【摘要】：索賠管理是工程項(xiàng)目合同管理的重要內(nèi)容,也是工程項(xiàng)目管理人員日常管理活動中比較關(guān)心的問題。雖然絕大部分的施工企業(yè)均能意識到索賠管理的重要性,但在工程實(shí)踐中,對于索賠問題卻又常常覺得無從下手,索賠的效率也很難得到保障。正是在這樣的背景下,本文對承包商全面索賠管理展開研究,以期提出比較具體的索賠管理策略,提高索賠管理的效率和企業(yè)索賠的效果�；贔IDIC施工合同條件,本文綜合運(yùn)用文獻(xiàn)研究法和實(shí)證分析的方法,對承包商全面索賠管理展開研究。首先,本文提出了全面索賠管理的概念,其包含全過程、全方位及全員三個方面的索賠管理,并從PDCA循環(huán)及博弈論的角度分別闡述了全面索賠管理所包含的基本思想,嘗試性地構(gòu)建了全面索賠管理的基本框架。其次,對FIDIC施工合同條件進(jìn)行分析,分別從承包商和業(yè)主的角度對合同條件中的索賠條款進(jìn)行歸納,并對每一條索賠條款均進(jìn)行了深入分析。然后,以全面索賠管理概念為核心,展開對承包商索賠管理策略的探討,包括宏觀層面的承包商索賠管理總方針,以及微觀層面上結(jié)合具體索賠條款的索賠管理策略。采用全面索賠管理基本框架與具體索賠條款相結(jié)合的方法,重點(diǎn)結(jié)合具體索賠條款研究探討承包商索賠與反索賠的策略。最后,結(jié)合南亞某國水電站工程項(xiàng)目對本文的索賠管理策略進(jìn)行了實(shí)踐應(yīng)用和分析。
[Abstract]:Claim management is not only an important part of project contract management, but also an issue of concern in the daily management activities of project managers. Although most construction enterprises can realize the importance of claim management, in engineering practice, they often feel that there is no way to deal with the problem of claims, and the efficiency of claims is difficult to be guaranteed. It is under this background that this paper studies the contractor's overall claim management in order to put forward more specific claim management strategies to improve the efficiency of claim management and the effect of enterprise claim management. Based on the conditions of FIDIC construction contract, this paper uses the method of literature research and empirical analysis to study the contractor's comprehensive claim management. First of all, this paper puts forward the concept of comprehensive claim management, which includes three aspects: the whole process, the omni-directional and the whole staff, and expounds the basic ideas of the comprehensive claim management from the angle of PDCA cycle and game theory respectively. This paper tries to construct the basic framework of comprehensive claim management. Secondly, the conditions of FIDIC construction contract are analyzed, the claim clauses in the contract conditions are summarized from the point of view of the contractor and the owner respectively, and each claim clause is analyzed in depth. Then, taking the concept of comprehensive claim management as the core, this paper discusses the contractor's claim management strategy, including the general policy of contractor's claim management at the macro level and the claim management strategy based on the specific claim clause at the micro level. This paper adopts the method of combining the basic framework of comprehensive claim management with the specific claim clause, and studies the strategy of contractor's claim and counterclaim by combining the specific claim terms. Finally, the paper applied and analyzed the claim management strategy of a hydropower station project in South Asia.
