基于權(quán)力結(jié)構(gòu)轉(zhuǎn)型的地方政府治理變革研究

【摘要】:轉(zhuǎn)型期的中國,地方政府在治理變革中推動了大量的政府治理創(chuàng)新。這種轉(zhuǎn)型中的嘗試,使得權(quán)力結(jié)構(gòu)從穩(wěn)定的靜態(tài)向發(fā)展的動態(tài)轉(zhuǎn)變。學(xué)者們一直都在反思如何才能真正有效實現(xiàn)地方政府的治理變革目標(biāo),并有許多的研究嘗試從權(quán)力結(jié)構(gòu)角度來分析地方政府治理變革中產(chǎn)生的各種問題。對此,學(xué)界普遍認(rèn)為:任何形式的地方政府創(chuàng)新,都必然帶來對既有權(quán)力結(jié)構(gòu)的破除。但已有研究尚未系統(tǒng)解釋權(quán)力結(jié)構(gòu)的轉(zhuǎn)型與地方政府的治理變革兩者間的內(nèi)在聯(lián)系,也因此留給了我們“兩者間究竟是何關(guān)系、兩者相互間會有什么樣的影響以及如何引導(dǎo)兩者間的關(guān)系發(fā)展”這樣的研究命題。在這樣的理論與現(xiàn)實需求之下,本項研究以權(quán)力結(jié)構(gòu)為切入點,通過分析集權(quán)化權(quán)力結(jié)構(gòu)下的地方政府治理現(xiàn)狀來揭示地方政府治理變革過程中權(quán)力結(jié)構(gòu)轉(zhuǎn)型發(fā)生的必然性;并就集權(quán)化權(quán)力結(jié)構(gòu)下的地方政府治理變革作系統(tǒng)分析,進而運用案例研究方法,重點分析集權(quán)化權(quán)力結(jié)構(gòu)模式下形成的“地方政府創(chuàng)新”路徑、“省管縣改革”路徑、“開發(fā)區(qū)”路徑三大典型地方治理變革路徑中,以及“管委會-公司”模式、“項目制”模式和“土地-金融-財政”模式三大典型地方政府治理變革模式中所呈現(xiàn)出的權(quán)力結(jié)構(gòu)轉(zhuǎn)型的規(guī)律。在上述個案研究過程中全面分析權(quán)力結(jié)構(gòu)轉(zhuǎn)型與地方政府治理變革間的各種關(guān)系,并進而在宏觀上探討集權(quán)化權(quán)力結(jié)構(gòu)向法治化權(quán)力結(jié)構(gòu)轉(zhuǎn)型的各個問題。研究形成了以下觀點:1、權(quán)力結(jié)構(gòu)的主體要素與行為要素,是影響地方政府治理變革的兩個關(guān)鍵要素。因此,權(quán)力結(jié)構(gòu)的轉(zhuǎn)型首先必須是主體向多元與平等轉(zhuǎn)型。地方政府實現(xiàn)治理變革目標(biāo)的重要前提,即對集權(quán)權(quán)力結(jié)構(gòu)下所形成的控制關(guān)系、博弈關(guān)系和共謀關(guān)系的破除。主體與行為要素轉(zhuǎn)變的過程,唯有借助權(quán)力結(jié)構(gòu)的轉(zhuǎn)型方具有可能。2、集權(quán)化權(quán)力結(jié)構(gòu)下的地方政府治理變革選擇了漸進式改革路徑,但該路徑無法解決地方政府職權(quán)配置中的非法治化所帶來的公共治理困境。以治理為導(dǎo)向的地方政府改革受到了集權(quán)化權(quán)力結(jié)構(gòu)的嚴(yán)重制約而造成了權(quán)力邊界不清、權(quán)力層級沖突嚴(yán)重、權(quán)力影響市場發(fā)展等等問題,解決這些問題必須從權(quán)力結(jié)構(gòu)轉(zhuǎn)型入手。3、集權(quán)化權(quán)力結(jié)構(gòu)下的地方政府治理轉(zhuǎn)型實踐,既實現(xiàn)了對現(xiàn)在權(quán)力結(jié)構(gòu)的突破,又陷入到了新的權(quán)力結(jié)構(gòu)陷阱中。地方政府治理變革的三種路徑和三種模式均是對當(dāng)下權(quán)力結(jié)構(gòu)的挑戰(zhàn),也均在一定時間、一定范圍內(nèi)實現(xiàn)了對當(dāng)下權(quán)力結(jié)構(gòu)的突破。但均屬于治標(biāo)不治本。4、保障地方政府治理變革的效果,首先必須獲得主體要素的突破,即轉(zhuǎn)變集權(quán)化權(quán)力結(jié)構(gòu)下的權(quán)力主體制度設(shè)計,由人治化權(quán)力決策和運行機制轉(zhuǎn)向法治化的權(quán)力決策和運行機制;其次須轉(zhuǎn)變權(quán)力主體的行動策略,由控制、博弈、共謀行為方式轉(zhuǎn)向依據(jù)法律而建構(gòu)的平等對話行為方式。

Under such theoretical and practical needs, this research takes the power structure as the starting point, to reveal the necessity of power structure transformation process of governance reform in local government through the analysis of the management of local government centralized power structure under the current situation; and Analysis on centralized governance reform of local government power structure of the system, and then use the the method of case study, focuses on the analysis of centralized power structure under the mode of formation of the "local government innovation path", "province governing county" reform path, "development zone" path of the three typical local governance reform path, and the "CMC - company" mode, "the transformation of power structure presents the mode change of project system" mode and the "land finance finance" model of the three typical local government governance in law. The reform of local government is seriously restricted by the centralization of power structure caused by the power boundary is not clear, power level conflicts, power market development and so on, these problems must be solved by the power structure of.3 transformation, transformation of local governance practice of centralization of power structure, not only realizes the power structure of now the breakthrough, and into the trap in the new power structure. Three kinds of path of transformation of local government administration and the three models are on the current power structure challenges are in a certain period of time, within a certain range of the current power structure breakthrough. But are palliatives.4, protection of local government the effect of governance reform, we must first obtain the main elements of the breakthrough, change of main power system design of centralized power structure, the rule and mechanism of decision-making power steering The power decision-making and operation mechanism of rule by law is changed.
