我國(guó)農(nóng)村校車服務(wù)公私合作供給中的政府監(jiān)管研究

【摘要】:近三年來(lái),我國(guó)發(fā)生了50余起校車安全事故,其中重大事故13起。如此觸目驚心的數(shù)字,將校車服務(wù)、校車服務(wù)的安全運(yùn)營(yíng)帶進(jìn)大眾的視野之中,校車安全這一話題逐漸引起了社會(huì)各界的關(guān)注,各級(jí)政府也開(kāi)始著重發(fā)展校車事業(yè)。校車的含義(用于接送不少于5名處于義務(wù)教育階段的學(xué)生及其照管人員上下學(xué)的車輛)和屬性(公益性)決定了校車服務(wù)是一種特殊的公共服務(wù),并且政府必須是它的第一責(zé)任主體。隨著教育體制改革、城鎮(zhèn)化腳步的逐漸加快以及“撤點(diǎn)并!闭叩拇罅(shí)施,我國(guó)農(nóng)村地區(qū)對(duì)于校車服務(wù)的需求愈發(fā)強(qiáng)烈。但是農(nóng)村地區(qū)的教育資源投入少、財(cái)政資金壓力巨大,政府不可能作為單一供給主體提供校車服務(wù),因此政府有必要將市場(chǎng)主體引入農(nóng)村校車服務(wù)中,合作供給模式可以緩解政府的財(cái)政壓力,維護(hù)教育資源的公平配置。但是,當(dāng)市場(chǎng)主體進(jìn)入校車服務(wù)后,政府對(duì)于校車服務(wù)的監(jiān)管變得更加復(fù)雜,多個(gè)供給主體必然導(dǎo)致權(quán)責(zé)不清、滋生腐敗等現(xiàn)象,而這些不良現(xiàn)象的產(chǎn)生勢(shì)必影響到校車服務(wù)的順利開(kāi)展和安全運(yùn)營(yíng)。為了從根本上解決校車服務(wù)的安全問(wèn)題,政府部門必須提升對(duì)校車服務(wù)的監(jiān)管力度、改善監(jiān)管方式。本文以芝加哥學(xué)派波斯納提出的公共利益理論為指導(dǎo),將校車服務(wù)市場(chǎng)化作為農(nóng)村校車服務(wù)順利開(kāi)展的前提,以政府監(jiān)管作為切入點(diǎn),從校車服務(wù)的立法、運(yùn)營(yíng)過(guò)程中的監(jiān)管以及校車服務(wù)的進(jìn)、退機(jī)制為出發(fā)點(diǎn),力爭(zhēng)解決解決農(nóng)村校車服務(wù)中的監(jiān)管問(wèn)題,希望以完善政府對(duì)校車服務(wù)的監(jiān)管保障農(nóng)村兒童享受到安全的校車服務(wù)。筆者將本論文分為五大章節(jié)(三部分),第一部分主要是提出論文要解決的主要問(wèn)題,并針對(duì)農(nóng)村校車服務(wù)中的問(wèn)題介紹必要的背景、理論依據(jù)和相關(guān)研究。第二部分則是結(jié)合農(nóng)村校車服務(wù)中政府監(jiān)管的現(xiàn)狀,分析問(wèn)題產(chǎn)生的原因,然后進(jìn)行必要的理性分析。最后,根據(jù)我國(guó)的實(shí)際情況,提出解決問(wèn)題的方法,力爭(zhēng)為農(nóng)村校車服務(wù)公私合作供給模式下的政府監(jiān)管提供有效的改進(jìn)意見(jiàn),最終保障農(nóng)村校車服務(wù)安全的、順利的運(yùn)營(yíng)。
[Abstract]:In the past three years, more than 50 school bus safety accidents have occurred in China, of which 13 are major accidents. Such shocking figures bring the safe operation of school bus service and school bus service into the public's view. The topic of school bus safety has gradually attracted the attention of all walks of life. Governments at all levels have also begun to focus on the development of school buses. The meaning of school buses (used to transport not less than 5 students in compulsory education and their carers to and from school) and attributes (commonweal) determines school bus service. Is a special kind of public service, And the government must be the main body of its primary responsibility. With the reform of the education system, the pace of urbanization is gradually quickening and the policy of "withdrawing points and combining schools" has been vigorously implemented. The demand for school bus service in rural areas of our country is more and more intense. However, the education resources in rural areas are less and the financial capital pressure is enormous, so the government can not provide school bus service as a single main supply. Therefore, it is necessary for the government to introduce the market main body into the rural school bus service. The cooperative supply mode can relieve the financial pressure of the government and maintain the fair allocation of educational resources. However, when the market main body enters the school bus service, The government's supervision of school bus services has become more complicated, and many suppliers will inevitably lead to unclear powers and responsibilities and corruption. However, the emergence of these undesirable phenomena will inevitably affect the smooth development and safe operation of the school bus service. In order to fundamentally solve the safety problem of the school bus service, government departments must enhance the supervision of the school bus service. Under the guidance of the theory of public interest put forward by Posner of Chicago School, this paper regards the marketization of school bus service as the prerequisite for the smooth development of school bus service in rural areas, and takes government supervision as the starting point from the point of view of the legislation of school bus service. The supervision in the operation process and the advance and retreat mechanism of the school bus service are taken as the starting point to solve the problem of supervision in the rural school bus service. I hope to improve the government supervision of school bus services to ensure rural children enjoy safe school bus services. This paper is divided into five chapters (three parts, the first part is to propose the main problems to be solved. And introduce the necessary background, theoretical basis and related research in view of the problems in rural school bus service. The second part is to analyze the reasons of the problems in combination with the current situation of government supervision in rural school bus service. Finally, according to the actual situation of our country, put forward the solution to the problem, and strive to provide effective improvement advice for the government supervision under the mode of public-private cooperative supply of rural school bus service. Finally ensure the rural school bus service safety, smooth operation.
