【摘要】：自然資源是社會(huì)經(jīng)濟(jì)發(fā)展的基礎(chǔ)，其科學(xué)合理的利用對于經(jīng)濟(jì)發(fā)展、社會(huì)進(jìn)步、構(gòu)建和諧社會(huì)有著密切的關(guān)系。礦產(chǎn)資源作為自然資源中一個(gè)重要的組成部分，隨著我國工業(yè)化水平的不斷提高，對其需求也顯得越來越緊迫，因此，我國適時(shí)的改變了計(jì)劃經(jīng)濟(jì)時(shí)代的礦業(yè)權(quán)無償劃撥形式，施行了礦業(yè)權(quán)有償出讓制度。 本文首先介紹了此項(xiàng)研究的背景、意義和目的，并總結(jié)了當(dāng)前主流的礦業(yè)權(quán)有償出讓理論研究成果，從市場機(jī)制與資源配置、保障國家權(quán)益、保障礦業(yè)權(quán)人的合法權(quán)益和礦產(chǎn)資源的利用水平這四個(gè)方面對當(dāng)前主流觀點(diǎn)進(jìn)行了梳理，借助管理學(xué)“零和游戲”理論對礦業(yè)權(quán)出讓進(jìn)行了理論分析，對礦業(yè)權(quán)與礦業(yè)權(quán)有償出讓的概念進(jìn)行了界定，其次介紹了新疆地區(qū)礦產(chǎn)資源勘查開發(fā)現(xiàn)狀、礦業(yè)權(quán)有償出讓制度的發(fā)展和現(xiàn)狀�？偨Y(jié)了新疆地區(qū)在實(shí)行礦業(yè)權(quán)有償出讓中存在的一些問題，包括行政力量干預(yù)礦業(yè)權(quán)有償出讓，礦業(yè)權(quán)投放不合理，礦業(yè)權(quán)出讓合同的缺陷，之后分析了上述問題產(chǎn)生的三個(gè)各方面原因，其中行政力量干預(yù)礦業(yè)權(quán)有償出讓的主要原因包括：西部經(jīng)濟(jì)欠發(fā)達(dá)地區(qū)在招商引資中遷就企業(yè)；地方領(lǐng)導(dǎo)的個(gè)人意愿強(qiáng)加于規(guī)則之上；部分領(lǐng)導(dǎo)干部存在廉潔問題。礦業(yè)權(quán)投放不合理的主要原因包括：以往的礦業(yè)權(quán)投放缺乏科學(xué)、長遠(yuǎn)規(guī)劃；法規(guī)政策的多次調(diào)整導(dǎo)致遺留問題較多；礦業(yè)權(quán)設(shè)方案編制倉促，對合理投放礦業(yè)權(quán)起到的作用有限。礦業(yè)權(quán)出讓合同存在缺陷的主要成因包括：條款的設(shè)計(jì)與新疆實(shí)際區(qū)情不符；對礦業(yè)權(quán)出讓合同的嚴(yán)肅性認(rèn)識不夠；礦業(yè)權(quán)出讓合同沒有做好適應(yīng)新形勢的準(zhǔn)備。 在此基礎(chǔ)上，通過對比、借鑒幾個(gè)礦業(yè)大國的礦業(yè)權(quán)出讓制度及其經(jīng)驗(yàn)，對新疆地區(qū)礦業(yè)權(quán)出讓的改進(jìn)措施進(jìn)行了探討，提出五點(diǎn)建議：堅(jiān)持市場化配置資源；預(yù)防腐敗，加強(qiáng)監(jiān)管；完善礦業(yè)權(quán)設(shè)置方案；完善出讓程序；督促并鼓勵(lì)企業(yè)提高礦產(chǎn)資源利用能力；，繼續(xù)推進(jìn)礦山整合，完善礦業(yè)權(quán)出讓合同的設(shè)計(jì)，并使其盡早適應(yīng)新形勢下的礦業(yè)權(quán)出讓市場。
[Abstract]:Natural resources are the basis of social and economic development, and their scientific and rational utilization is closely related to economic development, social progress and the construction of a harmonious society. Mineral resources are an important part of natural resources. With the development of industrialization in our country, the demand for mining rights is becoming more and more urgent. Therefore, China has changed the form of free transfer of mining rights in the planned economy era and implemented the system of paid transfer of mining rights. This paper first introduces the background, significance and purpose of this research, and summarizes the current mainstream mining rights paid transfer theory research results, from the market mechanism and resource allocation, to protect the rights and interests of the country. In this paper, four aspects of protecting the legal rights and interests of mining owners and the level of utilization of mineral resources are discussed, and the theory of "zero-sum game" of management is used to analyze the transfer of mining rights. This paper defines the concept of mining right and paid transfer of mining right, and then introduces the present situation of exploration and development of mineral resources in Xinjiang. This paper summarizes some problems existing in the implementation of the paid transfer of mining rights in Xinjiang, including the interference of administrative forces in the paid transfer of mining rights, the unreasonable investment of mining rights, the development and the present situation of the system of paid transfer of mining rights. The defects of the contract for transferring mining rights are analyzed, and three reasons for the above problems are analyzed. Among them, the main reasons for the interference of administrative power in the paid transfer of mining rights include: the western economically underdeveloped region accommodates enterprises in the process of attracting investment; The personal will of local leaders is imposed on the rules, and some leading cadres have the problem of honesty. The main reasons for unreasonable mining rights investment include: the lack of science and long-term planning in mining rights investment in the past; Many changes in regulations and policies have resulted in a large number of remaining problems; mining rights have been set up in a hasty manner. The main causes of defects in mining rights transfer contract include: the design of terms does not accord with the actual situation in Xinjiang, the serious understanding of mining rights transfer contract is not enough; Mining right transfer contract is not ready to adapt to the new situation. On this basis, through comparison, drawing lessons from the mining right transfer system and experience of several mining countries, this paper probes into the improvement measures of mining right transfer in Xinjiang, and puts forward five suggestions: insisting on market allocation of resources; preventing corruption. To strengthen supervision; to perfect the plan for the establishment of mining rights; to improve the procedures for transferring mineral resources; to urge and encourage enterprises to improve their ability to utilize mineral resources; to continue to promote the integration of mines; and to perfect the design of contracts for the transfer of mining rights, And make it adapt to the new situation as soon as possible under the mining rights transfer market.
