【摘要】：近幾年，食品安全事件頻繁發(fā)生，各地食品安全形勢令人堪憂，對政府食品安全監(jiān)管責任部門提出巨大挑戰(zhàn)，因此，建立和健全食品安全監(jiān)管機制和行政問責機制就成為首要問題。食品安全監(jiān)管的行政問責制首先具有“行政針對性”，即針對的客體對象是相關(guān)行政單位及工作人員，主要是政府和其工作人員。問責的內(nèi)容與目的是要求客體承擔由于其不履行或不正確履行食品安全監(jiān)督與管理的責任而造成傷害或損失事實的發(fā)生這一結(jié)果。 目前，我國已有多部食品安全監(jiān)管領(lǐng)域的法律制度，在食品安全監(jiān)管的主旨思想、監(jiān)管內(nèi)容與體制、監(jiān)管責任分配與認定、責任追究方式與方法等方面均作出明確規(guī)定，但是在食品安全監(jiān)管的問責制度層面缺陷較多。本文具體以目前最為焦點的肉業(yè)問題為例，對目前的食品安全監(jiān)管問責機制進行了分析。鑒于調(diào)查研究的結(jié)果與目前的行業(yè)現(xiàn)狀，本文通過深入研究以期進一步完善問責制度。本文在結(jié)構(gòu)上分為四個研究部分：第一章為導論部分，主要介紹本文的選題背景、研究意義、國內(nèi)外相關(guān)理論研究現(xiàn)狀、研究技術(shù)路線與方法；第二章為食品安全監(jiān)管由于食品安全監(jiān)管行政問責的理論基礎(chǔ)；第三章對食品安全監(jiān)管行政問責制度進行了相關(guān)法規(guī)分析，并列入實證來分析現(xiàn)存問題；第四章提出對策與建議。 通過本文的分析研究，，筆者認為只有明確政府對食品安全監(jiān)管的主體地位、制定科學的食品安全監(jiān)管行政問責法律機制、建立有利于高效問責的保障機制才能完善食品安全監(jiān)管行政問責制度。
[Abstract]:In recent years, food safety incidents have occurred frequently, and the food safety situation in various places is worrisome, which poses a great challenge to the responsible departments of the government's food safety supervision, so, Establishing and perfecting food safety supervision mechanism and administrative accountability mechanism has become the most important issue. The administrative accountability system of food safety supervision first has "administrative pertinence", that is, the object is the relevant administrative units and staff, mainly the government and its staff. The content and purpose of accountability is to require the object to bear the result that the fact of injury or loss is caused by the failure or incorrect performance of the responsibility of food safety supervision and management. At present, there are many legal systems in the field of food safety supervision in China, which are clearly stipulated in the main idea of food safety supervision, the content and system of supervision, the distribution and determination of supervision responsibility, the way and method of responsibility investigation, and so on. But there are many defects in the accountability system of food safety supervision. Taking the meat industry as an example, this paper analyzes the accountability mechanism of food safety supervision. In view of the results of the investigation and the current situation of the industry, this paper aims to further improve the accountability system through in-depth research. The structure of this paper is divided into four parts: the first chapter is the introduction, mainly introduces the background of the topic, the significance of the research, domestic and foreign related theoretical research status, research technical routes and methods; The second chapter is the theoretical basis of administrative accountability for food safety supervision, the third chapter analyzes the relevant laws and regulations of food safety supervision administrative accountability system, and includes empirical analysis to analyze the existing problems. The fourth chapter puts forward countermeasures and suggestions. Through the analysis and research of this paper, the author thinks that only the main position of the government to the food safety supervision should be clarified, and the scientific legal mechanism of the administrative accountability for the food safety supervision should be established. Only by establishing a guarantee mechanism conducive to high-efficiency accountability can we improve the administrative accountability system of food safety supervision.
