【摘要】：目前,我國各項(xiàng)制度深化改革,社會(huì)經(jīng)濟(jì)建設(shè)高速發(fā)展,但社會(huì)法治建設(shè)進(jìn)程緩慢,公民法律素養(yǎng)有待提升。如何應(yīng)對轉(zhuǎn)型給社會(huì)穩(wěn)定帶來的種種壓力與挑戰(zhàn),如何扼制繁雜多元的涉法涉訴信訪矛盾沖突,鞏固社會(huì)的和諧穩(wěn)定,傳統(tǒng)信訪工作方式方法正遭遇瓶頸。面對大量涌現(xiàn)的新舊交疊的社會(huì)矛盾和社會(huì)問題,政法機(jī)關(guān)處理的大量各類矛盾糾紛的壓力也與日俱增,涉法涉訴信訪陷入管控失效的局面,重訪纏訪、越級上訪現(xiàn)象凸顯,涉法涉訴信訪積案難以終結(jié),使得我國司法權(quán)威性和公正性受到強(qiáng)烈質(zhì)疑。社會(huì)治理體制不斷深化改革,在《關(guān)于進(jìn)一步加強(qiáng)新時(shí)期信訪工作的意見》與《關(guān)于創(chuàng)新群眾工作方法解決信訪突出問題的意見》的政策指導(dǎo)下,信訪工作部門積極探索創(chuàng)新信訪工作方式方法,試圖引入社會(huì)第三方力量參與化解信訪矛盾糾紛,緩解信訪困境。2015年,為借助律師隊(duì)伍專業(yè)、親和、中立的執(zhí)業(yè)優(yōu)勢,重塑并強(qiáng)化符合依法治國理念的律師社會(huì)責(zé)任,《關(guān)于建立律師參與化解和代理涉法涉訴信訪案件制度的意見》正式提出要引入律師參與涉法涉訴信訪矛盾化解工作。該制度充分發(fā)揮律師隊(duì)伍的優(yōu)勢作用,促使律師參與并輔助政法機(jī)關(guān)緩和涉法涉訴信訪矛盾沖突,加強(qiáng)公權(quán)力機(jī)關(guān)與信訪群眾的有效溝通,瓦解信訪群眾“信訪不信法”的惡性根源,將涉法涉訴信訪問題引向法治救濟(jì)、終結(jié)軌道,深化涉法涉訴信訪工作的多元改革。綜上所述,針對律師參與化解和代理涉法涉訴信訪案件問題展開理論研究與實(shí)踐討論就顯得尤為迫切了。在本文中,筆者將從涉法涉訴信訪問題的政策法律依據(jù)、實(shí)踐調(diào)研探索、制度問題及原因分析、建立并完善律師參與涉法涉訴信訪案件制度等四個(gè)方面展開討論。依據(jù)各地實(shí)踐經(jīng)驗(yàn),以某市中院關(guān)于律師參與化解和代理涉法涉訴信訪案件制度試點(diǎn)情況為例,筆者試圖從堅(jiān)持涉法涉訴信訪案件參與原則、搭建律師參與涉法涉訴信訪援助平臺(tái)、完善律師參與涉法涉訴信訪案件程序、加強(qiáng)參與涉法涉訴信訪案件律師管理這四個(gè)方面探討確立我省律師參與涉法涉訴信訪案件制度體系,以期有效發(fā)揮該制度的功能作用,緩解我省涉法涉訴信訪難題。
[Abstract]:At present, every system of our country deepens the reform, the social economic construction develops at a high speed, but the construction of the social rule of law is slow, the citizen's legal literacy needs to be improved. How to deal with the various pressures and challenges brought by the transformation to the social stability. How to control the complicated and pluralistic conflict of litigation, petition and petition, consolidate the social harmony and stability, the traditional method of petition work is facing the bottleneck, and face a large number of new and old overlapping social contradictions and social problems. The pressure of a large number of contradictions and disputes handled by the political and legal organs is also growing day by day. The legal litigation and petition fall into the situation of ineffective control and control. The phenomenon of repeated visits, leapfrogging petitions and visits is prominent, and it is difficult to end the backlog of cases involving litigation, petition and visit. The judicial authority and impartiality of our country are strongly questioned, and the social governance system continues to deepen the reform. Under the policy guidance of the "opinions on further strengthening the work of Letters and visits in the New period" and the "opinions on innovating the methods of Mass work to solve the prominent problems of Letters and visits". In 2015, the department actively explored the innovative methods of petition work, tried to introduce social third party forces to resolve the conflicts and disputes, and ease the plight of letters and visits. In 2015, it was professional and friendly with the help of lawyers. The neutral practice advantage reshapes and strengthens the lawyer's social responsibility which accords with the idea of governing the country by law. Opinions on the Establishment of the system of lawyers' participation in resolving and acting in cases involving lawsuits and petitions formally proposed that lawyers should be introduced into the work of resolving contradictions between litigation and petition involving in law, and that the system should give full play to the superior role of lawyers. We should urge lawyers to participate in and assist the political and legal organs to ease the conflicts between petition and petition, strengthen the effective communication between the public power organ and the people, and disintegrate the malignant root of the "letter and visit law". Legal issues related to litigation petitions and visits led to the rule of law relief, the end of the track, deepening the multiple reform of the law involving litigation letters and visits. To sum up. It is particularly urgent to study and discuss the theory and practice of lawyers' participation in resolving and acting in litigation cases. In this paper, the author will discuss the policy and legal basis of legal issues. Practical investigation and exploration, system problems and reasons analysis, the establishment and improvement of the system of lawyers involved in litigation, petition cases and other four aspects of the discussion, based on local practice experience. Taking the trial case system of lawyers' participation in resolving and acting for legal issues in a city as an example, the author tries to establish a platform for lawyers' participation in litigation, petition and petition by insisting on the principle of participating in litigation and petition cases. To perfect the procedure of lawyers' participation in litigation and petition cases and to strengthen the management of lawyers' participation in litigation, petition and visit cases, and to explore the establishment of the system of lawyers' participation in legal complaints, petitions and visits in our province. In order to give full play to the function of the system and alleviate the problem of litigation and petition in our province.
