【摘要】：拆遷是伴隨著城市化的推進而產(chǎn)生的,拆遷工作的成敗直接關系到地方經(jīng)濟的發(fā)展,關系到地方社會秩序,關乎公眾的切身利益,也影響著地方的形象,但是近年來各地拆遷工作中爆發(fā)出來的矛盾和沖突卻越來越嚴重,已經(jīng)嚴重影響到地方的安定和諧。通過對一系列暴力拆遷案件的分析,不難發(fā)現(xiàn)地方拆遷工作的成敗與地方政府信用缺失是密不可分的,如拆遷工作比較隨意,有的地方政府想拆就拆,不顧當?shù)貙嶋H情況;拆遷工作不透明,從拆遷政策到補償?shù)綀?zhí)行等各階段都存在暗箱操作;拆遷工作不公平,拆遷補償標準不一,關系戶、釘子戶等問題難以得到妥善的處理。本文通過研究政府信用與拆遷工作之間存在的關系,提出政府信用越高則拆遷工作做得越好的假設。本文遵循實證與理論相結合的研究方式和原則,進行了大量的文獻研究,通過問卷調(diào)查、電話訪談、現(xiàn)場訪談、案例分析、參與觀察、比較分析等多種研究方法對拆遷工作現(xiàn)狀、地方政府信用的影響因素、地方政府信用高低對拆遷工作的影響及如何通過地方政府的信用建設推進拆遷工作等問題進行了分析研究。此次研究中,筆者利用自身曾經(jīng)在拆遷辦工作3年的優(yōu)勢,搜集到更加精確的資料、數(shù)據(jù),對惠山區(qū)三個街道的拆遷工作進行調(diào)查統(tǒng)計和比對分析,證實了政府信用越高則拆遷工作做得越好的假設。在假設被證實的基礎上,本文進一步提出了推進合理合法拆遷的具體做法,即拆遷要有前提,不能想拆就拆;拆遷要透明,不能偷偷摸摸;拆遷要做到公平,不能欺軟怕硬;拆遷要選賢任能,德才兼?zhèn)湔呱稀?br/>[Abstract]:Demolition is accompanied by the development of urbanization. The success or failure of demolition directly relates to the development of local economy, local social order, the vital interests of the public, but also affects the image of the local. But in recent years, the conflicts and contradictions that broke out in the demolition work have become more and more serious, which has seriously affected the stability and harmony of the local areas. Through the analysis of a series of violent demolition cases. It is not difficult to find that the success or failure of the local demolition work and the lack of local government credit is inseparable, such as demolition work is more casual, some local governments want to dismantle, regardless of the local actual situation; Demolition work is not transparent, from demolition policy to compensation to the implementation of the various stages of the existence of dark box operation; The work of demolition is unfair, the standard of compensation for demolition is different, and the problems such as related households and nail households are difficult to be properly dealt with. This paper studies the relationship between government credit and demolition work. Put forward the assumption that the higher the government credit, the better the demolition work. This paper follows the combination of empirical and theoretical research methods and principles, carried out a large number of literature research, through questionnaires, telephone interviews, on-site interviews. Case study, participation in observation, comparative analysis and other research methods on the demolition of the status quo, local government credit factors. The impact of local government credit on demolition work and how to promote demolition work through the credit construction of local governments were analyzed and studied. The author makes use of his own advantage in the demolition office for 3 years, collects more accurate information and data, carries on the investigation statistics and the comparative analysis to the demolition work of the three streets in Huishan area. On the basis of the hypothesis that the higher the government credit, the better the demolition work is done. On the basis of the hypothesis being confirmed, this paper further puts forward the concrete method of promoting reasonable and legal demolition, that is, the demolition must have a premise, but it cannot be dismantled on the basis of the assumption. Demolition should be transparent, not sneaky; Demolition should be fair, can not be bullied and afraid of hard; Demolition to select talent, talent and talent on the top.
