工商行政管理行政處罰工商行政管理機(jī)關(guān)依法對(duì)經(jīng)濟(jì)違法、違章行為實(shí)施行政處罰的一種權(quán)力手段。行政處罰的又寸象，既可以是法人，也可以是自然人。在中國，凡是從事經(jīng)濟(jì)違法、違章活動(dòng)的一切組織和個(gè)人，工商行政管理機(jī)關(guān)都有權(quán)在國家授予的職權(quán)范圍內(nèi)給予處罰。處罰的種類主要有:責(zé)令具結(jié)悔過，通報(bào)批評(píng)，限價(jià)出售商品，強(qiáng)制收購商品，沒收非法所得，沒收物資或物品，沒收銷貨款，責(zé)令停業(yè)整頓，吊銷營業(yè)執(zhí)照等。以上處罰，可以單處，也可以并處。對(duì)情節(jié)嚴(yán)重構(gòu)成犯罪的，工商行政管理機(jī)關(guān)在實(shí)施處罰后，，應(yīng)將案件移交司法機(jī)關(guān)追究行為人的刑事責(zé)任。工商行政管理機(jī)關(guān)的處罰一般經(jīng)過立案、檢查、審批、處罰等程序，但在特殊情況下，也可以即時(shí)處罰。這些特殊情況包括:①違法違章事實(shí)清楚，不需要繼續(xù)調(diào)查取證的。②違法、違章情節(jié)輕微，違法數(shù)額較小的。③行為人承認(rèn)違法違章事實(shí)，接受即時(shí)處罰的。④受執(zhí)法現(xiàn)場(chǎng)的條件、環(huán)境等限制，必須及時(shí)處理的。工商行政管理機(jī)關(guān)對(duì)違法、違章行為人實(shí)施處罰時(shí)，應(yīng)制作處罰決定書送達(dá)當(dāng)事人。被處罰人如對(duì)處罰不服，可在法定期限內(nèi)向上一級(jí)工商行政管理機(jī)關(guān)申請(qǐng)復(fù)議，匕一級(jí)工商行政管理機(jī)關(guān)依法作出復(fù)議決定。被處罰人對(duì)復(fù)議決定不服的，可以按照法定程序向法院起訴。
