【摘要】：隨著信息網絡技術的創(chuàng)新發(fā)展,互聯(lián)網滲透進人們生活的方方面面。伴隨著生活方式的便捷高效,發(fā)生了一系列公民個人信息被泄露、非法獲取、非法利用、非法出售等事件,從而衍生出垃圾短信、騷擾電話、恐嚇詐騙等諸多社會問題,這些問題嚴重干擾了我們的生活安寧,給我們的人身財產安全帶來威脅。2016年,山東、廣東等地連續(xù)發(fā)生徐玉玉案等三起大學生遭電信網絡詐騙案件,導致受害人猝死或自殺,再次引起社會對個人信息保護問題的廣泛關注。我國刑法在保護公民個人信息方面起步較晚,2009年《刑法修正案(七)》首次規(guī)定了針對公民個人信息的犯罪,2015年《刑法修正案(九)》在一定程度上進行了完善,2017年5月8日最高人民法院、最高人民檢察院發(fā)布的《關于辦理侵犯公民個人信息刑事案件適用法律若干問題的解釋》在多個方面細化了《刑法修正案(九)》關于侵犯公民個人信息罪的規(guī)定,是我國公民個人信息刑法保護的一大長足進步,但仍然存在一定的完善空間。本文運用文獻研究和比較研究的方法,深入論證個人信息的概念、刑法含義、法律特征以及網絡環(huán)境下個人信息的特點,將《刑法修正案(九)》和《解釋》的立法進步和立法局限進行對應分析,結合域外個人信息刑法保護的立法經驗,在此基礎上針對我國網絡環(huán)境下個人信息刑法保護仍有進步空間的地方提出了四點具有可行性的完善思路。本文的主要研究結論是,我國現(xiàn)行刑事法律體系可從以下四個方面加強對網絡環(huán)境下的個人信息保護:(1)將網絡環(huán)境下衍生的新型公民個人信息納入保護范圍,例如個人生物識別信息、快遞物流信息等。(2)增設非法利用、非法破壞公民個人信息的入罪行為方式,打擊冒用、盜用他人身份,刪除、篡改、破壞他人信息的行為。(3)制定“不可逆的匿名化處理”技術標準,防止不法分子鉆法律空子將合法收集的公民個人信息經過不合格的匿名化處理后提供給他人,規(guī)范信息控制者的處理行為。(4)健全配套立法,建立完備的前置法律保護體系與刑法相銜接,協(xié)調統(tǒng)一,發(fā)揮全面有效的保護作用。
[Abstract]:With the innovation and development of information network technology, the Internet permeates every aspect of people's life.With the convenience and efficiency of the way of life, a series of personal information of citizens has been leaked, illegally obtained, illegally exploited, illegally sold, and so on. As a result, many social problems have arisen, such as spam messages, harassment of phone calls, intimidation and fraud, and so on.These problems seriously disturb our peace of life and threaten our personal and property safety. In 2016, three consecutive cases of college students being defrauded by telecommunications networks in Shandong and Guangdong provinces led to sudden death or suicide of the victims.Once again, it has aroused widespread concern about the protection of personal information.China's criminal law started relatively late in protecting citizens' personal information. In 2009, the Criminal Law Amendment (7) first stipulated the crime against citizens' personal information. In 2015, the Criminal Law Amendment (9) improved to a certain extent, 2017.On May 8, the Supreme people's Court,The Supreme people's Procuratorate issued the interpretation of some issues concerning the applicable Law in handling Criminal cases against Citizens' personal Information. In many respects, the Supreme people's Procuratorate refined the provisions of the Criminal Law Amendment (9) on the crime of infringing on citizens' personal information.It is a great progress in the criminal law protection of citizen's personal information, but there is still some room for perfection.This paper uses the methods of literature research and comparative study to demonstrate the concept of personal information, the meaning of criminal law, the legal characteristics and the characteristics of personal information under the network environment.Through the corresponding analysis of the legislative progress and limitation of the amendments to the Criminal Law (9) and the interpretation of the Criminal Law, and combined with the legislative experience of the criminal law protection of personal information abroad,On this basis, four feasible ideas are put forward to improve the protection of personal information criminal law under the network environment of our country.The main conclusion of this paper is that the current criminal law system of our country can strengthen the protection of personal information under the network environment from the following four aspects: (1) bring the new personal information derived from the network environment into the scope of protection.For example, personal biometric information, express logistics information, etc.) to add illegal use, illegally destroy citizens' personal information of the criminal behavior, crack down on false use, embezzlement of other people's identity, delete, tamper,(3) to establish "irreversible anonymous processing" technical standards to prevent lawbreakers from exploiting legal gaps in order to provide citizens' personal information legally collected through substandard anonymous processing to others.Standardizing the handling behavior of the information controller. (4) perfecting the supporting legislation, establishing a complete pre-legal protection system to link up with the criminal law, coordinating and unifying, and playing a comprehensive and effective protective role.
