【摘要】：工程監(jiān)理制度自1988年提出至今,對(duì)我國(guó)建筑市場(chǎng)的發(fā)展起到了非常積極的作用,但隨著國(guó)民經(jīng)濟(jì)發(fā)展和市場(chǎng)進(jìn)一步開(kāi)放,工程監(jiān)理制和工程監(jiān)理企業(yè)的弊端越來(lái)越明顯。2003年至今國(guó)務(wù)院建設(shè)主管部門(mén)出臺(tái)了一系列培育和發(fā)展工程項(xiàng)目管理企業(yè)的指導(dǎo)意見(jiàn)和辦法,2014年又發(fā)文指出要進(jìn)一步調(diào)整強(qiáng)制監(jiān)理的范圍。在強(qiáng)制監(jiān)理的范圍可能縮小、工程咨詢(xún)服務(wù)將進(jìn)一步市場(chǎng)化的情況下,工程監(jiān)理企業(yè)為了繼續(xù)生存就必須尋求轉(zhuǎn)型發(fā)展。本文首先采用搜集和查閱企業(yè)資料與統(tǒng)計(jì)數(shù)據(jù)等方法,分析國(guó)內(nèi)監(jiān)理行業(yè)總體情況、國(guó)內(nèi)監(jiān)理企業(yè)業(yè)務(wù)內(nèi)容和管理水平,了解國(guó)內(nèi)監(jiān)理行業(yè)和企業(yè)的發(fā)展現(xiàn)狀。其次論文從市場(chǎng)經(jīng)濟(jì)、企業(yè)發(fā)展、政策推動(dòng)三個(gè)方面分析了監(jiān)理企業(yè)發(fā)展項(xiàng)目管理服務(wù)的必要性,分析目前我國(guó)建設(shè)各方主體的主要工作內(nèi)容及建設(shè)單位的法律責(zé)任,明確項(xiàng)目管理服務(wù)的定位、概念及其與工程監(jiān)理的差異性,監(jiān)理企業(yè)提供項(xiàng)目管理服務(wù)應(yīng)具有的能力。通過(guò)分析國(guó)內(nèi)外優(yōu)秀項(xiàng)目管理企業(yè)的發(fā)展現(xiàn)狀歸納其典型特征,提出我國(guó)監(jiān)理企業(yè)發(fā)展項(xiàng)目管理服務(wù)的具體目標(biāo)。接著針對(duì)監(jiān)理企業(yè)可提供的多種項(xiàng)目管理服務(wù)模式提出構(gòu)想,并分析在不同模式下,監(jiān)理企業(yè)可能承擔(dān)的法律責(zé)任。最后本文針對(duì)監(jiān)理企業(yè)在發(fā)展項(xiàng)目管理服務(wù)的轉(zhuǎn)型過(guò)程中遇到的內(nèi)部障礙和條件、外部障礙和條件進(jìn)行分析。
[Abstract]:Engineering supervision system has played a very positive role in the development of construction market since 1988, but with the development of national economy and the further opening of the market, The disadvantages of engineering supervision system and engineering supervision enterprises are becoming more and more obvious. Since 2003, the construction department of the State Council has issued a series of guidance opinions and measures for the cultivation and development of engineering project management enterprises. In 2014, it was pointed out that we should make further progress. Adjust the scope of compulsory supervision step by step. Under the circumstances that the scope of compulsory supervision may be narrowed and the engineering consulting service will be further marketized, engineering supervision enterprises must seek transformation and development in order to survive. This paper firstly analyzes the general situation of domestic supervision industry, the business content and management level of domestic supervision enterprises by means of collecting and consulting enterprise information and statistical data, so as to understand the present situation of domestic supervision industry and enterprises. Secondly, the thesis analyzes the necessity of supervision enterprise development project management service from three aspects of market economy, enterprise development and policy promotion, and analyzes the main work content and legal responsibility of construction units. It is clear that the position of project management service, the concept and the difference between project management service and project supervision, and the ability that supervision enterprise should have to provide project management service. By analyzing the development situation of excellent project management enterprises at home and abroad, the typical characteristics of them are summarized, and the specific objectives of developing project management services for supervision enterprises in China are put forward. Then the author puts forward the conception of various project management service modes which can be provided by supervision enterprises, and analyzes the legal responsibilities that may be assumed by supervision enterprises under different modes. Finally, this paper analyzes the internal and external obstacles and conditions encountered in the process of developing project management services in supervision enterprises.
