【摘要】：當(dāng)前,隨著我國(guó)建筑市場(chǎng)的市場(chǎng)化和國(guó)際化不斷加深,索賠管理在工程項(xiàng)目管理中已經(jīng)變得越來越重要。同時(shí)隨著建筑企業(yè)越來越激烈的競(jìng)爭(zhēng),建筑企業(yè)紛紛開始探索得以順利生存的各種措施,索賠管理就是建筑企業(yè)的重要舉措之一。而相對(duì)索賠經(jīng)驗(yàn)豐富的承包商而言,我國(guó)業(yè)主方的索賠管理水平要落后很多。因此,對(duì)于業(yè)主來說,提高索賠管理水平具有十分重要的意義。本文從業(yè)主的角度出發(fā),討論了如何加強(qiáng)業(yè)主的索賠管理。提出了業(yè)主索賠管理的框架,包括：業(yè)主主動(dòng)索賠、業(yè)主索賠防范、業(yè)主反索賠、業(yè)主索賠爭(zhēng)端處理,并在此基礎(chǔ)上提出業(yè)主索賠管理的工作體系。業(yè)主主動(dòng)索賠和索賠防范這兩塊內(nèi)容是在實(shí)際調(diào)研的基礎(chǔ)上展開的。首先,作者在理論分析的基礎(chǔ)之上,通過調(diào)查問卷的形式直接證實(shí)了業(yè)主索賠管理水平嚴(yán)重落后于建筑企業(yè)的事實(shí)。在主動(dòng)索賠中,重點(diǎn)論述了索賠機(jī)會(huì)的識(shí)別以及工期延誤的相關(guān)問題；在索賠防范中,重點(diǎn)論述了項(xiàng)目不同階段索賠防范的措施。其次,提出了反索賠的原則、步驟、內(nèi)容,它是業(yè)主有效控制索賠事件給自身造成影響的重要手段。最后,論述了業(yè)主索賠管理工作體系的建立,包括組織機(jī)構(gòu)建立和工作制度的建立。
[Abstract]:At present, with the deepening of marketization and internationalization of construction market in China, claim management has become more and more important in engineering project management. At the same time, with the increasingly fierce competition of construction enterprises, construction enterprises have begun to explore various measures to survive smoothly. Claim management is one of the important measures of construction enterprises. Compared with the contractors with rich claim experience, the claim management level of the owners in our country is far behind. Therefore, for the owners, improving the level of claim management has a very important significance. This paper discusses how to strengthen the owner's claim management from the owner's point of view. This paper puts forward the framework of owner's claim management, including: the owner's active claim, the owner's claim prevention, the owner's counter-claim, the owner's claim dispute processing, and on this basis, the working system of the owner's claim management is put forward. The owner's active claim and claim prevention are carried out on the basis of actual investigation. Firstly, on the basis of theoretical analysis, the author directly confirms the fact that the management level of owners' claims lags behind that of construction enterprises. In the active claim, the paper focuses on the identification of the claim opportunity and the problems related to the delay in the construction period, and on the measures of the claim prevention in different stages of the project. Secondly, it puts forward the principle, steps and contents of counterclaim, which is an important means for the owner to control the claim event effectively. Finally, it discusses the establishment of owner claim management system, including the establishment of organization and work system.
