【摘要】：中國(guó)經(jīng)濟(jì)的飛速發(fā)展和綜合國(guó)力的不斷增強(qiáng)使得國(guó)人參與慈善事業(yè)的意識(shí)不斷提升,我國(guó)的慈善組織也由此進(jìn)入了發(fā)展的快車道,主要體現(xiàn)在慈善組織數(shù)量大幅增加,慈善組織援助面不斷擴(kuò)大等方面。但由于我國(guó)有關(guān)慈善組織的各項(xiàng)政策制度尚未完善,尤其是全國(guó)性的慈善基本法遲遲未能出臺(tái),使得我國(guó)慈善組織的可持續(xù)發(fā)展陷入定位困境、合法性困境、公信力困境以及資源困境。文章主體分為四個(gè)部分。第一部分主要是講歷史上我國(guó)慈善組織的發(fā)展進(jìn)程,由古代慈善組織的雛形到近代慈善組織的發(fā)展,描述了慈善組織從組織形式到運(yùn)行理念的歷史轉(zhuǎn)變；第二部分主要講述了我國(guó)慈善組織的發(fā)展現(xiàn)狀以及慈善組織可持續(xù)發(fā)展面臨的困境,并在此基礎(chǔ)上,從慈善組織的管理體制、外部發(fā)展環(huán)境以及內(nèi)部運(yùn)營(yíng)機(jī)制等三個(gè)角度進(jìn)行了困境成因分析,揭示出我國(guó)有關(guān)慈善組織法律法規(guī)的不足、監(jiān)管和問責(zé)機(jī)制的缺失、行政化色彩濃重、公信力低下以及組織內(nèi)部人員素質(zhì)和基金運(yùn)營(yíng)水平都有待提高等問題。此外,文章在此還以“郭美美網(wǎng)絡(luò)炫富事件”以及“嫣然天使基金的困擾”為具體案例,暴露出我國(guó)慈善組織在實(shí)際操作過程中存在不少亟需改進(jìn)和優(yōu)化的薄弱環(huán)節(jié)；文章第三部分選取了英國(guó)和美國(guó)兩個(gè)慈善組織較為發(fā)達(dá)的國(guó)家,從較為宏觀的角度概述了這兩個(gè)國(guó)家慈善組織的發(fā)展?fàn)顩r并從中進(jìn)行有益的借鑒：通過協(xié)議建立合作伙伴關(guān)系、建立獨(dú)立于政府行政體系的國(guó)家監(jiān)督機(jī)構(gòu)、加大政府購(gòu)買社會(huì)組織服務(wù)的力度；第四部分針對(duì)前面提到的困境以及相關(guān)案例暴露出的問題,從傳統(tǒng)和創(chuàng)新兩個(gè)維度提出了促進(jìn)我國(guó)慈善組織的可持續(xù)發(fā)展的四點(diǎn)建議,分別是：完善政策法規(guī),理順“政慈”關(guān)系、構(gòu)建多層次全方位的監(jiān)督機(jī)制、加強(qiáng)慈善組織的專業(yè)化建設(shè)以及強(qiáng)化慈善組織的品牌效應(yīng)。中國(guó)慈善組織經(jīng)歷幾十年的發(fā)展已經(jīng)取得了可喜的進(jìn)步,雖然問題不少,但相信隨著國(guó)家綜合實(shí)力的繼續(xù)增強(qiáng),國(guó)人慈善意識(shí)的不斷提高,我國(guó)必將擁有一套組織健全、法律規(guī)范、自主性強(qiáng)的可持續(xù)發(fā)展的慈善組織事業(yè)體系。
[Abstract]:With the rapid development of China's economy and the continuous enhancement of the overall national strength, the awareness of Chinese people to participate in philanthropy has been continuously raised, and the charity organizations in our country have thus entered the fast track of development, mainly reflected in the substantial increase in the number of charitable organizations. Charitable organizations continue to expand the scope of aid and other aspects. However, the various policies and systems of charity organizations in our country have not been perfected, especially the national charity basic law has not been issued, which makes the sustainable development of charitable organizations in our country into a dilemma of positioning and legitimacy. Credibility dilemmas and resource dilemmas. The main body of the article is divided into four parts. The first part mainly talks about the development process of charity organization in history, from the embryonic form of ancient charity organization to the development of modern charity organization, and describes the historical transformation of charity organization from the form of organization to the concept of operation. The second part mainly describes the development of charitable organizations in China and the plight of the sustainable development of charitable organizations, and on this basis, from the management system of charitable organizations, From three angles of external development environment and internal operation mechanism, this paper analyzes the causes of predicament, reveals the deficiency of laws and regulations of relevant charitable organizations in China, the lack of supervision and accountability mechanism, and the heavy color of administration. Low credibility and the organization's internal staff quality and the level of fund operations need to be improved and so on. In addition, this article also takes "Guo Meimei network to show off the rich event" and "Yan ran angel fund trouble" as the concrete case, exposed our country charitable organization in the actual operation process has many urgent need to improve and optimize the weak link; In the third part of this paper, two developed countries, the United Kingdom and the United States, are selected to summarize the development of charitable organizations in the two countries from a macro point of view and draw useful lessons from them: establishing a partnership through agreement. The fourth part focuses on the difficulties mentioned above and the problems exposed in the relevant cases. From the two dimensions of tradition and innovation, this paper puts forward four suggestions to promote the sustainable development of charitable organizations in our country. They are: perfecting the policies and regulations, straightening out the relationship of "political kindness", and constructing a multi-level and omni-directional supervision mechanism. Strengthen the professional construction of charitable organizations and strengthen the brand effect of charitable organizations. China's charitable organizations have made gratifying progress through decades of development. Although there are many problems, it is believed that with the continued strengthening of the comprehensive strength of the country and the continuous improvement of the Chinese people's sense of charity, our country will have a sound organization. Legal norms, strong autonomy and sustainable development of charitable organizations and undertakings system.
