【摘要】：針對目前建筑市場中普遍存在的業(yè)主行為不規(guī)范問題,提出利用業(yè)主責任保函來規(guī)范業(yè)主行為。借鑒美國的"付款擔保",提出業(yè)主責任保函針對解決工程款及農(nóng)民工工資拖欠問題的設(shè)計特征;然后基于政府對業(yè)主公共責任的監(jiān)管需求,并借鑒國外行政擔保的經(jīng)驗,提出業(yè)主責任保函針對落實業(yè)主公共責任的設(shè)計特征;最后,對保函的具體內(nèi)容進行設(shè)計,為今后保函的實施提供借鑒。
[Abstract]:Aiming at the nonstandard behavior of owners in the construction market at present, this paper puts forward that the owner's behavior should be regulated by the owner's letter of guarantee. Referring to the "payment guarantee" of the United States, this paper puts forward the design features of the owner's letter of guarantee aimed at solving the problem of the payment of the project and the arrears of the migrant workers' wages. Then, based on the government's demand for the supervision of owner's public responsibility, and drawing on the experience of foreign countries' administrative guarantee, the author puts forward the design characteristics of the owner's responsibility guarantee for the implementation of the owner's public responsibility. Finally, the concrete content of the guarantee is designed to provide reference for the implementation of the guarantee in the future.
