我國公務員“福利腐敗”的治理研究

【摘要】:福利腐敗問題已經成為近年來公務員隊伍廉政建設中的一個重要問題。同一般的腐敗行為不同,公務員的福利腐敗是一種隱藏在正當福利名義之下的腐敗行為,這就決定了其腐敗行為的隱蔽性,造成了其治理過程中的巨大困難。從公務員福利腐敗的內容來看,涉及到公務員生活的方方面面。在當前社會轉型的大背景之下,公務員嚴重的福利腐敗與日益擴大的貧富差異形成了鮮明對比,損害了社會的公平正義與和諧穩(wěn)定。所以,公務員福利腐敗問題必須得到及時有效的治理。本次研究在全面推進依法治國,從嚴治黨新常態(tài)的背景下,對公務員福利腐敗問題從理論上進行了探討。本次研究除去引言外主要分為四個大部分:第一大部分是基礎理論部分。在對基本概念進行界定的基礎上,分析了正當福利與福利腐敗的區(qū)別,介紹了論文所涉及的三個主要理論:尋租理論、權力制衡理論和利益集團理論。第二部分分析了當前公務員福利腐敗的表現、特征及危害。第三大部分是現狀、問題及原因分析部分,分析了當前我國公務員福利腐敗治理所取得的成績,采取的措施,存在問題及原因。從目前來看,公務員福利腐敗問題雖然已經引起黨和國家以及學術界的重視,對公務員福利腐敗的治理也取得了一定的成績,遏制了公務員福利腐敗的進一步擴大。但是,關于公務員福利腐敗的治理尚處于初級階段,在法律法規(guī)的建設、監(jiān)督、制度執(zhí)行以及公務員教育等方面依然存在著一定的問題有待進一步解決。第四部分是公務員福利腐敗治理的對策部分。對公務員福利腐敗的治理是一個復雜而長期的過程,從以往的治理措施和成效來看,以部門性的制度規(guī)定來治理福利腐敗雖然取得了巨大的成績,但是,未來公務員福利腐敗的治理需要推進公務員福利腐敗治理的立法進程,以法律形式作為公務員福利腐敗治理的根本之策,同時,提升當前公務員福利腐敗治理的效力,需要積極落實相關制度規(guī)定,切實發(fā)揮制度的約束力,提升公務員福利腐敗的內部監(jiān)督效力,激發(fā)社會公眾監(jiān)督的活力,有針對性的對公務員福利腐敗進行系統(tǒng)的教育,增強公務員對福利腐敗的自律能力。
[Abstract]:The problem of welfare corruption has become an important issue in the construction of a clean government in the civil service in recent years. The welfare corruption of civil servants is a kind of corrupt behavior hidden under the name of legitimate welfare, which determines the concealment of their corrupt behavior and causes great difficulties in the process of governance. From the content of civil servant welfare corruption, it involves all aspects of civil servant life. Under the background of the current social transformation, the serious welfare corruption of civil servants is in sharp contrast with the widening gap between the rich and the poor, which damages the fairness, justice and harmony and stability of the society. Therefore, the civil service welfare corruption problem must be timely and effective management. Under the background of comprehensively promoting governing the country according to law and strictly governing the Party, this study probes into the problem of civil servant welfare corruption theoretically. In addition to the introduction, this study is divided into four main parts: the first part is the basic theory. On the basis of defining the basic concept, this paper analyzes the difference between legitimate welfare and welfare corruption, and introduces three main theories involved in this paper: rent-seeking theory, power balance theory and interest group theory. The second part analyzes the current civil service welfare corruption performance, characteristics and harm. The third part is the present situation, the problem and the reason analysis part, has analyzed our country civil servant welfare corruption management achievement, the adoption measure, the existence question and the reason. At present, although the problem of civil servant welfare corruption has attracted the attention of the Party, the state and the academic circles, the governance of civil servant welfare corruption has also made certain achievements, which has restrained the further expansion of civil service welfare corruption. However, the governance of civil servants' welfare corruption is still in the primary stage, and there are still some problems to be solved in the construction of laws and regulations, supervision, system implementation and civil servant education. The fourth part is the countermeasure part of civil servant welfare corruption management. The governance of civil servants' welfare corruption is a complicated and long-term process. From the point of view of the past governance measures and effects, although it has made great achievements to control the welfare corruption with the regulations of the departmental system, however, In the future, the governance of civil servants' welfare corruption needs to promote the legislative process of civil servants' welfare corruption governance, to take the form of law as the fundamental strategy of civil servants' welfare corruption governance, and at the same time, to enhance the effectiveness of the current civil servants' welfare corruption governance. It is necessary to actively implement the relevant system provisions, give full play to the binding force of the system, enhance the effectiveness of internal supervision of civil servants' welfare corruption, stimulate the vitality of public supervision, and systematically educate civil servants' welfare corruption. Enhance the self-discipline of civil servants on welfare corruption.
