【摘要】：中國(guó)政府采購(gòu)制度建立了有關(guān)《中華人民共和國(guó)政府采購(gòu)法》,明確了相應(yīng)的采購(gòu)制度,在實(shí)施的這十多年里,對(duì)于規(guī)范政府采購(gòu)行為發(fā)揮了極重要的作用。政府采購(gòu)制度功能不單是提升政府采購(gòu)效率、效益,同時(shí)也承擔(dān)系列政策性的作用,可促進(jìn)中小企業(yè)發(fā)展是基本一個(gè)政策功能。并且,其功能在《中華人民共和國(guó)中小企業(yè)促進(jìn)法》中得到加大,也被一些地方所落實(shí)。但是,總得來(lái)說(shuō)仍未形成法律制度的體系。雖政府在采購(gòu)促進(jìn)中小企業(yè)發(fā)展法律制度構(gòu)建未有全方位推進(jìn),但這也不能說(shuō)明政府采購(gòu)這一政策性功能在實(shí)際中沒(méi)有意義。從其他國(guó)外政府采購(gòu)制度分析,對(duì)于中小企業(yè)的扶持是一種常態(tài),且此制度實(shí)際效果也比較明顯。本文基于對(duì)政府、中小企業(yè)有關(guān)概念研究、分析入手,由我們國(guó)家政府采購(gòu)所面臨的實(shí)際問(wèn)題出發(fā),以江蘇省作為研究對(duì)象,對(duì)中國(guó)政府采購(gòu)所遇問(wèn)題提出有關(guān)優(yōu)化建議,旨在可為政府采購(gòu)問(wèn)題提供更好的意見(jiàn)。全文共七大章:第一章主要研究全文的研究背景、意義,包括國(guó)內(nèi)、國(guó)外有關(guān)研究的動(dòng)態(tài),全文的研究方法、思路、論文寫(xiě)作過(guò)程的難點(diǎn)、創(chuàng)新點(diǎn)。第二章理論綜述。主要對(duì)政府采購(gòu)的概念進(jìn)行分析,明確其特點(diǎn)、原則、目標(biāo)、功能。之后對(duì)中小企業(yè)的界定進(jìn)行細(xì)致的分析,同時(shí)指出中小企業(yè)界定標(biāo)準(zhǔn)在政府采購(gòu)扶持中小企業(yè)發(fā)展的理論根據(jù),之后為論述打下基礎(chǔ)。第三章主要分析了中國(guó)企業(yè)參與到政府采購(gòu)的現(xiàn)狀,包括三部分內(nèi)容:第一部分:中小企業(yè)參加到政府采購(gòu)所遇到的問(wèn)題;第二部分,對(duì)政府采購(gòu)促進(jìn)中小企業(yè)發(fā)展暫行辦法出臺(tái)意義、不足進(jìn)行分析;第三,部分省市政府的政策意義。第四章以美國(guó)為例,分析那些發(fā)達(dá)國(guó)家政府采購(gòu)促進(jìn)中小企業(yè)發(fā)展的經(jīng)驗(yàn)。第五章在之前所有討論的基礎(chǔ)上借用國(guó)際先進(jìn)經(jīng)驗(yàn),提出完善政府采購(gòu)政策支持中小企業(yè)發(fā)展的對(duì)策。第六章案例分析,以中國(guó)江蘇為例,分析政府采購(gòu)扶持中小企業(yè)發(fā)展所面臨的現(xiàn)狀、困難、解決對(duì)策,最后第七章對(duì)全文進(jìn)行總結(jié)。
[Abstract]:The Chinese government procurement system has established the "Law of the people's Republic of China on Government Procurement" and clarified the corresponding procurement system, which has played a very important role in standardizing government procurement in the past ten years or so. The function of government procurement system is not only to improve the efficiency and benefit of government procurement, but also to assume the role of a series of policies, which can promote the development of small and medium-sized enterprises is a basic policy function. Moreover, its function is enhanced in the Law of the people's Republic of China on the Promotion of small and Medium-sized Enterprises, and has also been implemented in some places. But, in general, there is still no legal system. Although the government has not promoted the construction of the legal system of procurement to promote the development of small and medium-sized enterprises, it does not mean that the policy function of government procurement is meaningless in practice. From the analysis of other foreign government procurement systems, it is normal to support small and medium-sized enterprises, and the actual effect of this system is obvious. Based on the research and analysis of the concepts of government and small and medium-sized enterprises, this paper takes Jiangsu Province as the object of study, and puts forward some suggestions on how to optimize the problems encountered by Chinese government procurement. The aim is to provide better advice on government procurement issues. There are seven chapters: the first chapter mainly studies the research background and significance of the full text, including domestic and foreign research trends, research methods, ideas, difficulties in the process of writing papers, innovative points. The second chapter summarizes the theory. This paper mainly analyzes the concept of government procurement and clarifies its characteristics, principles, objectives and functions. Then the definition of small and medium-sized enterprises is analyzed carefully, and the theoretical basis of government procurement to support the development of small and medium-sized enterprises is pointed out at the same time, and then lay a foundation for the discussion. The third chapter mainly analyzes the current situation of Chinese enterprises participating in government procurement, including three parts: the first part: small and medium-sized enterprises to participate in government procurement encountered problems; The second part analyzes the significance of the interim measures of government procurement to promote the development of small and medium-sized enterprises; third, the policy significance of some provincial and municipal governments. The fourth chapter takes the United States as an example to analyze the experience of government procurement to promote the development of small and medium-sized enterprises in developed countries. On the basis of all the previous discussions, the fifth chapter draws on the international advanced experience and puts forward the countermeasures to improve the government procurement policy to support the development of small and medium-sized enterprises. The sixth chapter is a case study, taking Jiangsu Province of China as an example, to analyze the current situation, difficulties and countermeasures faced by government procurement to support the development of small and medium-sized enterprises. Finally, the seventh chapter summarizes the full text.
