困境兒童權(quán)益保障中的政府責(zé)任

【摘要】:近年來(lái),“困境兒童”一詞頻現(xiàn)于政府文件和新聞媒介,困境兒童問(wèn)題已成為政府和社會(huì)公眾共同關(guān)注的社會(huì)問(wèn)題。我們把處于生理性困境或遇到社會(huì)性困境的兒童統(tǒng)歸為“困境兒童”,本文中困境兒童主要指事實(shí)無(wú)人撫養(yǎng)兒童、父母不適格兒童、重病重殘兒童和貧困兒童。創(chuàng)建服務(wù)型政府,是我國(guó)政府行政改革的總目標(biāo)之一,為困境兒童提供服務(wù)和保障,有助于落實(shí)政府保護(hù)弱勢(shì)群體的職能,進(jìn)而推動(dòng)服務(wù)型政府的建設(shè)。本文一共包括六部分。第一部分為緒論。第二部分先提出困境兒童權(quán)益受損形勢(shì)嚴(yán)峻,主要表現(xiàn)在生存權(quán)受侵害、發(fā)展權(quán)無(wú)保障、受保護(hù)權(quán)沒(méi)夯實(shí)、參與權(quán)未重視四方面,另外,就困境兒童權(quán)益受損成因進(jìn)行了分析。第三部分在闡述困境兒童保護(hù)中政府已有努力的基礎(chǔ)上,剖析了目前存在的不足,包括法律制度不完善、社會(huì)管理有疏漏、公共服務(wù)不配套。第四部分,結(jié)合服務(wù)型政府理論和公共服務(wù)理念,從政府的職能角度出發(fā),強(qiáng)調(diào)服務(wù)型政府理應(yīng)滿足困境兒童的利益訴求,幫扶困境兒童這一弱勢(shì)群體是服務(wù)型政府的分內(nèi)職責(zé)。第五部分,是本論文的核心內(nèi)容,提出政府在困境兒童權(quán)益保障中應(yīng)該如何履行責(zé)任,具體措施有:完善法律法規(guī),建立健全困境兒童保障制度,夯實(shí)政府的社會(huì)管理職責(zé),推進(jìn)困境兒童公共服務(wù)均等化,加大政府的財(cái)政投入。第六部分為結(jié)論,總結(jié)了本文的不足之處,并展望了困境兒童工作的前景。履行保護(hù)困境兒童的責(zé)任是服務(wù)型政府不可推卸的責(zé)任,政府要高度重視維護(hù)、保障困境兒童的權(quán)益。但目前困境兒童工作還存在很多不足之處,本文將探討困境兒童權(quán)益保障中的政府責(zé)任,希望可以為政府工作提出有用的建議,進(jìn)而保障困境兒童合法權(quán)益。
[Abstract]:In recent years, the phrase "difficult children" is present in government documents and news media. The problem of children in dilemma has become a social issue of common concern to the government and the public. Discomfort children, seriously ill disabled children and poor children. Creating a service-oriented government is one of the general objectives of the government's administrative reform, providing services and security for children in trouble, helping the government to protect the functions of the vulnerable groups and promoting the construction of a service-oriented government. This article includes six parts. The first part is the introduction. Second In the first part, the situation of the impaired children's rights and interests is seriously damaged, mainly manifested in the right to survival is infringed, the right to development is not guaranteed, the right of protection is not rammed, the right of participation is not attached to four aspects. In addition, the cause of the cause of the impaired children's rights and interests is analyzed. The third part analyses the present efforts of the government in the protection of the plight of children. The deficiencies exist, including the imperfect legal system, the omission of social management and the public service. In the fourth part, combining the theory of service-oriented government and the concept of public service, from the point of view of the government's function, it emphasizes that the service-oriented government should meet the interests of the difficult children and help the vulnerable group to be a service-oriented government. The fifth part is the core content of this paper. It puts forward how the government should fulfill the responsibility in the protection of the rights and interests of children in trouble. The specific measures include: perfecting the laws and regulations, establishing and perfecting the security system for the children in trouble, consolidating the government's social management responsibilities, promoting the equalization of the public service for the children in trouble, and increasing the government's financial input. The six part is the conclusion, summarizing the shortcomings of this article, and looking forward to the prospects for the work of the difficult children. To fulfill the responsibility of protecting the difficult children is the unshirkable responsibility of the service-oriented government. The government should attach great importance to the maintenance and protect the rights and interests of the children in trouble. However, there are many shortcomings in the work of children in difficult situation at present, and this paper will discuss the difficulties. The government responsibility in the protection of children's rights and interests is expected to provide useful suggestions for the government's work, so as to protect the legitimate rights and interests of children in distress.
