【摘要】：行政審批,顧名思義是指具有行政管制權(quán)限的機(jī)關(guān)、事業(yè)單位及其他組織,對(duì)公民、法人和其他社會(huì)組織提出的從事某項(xiàng)特定活動(dòng)的申請(qǐng),作出準(zhǔn)予或不準(zhǔn)予決定的行為。行政審批具有多種表現(xiàn)形式,名稱也各不相同,比較常見的有審批、許可、核準(zhǔn)、認(rèn)定、批準(zhǔn)、審核、注冊(cè)、登記、備案等等,它們的實(shí)施主體、審批程序和要素條件等雖有所不同,但究其核心,都具有三個(gè)特點(diǎn),一是面向公眾(特定或非特定群體),二是作為某項(xiàng)行為或活動(dòng)的限制門檻,三是依申請(qǐng)而非主動(dòng)實(shí)施的行政行為。作為政府對(duì)經(jīng)濟(jì)社會(huì)進(jìn)行管理的一種重要手段,行政審批制度改革一直受到社會(huì)各界的高度關(guān)注,特別是隨著政府職能轉(zhuǎn)變,政府與市場、政府與社會(huì)的邊界逐漸清晰,精簡審批事項(xiàng)、提高審批效率、減少政府干預(yù)已成為越來越多的公民和市場主體的共同呼聲。在此背景下,黨中央國務(wù)院以推動(dòng)政府職能轉(zhuǎn)變,建設(shè)服務(wù)型政府為目標(biāo),啟動(dòng)了新一輪行政審批制度改革,改革的廣度和深度前所未有,極大釋放了經(jīng)濟(jì)社會(huì)的發(fā)展活力。在查閱大量國內(nèi)外文獻(xiàn)研究的基礎(chǔ)上,本文綜合運(yùn)用理論研究法、比較分析法和文獻(xiàn)研究法等方法,首先從國外、國內(nèi)兩個(gè)方面對(duì)行政審批制度改革的成果進(jìn)行總結(jié)分析,認(rèn)為確保行政審批的設(shè)立、嚴(yán)格按照法律法規(guī)執(zhí)行、取消和下放行政審批事項(xiàng)、精簡審批環(huán)節(jié)以及提高行政審批效率,推動(dòng)實(shí)行服務(wù)外包模式等方面都是下一步推進(jìn)改革可以充分借鑒的地方。然后,重點(diǎn)對(duì)重慶兩江新區(qū)行政審批制度存在的問題進(jìn)行了分析,發(fā)現(xiàn)目前依然存在行政審批權(quán)限與自身能力不夠匹配、行政審批效率還有待提高、社會(huì)組織培育尚待完善、重審批輕監(jiān)管等問題,并從五個(gè)方面分析了問題存在的原因。最后,針對(duì)存在的主要問題,提出大力提高行政審批效率、推動(dòng)行政審批標(biāo)準(zhǔn)化建設(shè)、推廣審批電子網(wǎng)絡(luò)一體化以及構(gòu)建審管分離的機(jī)制等方面的對(duì)策建議。
[Abstract]:As the name implies, refers to the administrative examination and approval, has administrative authority, institutions and other organizations, the citizens, legal persons and other social organizations put forward to engage in a particular activity application, make a decision to approve or disapprove of the behavior. The administrative examination and approval have a variety of forms and names are different, the more common are approval, license, approval, recognition, approval, review, registration, registration, filing and so on, the implementation of the main elements of them, approval procedures and conditions are different, but the core has three characteristics, one is for the public (specific or non specific groups), two as a behavior or activity the three is the limit threshold, according to the application and non administrative behavior of active implementation. As an important means for the government to manage the economy and society, the reform of the administrative examination and approval system has attracted attention from all sectors of society, especially with the The transformation of government functions, government and market, government and social boundaries gradually clear, streamline approval, improve processing efficiency, reduce government intervention has become the common voice of more and more citizens and market. Under this background, the Party Central Committee and the State Council to promote the transformation of government functions, building a service-oriented government as the goal, to start a new a round of administrative examination and approval system reform, the breadth and depth of reform great development of hitherto unknown, the vitality of economic and social. Based on a large number of domestic and foreign literature, this paper uses theoretical research method, comparative analysis and literature research methods, first of all from abroad, to analyze two aspects of domestic reform the results of the administrative examination and approval system, to ensure that the establishment of the administrative examination and approval, in strict accordance with the laws and regulations, cancellation and decentralization of administrative approval, streamline approval procedures and improve The efficiency of administrative examination and approval, to promote the implementation of the service outsourcing mode is local reform can fully learn next. Then, the focus is on the analysis of the existence of Chongqing Liangjiang New Area Administrative Examination and approval system, there still exists the administrative examination and approval authority and their ability is not enough, still need to improve the efficiency of administrative examination and approval, cultivating social organizations to be perfect, a light regulatory and other issues, and from five aspects analyzes the reasons of the problems. Finally, aiming at the main problems, put forward to improve the efficiency of administrative examination and approval, to promote the standardization of administrative examination and approval, the approval of electronic integration and the construction of network promotion countermeasures requlatory separation mechanism and so on.
