【摘要】：水污染治理是環(huán)境保護(hù)領(lǐng)域中的重要內(nèi)容,如今我國(guó)的水環(huán)境質(zhì)量不容樂觀。水污染第三方治理機(jī)制是引入市場(chǎng)因素的治理模式,在一定程度上可以緩解日趨嚴(yán)重的水污染問題。水污染第三方治理在我國(guó)處于萌芽發(fā)展階段,需要法律層面的制度保障,更加需要政府全過程的監(jiān)管。就目前我國(guó)實(shí)際情況來看,第三方市場(chǎng)準(zhǔn)入與退出機(jī)制的缺失、有待提高的運(yùn)行監(jiān)管、有待完善的環(huán)境監(jiān)管問責(zé)機(jī)制、執(zhí)法監(jiān)管資源不足等問題,這些都是政府履行監(jiān)管責(zé)任的障礙。官本位思想根深蒂固、雙重領(lǐng)導(dǎo)監(jiān)管機(jī)制的弊端、缺乏具體的規(guī)范法律體系、公眾參與流于形式等,這些都是影響政府履行監(jiān)管責(zé)任的原因。本文通過對(duì)上述問題的闡述,對(duì)實(shí)踐中政府履行監(jiān)管責(zé)任存在的問題提出以下建議措施:第一,政府制定統(tǒng)一合理的資質(zhì)審查標(biāo)準(zhǔn),建立準(zhǔn)入機(jī)制;第二,建立合理分責(zé)制度,明晰雙方主體責(zé)任的分擔(dān),加強(qiáng)對(duì)違法主體的處罰,確保有效的運(yùn)行監(jiān)管;第三,制定規(guī)范的第三方治理效果評(píng)價(jià)標(biāo)準(zhǔn)和退出管理辦法,建立退出機(jī)制;第四,整合現(xiàn)有機(jī)構(gòu)設(shè)立獨(dú)立專門的問責(zé)機(jī)構(gòu),加強(qiáng)權(quán)力機(jī)關(guān)與司法機(jī)關(guān)問責(zé),擴(kuò)展政府承擔(dān)責(zé)任方式,保障問責(zé)制度的有效實(shí)施;第五,加大對(duì)地方監(jiān)管資源的補(bǔ)充,提高環(huán)境監(jiān)管的公眾參與度緩解監(jiān)管執(zhí)法資源緊缺的局面。
[Abstract]:Water pollution control is an important content in the field of environmental protection. Nowadays, the quality of water environment in China is not optimistic. The third party governance mechanism of water pollution is the management mode of introducing market factors, which can alleviate the increasingly serious water pollution problem to a certain extent. The third party management of water pollution is in the stage of germination and development in China, and it needs legal layer. In view of the current situation of our country, the lack of third party market access and exit mechanism, the need to improve the operation supervision, the imperfect environmental supervision mechanism and the shortage of law enforcement supervision resources, are all obstacles to the government's supervision responsibility. Deep-rooted, the disadvantages of dual leadership regulatory mechanism, the lack of specific legal system, public participation in the form and so on, these are the reasons for the government to carry out the responsibility of supervision. This article, through the elaboration of the above problems, puts forward the following suggestions on the problems existing in the implementation of the government's supervision responsibility in practice: first, the government makes unity. Reasonable qualification examination standards, establish access mechanism; second, establish a reasonable system of responsibility, clear the share of the responsibility of the two sides, strengthen the punishment of the illegal subject, ensure effective operation supervision; third, establish standard third party management effect evaluation standard and exit management method, establish exit mechanism; fourth, integrate existing institutions to set up Independent and specialized accountability institutions, strengthen the accountability of the authority and the judiciary, expand the government to take responsibility and ensure the effective implementation of the accountability system; fifth, increase the complement of local regulatory resources, and improve the public participation of environmental supervision to alleviate the shortage of supervision and law enforcement resources.
