【摘要】：鄰避風(fēng)險(xiǎn)治理已成為當(dāng)前社會(huì)治理的新難題。鄰避沖突的根源在于鄰避設(shè)施所致的風(fēng)險(xiǎn)分配不均衡,這種不均衡反映出傳統(tǒng)的單向度管制型行政模式的失靈。在價(jià)值多元的社會(huì),面對(duì)多元的利益訴求,政府壟斷決策、壓制抗?fàn)幍闹卫矸绞揭殉尸F(xiàn)應(yīng)對(duì)無(wú)力的困局,亟須轉(zhuǎn)變治理模式,革新治理手段,以回應(yīng)失衡的利益結(jié)構(gòu)。協(xié)商民主理論主張不同主體之間通過(guò)平等的對(duì)話、協(xié)商和參與,達(dá)成共識(shí),實(shí)現(xiàn)利益平衡,為鄰避沖突治理提供一個(gè)理想圖景。賦予協(xié)商過(guò)程以規(guī)范性,使平等協(xié)商成為一種制度化的程序,優(yōu)化行政決策模式,完善利益平衡機(jī)制,由單維管制治理模式邁向多元協(xié)商共治模式,是緩解鄰避矛盾、緩釋鄰避沖突的可行性路徑。
[Abstract]:Adjoining risk management has become a new problem of social governance. The root of conflict avoidance lies in the imbalance of risk distribution caused by adjacent facilities, which reflects the failure of the traditional administrative mode of one-dimensional control. In a society with multiple values, in the face of pluralistic interest demands, the government monopolizes the decision making and the governance mode of suppressing the struggle has presented a difficult situation to cope with. It is urgent to change the governance mode and innovate the governance means in order to respond to the unbalanced interest structure. The theory of deliberative democracy advocates that through equal dialogue, consultation and participation, the different subjects reach a consensus, realize the balance of interests, and provide an ideal prospect for the governance of conflict avoidance. To give the consultation process normative, to make equal consultation an institutionalized procedure, to optimize the administrative decision-making mode, to perfect the mechanism of interest balance, and to move from the single-dimensional regulatory governance model to the multi-consultative co-governing mode is to alleviate the conflict avoidance between neighbors. Feasible path of slow-release neighbor conflict avoidance.
