我國(guó)政府食品安全管理體系建設(shè)研究

【摘要】:食品是整個(gè)人類社會(huì)生存和發(fā)展的基礎(chǔ),沒(méi)有食品作為保證,人類的生命都不能夠得以延續(xù),人類的發(fā)展也就成為無(wú)稽之談。食品安全問(wèn)題對(duì)國(guó)家和社會(huì)的發(fā)展所產(chǎn)生的影響是顯而易見(jiàn)的,政府有責(zé)任和義務(wù)對(duì)食品安全進(jìn)行管理。政府管理是行政機(jī)關(guān)在法律政策限定的領(lǐng)域內(nèi),為了克服市場(chǎng)失靈,促進(jìn)市場(chǎng)經(jīng)濟(jì)的正常有序發(fā)展,通過(guò)經(jīng)濟(jì)手段、法律以及行政等手段,對(duì)經(jīng)濟(jì)社會(huì)生活進(jìn)行規(guī)范、約束和限制的行為,以達(dá)到社會(huì)福利的最大化的目的。 本文運(yùn)用相關(guān)理論,通過(guò)案例分析,全面剖析了目前我國(guó)政府食品安全管理體系存在的主要問(wèn)題,主要包括:食品安全管理主體的問(wèn)題、食品安全管理制度的問(wèn)題、食品安全管理技術(shù)的問(wèn)題、食品安全管理環(huán)境的問(wèn)題。分析了我國(guó)政府食品安全管理體系存在問(wèn)題的主要原因,主要包括:食品安全管理能力較為薄弱、各級(jí)政府之間權(quán)責(zé)利關(guān)系不明晰、地方保護(hù)主義嚴(yán)重、財(cái)政投入不足。本文在分析了我國(guó)政府食品安全管理體系建設(shè)的現(xiàn)狀、問(wèn)題及其原因的基礎(chǔ)上,借鑒了美國(guó)、加拿大、日本等發(fā)達(dá)國(guó)家在食品安全管理體制建設(shè)方面的經(jīng)驗(yàn),對(duì)我國(guó)的食品安全體系建設(shè)提出了政策的建議。本文認(rèn)為我國(guó)食品安全管理體系的建設(shè)應(yīng)當(dāng)從以下方面進(jìn)行:加快食品安全的法律法規(guī)的建設(shè)、加強(qiáng)食品安全標(biāo)準(zhǔn)體系建設(shè)、健全食品召回制度和追溯機(jī)制建設(shè)、建立和完善檢驗(yàn)檢測(cè)體系、建立并推廣HACCP制度、建立危險(xiǎn)性評(píng)估技術(shù)、建立和完善食品安全信用體系、加強(qiáng)行業(yè)協(xié)會(huì)的管理、充分發(fā)揮消費(fèi)者和新聞媒體的監(jiān)督作用。
[Abstract]:Food is the foundation for the survival and development of human society, there is no food as a guarantee, human life can not continue, human development has also become affected. Groundless statement of food safety issues of national and social development is obviously, the government has the responsibility and obligation to manage the food safety management is the government. The administrative organ in the legal policy of limited area, in order to overcome market failure, promoting the orderly development of market economy, through economic means, legal and administrative means of economic and social life in the norms, constraints and limitations of behavior, in order to achieve the maximization of social welfare purposes.
This paper uses the relevant theories, through case analysis, a comprehensive analysis of the main problems existing in our country, the government food safety management system mainly includes: the main problems of food safety management, food safety management system, food safety management technology, food safety management environment. Analyze the main reasons of the problems. The government of our country food safety management system mainly includes: the ability of food safety management is weak, the relationship between levels of government responsibilities are not clear, serious local protectionism, lack of financial investment. This paper analyzes the status quo of China's government food safety management system construction, basic problems and reasons, the United States, Canada experience, Japan and other developed countries in the construction of food safety management system, the policy suggestions on the construction of our country's food safety system is put forward in this. This paper believes that the construction of China's food safety management system should be carried out from the following aspects: speeding up the construction of food safety laws and regulations, strengthen the construction of food safety standard system, improve the food recall system and traceability system construction, establish and improve the inspection system, the establishment and promotion of HACCP system, the establishment of risk assessment technology, establish and improve the food safety credit system, strengthen the management of industry associations, give full play to the supervisory role of consumers and the media.
