【摘要】：城市化、工業(yè)化進(jìn)程瓦解了以習(xí)慣維持的自然秩序,轉(zhuǎn)向?qū)?chuàng)制秩序的追求,法律和政策就是創(chuàng)制秩序建構(gòu)的基本路徑。通過(guò)政策的制定和實(shí)施,社會(huì)中的異質(zhì)因素和不確定性都可以被納入這種具有普遍性效果的規(guī)范之內(nèi),社會(huì)秩序得以實(shí)現(xiàn)。但是,創(chuàng)制秩序是依托于社會(huì)治理的中心-邊緣結(jié)構(gòu)的,在此結(jié)構(gòu)之中,政策作為一種工具而存在,政策的制定和實(shí)施都是為了方便于中心對(duì)邊緣的管理,管理型的社會(huì)治理模式也就是因此而來(lái)。當(dāng)人類進(jìn)入高度復(fù)雜性與高度不確定性的后工業(yè)化歷史階段,政策制定者與政策對(duì)象之間的界限將逐漸消失,政策不再是工具性的存在,而是服務(wù)于行動(dòng)者的合作行動(dòng)的發(fā)生。在合作行動(dòng)中,政策將逐步突破工具性的狹隘視野,成為道德的載體,合作秩序也將隨之生成。
[Abstract]:The process of urbanization and industrialization broke down the natural order maintained by habit and turned to the pursuit of creating order. Law and policy are the basic path of creating order. Through the formulation and implementation of policies, the heterogeneity and uncertainty in the society can be brought into this kind of universal norms, and the social order can be realized. However, the creation of order is based on the center-edge structure of social governance. In this structure, policy exists as a tool, and the policy formulation and implementation are designed to facilitate the center's management of the edge. The social governance model of management type also comes because of this. When human beings enter the post-industrialization stage of high complexity and uncertainty, the boundary between policy makers and policy objects will gradually disappear. Policy is no longer a instrumental existence, but the occurrence of cooperative actions that serve the actors. In cooperative action, policy will gradually break through the narrow perspective of instrumentality and become the carrier of morality.
