【摘要】：目前我國(guó)物流保險(xiǎn)制度正處于飛速發(fā)展和新舊交織過渡階段,其中航空物流保險(xiǎn)面臨新的挑戰(zhàn)。本文從法律層面、保險(xiǎn)制度兩個(gè)層面對(duì)我國(guó)航空物流保險(xiǎn)制度的執(zhí)行現(xiàn)狀及其問題、成因進(jìn)行了深入探討,并分析了導(dǎo)致我國(guó)航空物流保險(xiǎn)市場(chǎng)中投保與保險(xiǎn)之間矛盾的兩個(gè)原因。提出了借鑒海運(yùn)保賠保險(xiǎn)機(jī)制,完善航空物流責(zé)任保險(xiǎn)以及多方主體共同參與航空物流保險(xiǎn)等具體措施,旨在解決航空物流責(zé)任保險(xiǎn)存在的難題。
[Abstract]:At present, the logistics insurance system of our country is in the stage of rapid development and the intertwined transition between the old and the new, among which the aviation logistics insurance is facing new challenges. This paper probes into the present situation and problems of the implementation of the air logistics insurance system in China from the legal level and the insurance system, and probes into the causes of the implementation of the air logistics insurance system in China. It also analyzes the two reasons that lead to the contradiction between insurance and insurance in China's air logistics insurance market. This paper puts forward some concrete measures, such as drawing lessons from the mechanism of marine insurance and indemnity insurance, perfecting the air logistics liability insurance and participating in the air logistics insurance jointly by many subjects, in order to solve the problems existing in the air logistics liability insurance.
