【摘要】：“大部制”改革,即大部門體制改革,因其具備顯著優(yōu)勢而成為不少國家和地區(qū)普遍采用的政府機(jī)構(gòu)改革模式。近年來,我國政府機(jī)構(gòu)也將其作為深化行政體制改革的一個重要環(huán)節(jié),進(jìn)行了機(jī)構(gòu)改革。在大部制改革的浪潮之下,如何建立一個廉潔高效、運(yùn)轉(zhuǎn)協(xié)調(diào)、行為規(guī)范的道路路政管理體制,是一個值得深入探討的問題。廣州市作為國內(nèi)道路路網(wǎng)發(fā)達(dá)的城市之一,在交通行政管理方面所遇到的問題,與其他城市、地區(qū)具有一定的普遍性;另外,廣州市作為廣東省人民政府所在地的市,無論在行政級別還是立法權(quán)限上均具有一定的代表性。本文將通過文本分析、實(shí)證分析、調(diào)研走訪、文獻(xiàn)分析等研究方法,從法治的角度探索如何在廣州市大部制改革的契機(jī)下實(shí)現(xiàn)具有協(xié)同特色的道路路政一體化管理模式,擬制定公路與城市道路統(tǒng)一適用的地方性法規(guī),以一體化的具有協(xié)同創(chuàng)新特色的管理模式實(shí)施道路路政管理,促進(jìn)交通行政權(quán)的統(tǒng)一,推動廣州市道路路政管理高效運(yùn)作,從而達(dá)到加強(qiáng)和規(guī)范道路路政管理,保障道路完好、安全和暢通的道路行政管理目的。本文分為五個部分對“大部制視角下廣州市路政一體化法治研究”這一命題進(jìn)行探討。首先,本文界定了文章涉及的基本概念,闡述了大部門制改革及道路路政管理的內(nèi)涵。其次,回顧了廣州市政府機(jī)構(gòu)改革的歷史沿革,著重從法律適用與管理機(jī)制兩個方面進(jìn)行探討,歸納了廣州市道路路政管理在大部制改革背景下的發(fā)展、現(xiàn)狀與問題。再者,通過借鑒國內(nèi)外路政管理的有益做法并分析總結(jié),探索具有廣州市特色的一體化的協(xié)同管理模式,分別從合法性、合理性、必要性的角度進(jìn)行可行性分析。然后從制定統(tǒng)一適用的地方性法規(guī)、在大部制改革的契機(jī)下整合部門職權(quán)并健全內(nèi)部職能體系、設(shè)立具有協(xié)同特色的工作機(jī)制、完善多元監(jiān)督渠道等角度提出構(gòu)建廣州市道路路政一體化管理模式的建議。最后,總結(jié)全文的思路和意義。
[Abstract]:"Big department system reform, namely department system reform, the reform of government institutions mode is widely used in many countries and regions because of its advantages. In recent years, China's government agencies will also serve as an important part of deepening the reform of administrative system, carried out institutional reforms. Under the big department system reform the tide, how to build a clean and efficient, well coordinated and standardized road road administration system, is a problem worthy of further exploration. One of the Guangzhou city as the road network developed city, encountered in the traffic administrative management problems, and other areas of the city, has a certain universality; in addition, as the people's Government of Guangdong province is located in Guangzhou City, which is a representative in the administrative level or legislative authority. In this paper, through empirical analysis, text analysis, research visits, literature Analysis and other research methods, to explore how to realize a road road integration management mode in the collaborative features Department of Guangzhou city an opportunity to reform from the angle of law, the local regulations of highway and city road unified, with the integration of collaborative innovation with characteristics of the management mode of the implementation of the road traffic management, promote unified administration right, to promote the Guangzhou City Road and road management and efficient operation, so as to strengthen and standardize the management of road, road protection intact, safe and smooth road administrative purposes. This thesis consists of five parts of the "study" the integration of rule of law in Guangzhou city from the perspective of the proposition. First of all, this paper defines the basic concepts involved in this paper, expounds the connotation of system reform and road road management departments. Secondly, review of the Guangzhou municipal government institutional reform history Leather, two aspects from the legal application and management mechanism, summarizes the development path of road management in Guangzhou city under the background of big department system reform, current situation and problems. Furthermore, by drawing lessons from the domestic and foreign highway management and analysis, to explore the integration of collaborative management mode in Guangzhou city has characteristics, respectively.
