溫州市突發(fā)環(huán)境事件應(yīng)急管理的問(wèn)題和對(duì)策研究

【摘要】:隨著中國(guó)經(jīng)濟(jì)社會(huì)的高速發(fā)展,工業(yè)化和城鎮(zhèn)化的不斷推進(jìn),近年來(lái)經(jīng)濟(jì)發(fā)展累積起來(lái)的環(huán)境問(wèn)題不斷顯現(xiàn),環(huán)境保護(hù)工作面臨前所未有的壓力和挑戰(zhàn)。當(dāng)前我國(guó)環(huán)境風(fēng)險(xiǎn)不斷加劇,環(huán)境不斷惡化的情況尚未得到有效遏制,各種突發(fā)環(huán)境污染事件頻發(fā),造成公眾生命、財(cái)產(chǎn)的重大損失和生態(tài)環(huán)境的嚴(yán)重破壞,環(huán)境污染問(wèn)題已成為我國(guó)當(dāng)前公眾關(guān)注的焦點(diǎn)。新修訂的《中華人民共和國(guó)環(huán)境保護(hù)法》和《國(guó)家突發(fā)環(huán)境事件應(yīng)急預(yù)案》對(duì)環(huán)境管理和環(huán)境應(yīng)急工作進(jìn)行了規(guī)范,提出了更高的要求。但由于歷史欠賬的原因,我國(guó)當(dāng)前突發(fā)環(huán)境污染事件的發(fā)生率比較高,環(huán)境應(yīng)急管理在風(fēng)險(xiǎn)防范、事故預(yù)警、應(yīng)急保障、事故處置、公眾參與和善后工作等各個(gè)階段工作中,都存在著諸多不足。研究和探討政府如何履行環(huán)境應(yīng)急管理的責(zé)任,提高突發(fā)環(huán)境事件應(yīng)急管理的能力,建立環(huán)境應(yīng)急管理的機(jī)制,控制和減少突發(fā)環(huán)境事件的影響,有著重要的現(xiàn)實(shí)意義。溫州市是我國(guó)首批開(kāi)放的十四個(gè)沿海城市之一,也是國(guó)家金融綜合改革試驗(yàn)區(qū),民營(yíng)經(jīng)濟(jì)發(fā)達(dá),社會(huì)經(jīng)濟(jì)活動(dòng)頻繁。溫州市作為全國(guó)輿論關(guān)注的重點(diǎn)城市,在突發(fā)環(huán)境事件應(yīng)急管理的建設(shè)方面取得了一定成效,環(huán)境應(yīng)急體系也在不斷完善,某些方面還走在全國(guó)的前列。但是溫州市的環(huán)境安全問(wèn)題還很突出,重特大環(huán)境事故隱患尚未完全消除,近年來(lái)一系列環(huán)境突發(fā)事件也成為全國(guó)的熱點(diǎn)。溫州市是中國(guó)經(jīng)濟(jì)社會(huì)快速發(fā)展和環(huán)境問(wèn)題逐漸顯現(xiàn)的發(fā)達(dá)地區(qū)代表性城市,以溫州為典型對(duì)全國(guó)環(huán)境應(yīng)急管理進(jìn)行分析,有一定的借鑒意義。本文以發(fā)生在溫州的“牛奶河”環(huán)境應(yīng)急事件為例,介紹了“牛奶河”事件的經(jīng)過(guò)、事件的應(yīng)急處置、事故的發(fā)生原因以及事故的影響后果,分析了溫州環(huán)境應(yīng)急管理部門(mén)的應(yīng)對(duì)措施、成效和應(yīng)對(duì)不足的地方。在風(fēng)險(xiǎn)管理、應(yīng)急預(yù)案、應(yīng)急處置、后期工作等方面總結(jié)了溫州環(huán)境事件應(yīng)急管理的經(jīng)驗(yàn)啟示,對(duì)完善溫州市突發(fā)環(huán)境污染事件應(yīng)急管理體系提出了新構(gòu)想;谇拔牡姆治,并借鑒國(guó)外先進(jìn)城市在應(yīng)急管理方面的做法,對(duì)完善溫州市突發(fā)環(huán)境污染事件應(yīng)急管理體系作了探討。提出要從完善環(huán)境應(yīng)急組織結(jié)構(gòu)、預(yù)防機(jī)制、應(yīng)急監(jiān)測(cè)能力、信息機(jī)制、聯(lián)動(dòng)機(jī)制、善后處置等方面入手,特別強(qiáng)調(diào)要發(fā)揮國(guó)家、社會(huì)團(tuán)體和公民在環(huán)境應(yīng)急管理中的作用,重視“事前減災(zāi)”,發(fā)展環(huán)境應(yīng)急的科學(xué)技術(shù),加強(qiáng)環(huán)境應(yīng)急的保障,進(jìn)行環(huán)境應(yīng)急的公眾教育、建立環(huán)境保險(xiǎn)體系、開(kāi)展環(huán)境公益訴訟等措施,提出了構(gòu)建和完善溫州市環(huán)境污染應(yīng)急管理體系的對(duì)策和新建議,對(duì)提升我國(guó)城市環(huán)境應(yīng)急能力,預(yù)防和減少環(huán)境突發(fā)事件造成的損失,有一定的借鑒意義。
[Abstract]:With the rapid development of China's economy and society, industrialization and urbanization, the environmental problems accumulated by economic development in recent years continue to appear, and environmental protection is faced with unprecedented pressure and challenges.At present, the environmental risks in our country are continuously increasing, and the situation of environmental deterioration has not yet been effectively curbed. A variety of sudden environmental pollution incidents occur frequently, resulting in heavy loss of public life and property and serious damage to the ecological environment.Environmental pollution has become the focus of public concern in China.The newly revised "Environmental Protection Law of the people's Republic of China" and "the State Emergency Plan for Environmental Emergencies" have standardized the environmental management and environmental emergency work and put forward higher requirements.However, due to the historical default, the incidence of environmental pollution emergencies in China is relatively high. Environmental emergency management works in various stages, such as risk prevention, accident early warning, emergency protection, accident disposal, public participation and aftercare work, etc.There are many shortcomings.It is of great practical significance to study and discuss how the government can fulfill the responsibility of environmental emergency management, improve the ability of emergency management of environmental emergencies, establish the mechanism of environmental emergency management, and control and reduce the impact of environmental emergencies.Wenzhou is one of the first 14 coastal cities open to the outside world in our country. It is also the experimental area of national comprehensive financial reform. The private economy is developed and the social economic activities are frequent.Wenzhou, as the key city of national public opinion, has made some achievements in the construction of emergency management of unexpected environmental events, the environmental emergency system is also constantly improving, and some aspects are still in the forefront of the country.However, the environmental safety problem in Wenzhou is still outstanding, the hidden danger of serious environmental accident has not been completely eliminated, and a series of environmental emergencies have become a hot spot in China in recent years.Wenzhou is a representative city in developed regions with rapid economic and social development and environmental problems. It is of great significance to analyze the national environmental emergency management with Wenzhou as a typical example.Taking the "milk river" environmental emergency event in Wenzhou as an example, this paper introduces the course of the "milk river" incident, the emergency treatment of the incident, the cause of the accident and the effect of the accident.This paper analyzes the countermeasures, effectiveness and insufficient measures of Wenzhou environmental emergency management department.In the aspects of risk management, emergency plan, emergency disposal, and later work, this paper summarizes the experience and enlightenment of Wenzhou environmental emergency management, and puts forward a new conception to perfect the emergency management system of Wenzhou environmental pollution emergency.Based on the previous analysis and drawing lessons from the practice of foreign advanced cities in emergency management, this paper discusses how to improve the emergency management system of environmental pollution emergencies in Wenzhou.From the aspects of perfecting the organizational structure of environmental emergency response, prevention mechanism, emergency monitoring ability, information mechanism, linkage mechanism, post-treatment and so on, the paper puts special emphasis on the role of the state, social groups and citizens in environmental emergency management.Attaching importance to "disaster reduction beforehand", developing science and technology for environmental emergencies, strengthening the protection of environmental emergencies, carrying out public education on environmental emergencies, establishing an environmental insurance system, and carrying out environmental public interest litigation, etc.The countermeasures and new suggestions for constructing and perfecting the emergency management system of Wenzhou's environmental pollution are put forward, which can be used for reference to improve the ability of urban environmental emergency in China and to prevent and reduce the losses caused by environmental emergencies.
