【摘要】：礦業(yè)用地制度是礦產(chǎn)資源所有權(quán)、礦業(yè)權(quán)和政府管理權(quán)之間規(guī)范的制度安排�，F(xiàn)實(shí)中我國(guó)礦業(yè)用地使用權(quán)與礦業(yè)權(quán)矛盾較為明顯,礦產(chǎn)與土地資源難以得到充分有效利用,也導(dǎo)致了環(huán)境破壞難以及時(shí)恢復(fù)的問(wèn)題,原因主要在于我國(guó)礦業(yè)用地的取得及使用管理制度規(guī)定存在不足,推動(dòng)礦業(yè)用地管理制度改革已迫在眉睫。本文通過(guò)對(duì)國(guó)外礦業(yè)用地的取得及使用管理制度分析,比較國(guó)內(nèi)礦業(yè)用管理地制度情況,并總結(jié)經(jīng)驗(yàn)啟示,以期為我國(guó)及地方礦業(yè)用地管理改革決策提供參考。
[Abstract]:Mining land system is a standard system arrangement between mineral resource ownership, mining right and government management right.In reality, the contradiction between mining land use right and mining right is obvious in our country, and it is difficult to make full and effective use of mineral and land resources, which also leads to the problem that environmental damage is difficult to recover in time.The main reason is that there are some deficiencies in the management system of mining land acquisition and use in China, and it is urgent to promote the reform of mining land management system.Based on the analysis of foreign mining land acquisition and management system, this paper compares the situation of domestic mining land management system, and summarizes the experience and enlightenment, in order to provide a reference for our country and local mining land management reform decision-making.
