論我國(guó)中央與地方事權(quán)配置的法治化

【摘要】:中央與地方的關(guān)系始終是國(guó)家政治經(jīng)濟(jì)的核心問(wèn)題之一,而中央與地方的事權(quán)配置是其中的重要內(nèi)容。它關(guān)系著國(guó)家的政治穩(wěn)定、民族團(tuán)結(jié)和經(jīng)濟(jì)繁榮發(fā)展,關(guān)系著社會(huì)效率和資源流向。特別是現(xiàn)在中國(guó)正處于發(fā)展關(guān)鍵期,中央與地方事權(quán)配置問(wèn)題處理得當(dāng),就能有效發(fā)揮中央和地方的積極性,成為我國(guó)發(fā)展的助推劑,反之則反。因此,通過(guò)何種途徑使我國(guó)中央與地方事權(quán)配置問(wèn)題得到理性化地解決,成為我們急需研討的課題。十八屆三中全會(huì)提出的任何改革都要于法有據(jù)的指導(dǎo)思想,為中央與地方事權(quán)配置的關(guān)系問(wèn)題指明了方向。本文從中央與地方事權(quán)配置法治化的視角出發(fā)來(lái)研究中央與地方關(guān)系問(wèn)題,希望通過(guò)建立關(guān)于中央與地方之間各個(gè)層面的法律制度來(lái)規(guī)范二者行為,使其問(wèn)題通過(guò)法治方法來(lái)解決。文章共分為四個(gè)部分:第一部分從中央與地方事權(quán)配置的內(nèi)涵入手,繼而對(duì)我國(guó)中央與地方事權(quán)配置類型進(jìn)行分析,在此前提下,闡述了中央與地方事權(quán)配置法治化的必要性和基本原則等基本原理;第二部分著眼于中央與地方事權(quán)配置的異域經(jīng)驗(yàn)樣本,考慮到我國(guó)是單一制國(guó)家,著重就單一制集權(quán)模式和單一制分權(quán)模式進(jìn)行考察,以期為我國(guó)中央與地方事權(quán)配置法治化提供有益借鑒;第三部分對(duì)我國(guó)中央與地方事權(quán)配置現(xiàn)狀、存在的問(wèn)題及其原因進(jìn)行了詳細(xì)分析。這是基于中國(guó)現(xiàn)實(shí)的考量,也是我國(guó)中央與地方事權(quán)配置法治化必須植根的土壤;第四部分針對(duì)我國(guó)實(shí)現(xiàn)中央與地方事權(quán)配置法治化的具體路徑進(jìn)行了深入地探究。主要從三個(gè)層面進(jìn)行了論述:一是要更新觀念,實(shí)現(xiàn)我國(guó)中央與地方之間從行政放權(quán)到法治分權(quán)的轉(zhuǎn)變;二是要加強(qiáng)中央與地方事權(quán)配置的立法建設(shè),主要從完善憲法和修改制定中央與地方專門法及相關(guān)法律兩方面展開論述;三是對(duì)我國(guó)中央與地方事權(quán)配置的爭(zhēng)端解決機(jī)制進(jìn)行探究,指出要解決我國(guó)中央與地方事權(quán)配置中的沖突,除了利用具有預(yù)防功能的立法機(jī)制、高效便捷的行政解決機(jī)制外,還可以引入司法裁決機(jī)制,發(fā)揮司法權(quán)在中央與地方事權(quán)配置中的積極作用。本文認(rèn)為中央與地方的事權(quán)配置問(wèn)題只能通過(guò)法治化的途徑才能得到更好地解決,因此,我們必須從國(guó)家法治的高度,采取得力舉措,在中央與地方之間建立符合中國(guó)國(guó)情和民主政治發(fā)展要求的、有助于社會(huì)進(jìn)步和生產(chǎn)力發(fā)展的新型中央與地方事權(quán)配置機(jī)制,使中央與地方關(guān)系朝著更加健康的方向發(fā)展。
[Abstract]:The relationship between central government and local government is always one of the core problems of national politics and economy, and the allocation of power between central and local government is an important content. It relates to national political stability, national unity and economic prosperity, social efficiency and resource flow. Especially now that China is in a critical period of development, if the allocation of the central and local authorities is properly handled, the initiative of the central and local authorities can be effectively brought into play and become a booster for the development of our country, and vice versa. Therefore, it is urgent for us to solve the problem of the allocation of central and local authority rationally through what way. Any reform proposed by the third Plenary session of the 18th CPC Central Committee should be based on the guiding ideology of law, pointing out the direction of the relationship between the central and local authorities. This paper studies the relationship between the central and local authorities from the perspective of legalization of the allocation of power between the central and the local authorities, hoping to standardize their behavior by establishing legal systems at various levels between the central and local authorities. Let its problem be solved by the rule of law. The article is divided into four parts: the first part starts with the connotation of the allocation of the central and local authorities, and then analyzes the types of the allocation of the central and local authorities in China. The second part focuses on the foreign experience samples of central and local administrative power allocation, considering that China is a unitary country. Focusing on the single centralized power model and the single decentralization mode, in order to provide useful reference for the allocation of the central and local administration of power, the third part of China's central and local power allocation status quo, The existing problems and their causes are analyzed in detail. This is based on the consideration of the reality of China, and is also the soil where the legalization of the central and local administrative power allocation must be rooted. The fourth part makes a deep research on the specific path of realizing the legalization of the central and local administrative power allocation in China. It is mainly discussed from three aspects: first, to renew the concept, to realize the transformation from administrative decentralization to the rule of law between the central and local governments; second, to strengthen the legislative construction of the allocation of the central and local administrative powers. It mainly discusses from the two aspects of perfecting the constitution and amending and formulating the special laws of the central and local governments as well as the relevant laws. Third, it probes into the dispute settlement mechanism of the allocation of the central and local administrative powers in China. It is pointed out that in order to solve the conflict between the central and local authorities, the judicial adjudication mechanism can be introduced in addition to the legislative mechanism with preventive function and the efficient and convenient administrative settlement mechanism. Give full play to the positive role of judicial power in the allocation of central and local administrative powers. This paper holds that the allocation of administrative power between the central and local governments can only be better solved by means of the rule of law. Therefore, we must take effective measures from the height of the rule of law in the country. The establishment of a new central and local power allocation mechanism between the central and local governments, which conforms to China's national conditions and the requirements of democratic political development and is conducive to social progress and the development of productive forces, will make the relationship between the central and local authorities develop in a more healthy direction.
