【摘要】:為了規(guī)范建筑市場秩序,提高勞務(wù)隊伍職業(yè)素質(zhì)和建筑企業(yè)的整體素質(zhì),確保工程質(zhì)量和安全管理,建立預(yù)防建設(shè)領(lǐng)域拖欠農(nóng)民工工資的長效機制,住房與城鄉(xiāng)建設(shè)部于2005年8月5日頒布了《關(guān)于建立和完善勞務(wù)分包制度,發(fā)展建筑勞務(wù)企業(yè)的意見》,明確提出從2005年7月1日起,用三年的時間在全國建立基本規(guī)范的建筑勞務(wù)市場分包制度,,農(nóng)民工基本被勞務(wù)企業(yè)和其他用工企業(yè)直接吸納,“包工頭”承攬分包業(yè)務(wù)基本被禁止。通過近幾年國家建設(shè)相關(guān)主管部門積極推進勞務(wù)分包制度和勞務(wù)分包企業(yè)的建立和完善,目前我國建筑市場已基本形成勞務(wù)作業(yè)按要求分包給具有相應(yīng)資質(zhì)的勞務(wù)分包企業(yè)勞務(wù)分包制度,建筑市場成立一批具有規(guī)模化和正規(guī)化的勞務(wù)分包企業(yè)。然而我國建筑業(yè)勞務(wù)市場的無序化仍未得到根本轉(zhuǎn)變,我國建筑業(yè)勞務(wù)市場主體的勞務(wù)分包企業(yè)自有工人所占比例很少,勞務(wù)分包企業(yè)“空殼化”現(xiàn)象嚴重;我國建筑業(yè)勞務(wù)市場仍然存在“包工頭”形象,只不過有以前的顯性狀態(tài)轉(zhuǎn)變?yōu)殡[形狀態(tài);我國建筑勞務(wù)市場仍然存在通過“掛靠”等方式維持實質(zhì)上的“包工頭”交易模式的根源。 本文首先分析我國建筑勞務(wù)市場“包工頭”現(xiàn)象產(chǎn)生的歷史背景,主要是我國施工管理體制、用工制度的改革和農(nóng)民工成為施工生產(chǎn)的主體兩方面原因造成了“包工頭”現(xiàn)象的形成;分析了建筑勞務(wù)市場“包工頭”現(xiàn)象的現(xiàn)狀,并分析了“包工頭”在我國建筑勞務(wù)市場中的地位和作用;并通過實證研究分析了我國建筑勞務(wù)市場“包工頭”所帶來的問題。然后運用制度經(jīng)濟學對農(nóng)民工就業(yè)模式的決策選擇機制分析和勞務(wù)分包企業(yè)用工模式的決策選擇機制分析,得出我國建筑勞務(wù)市場就業(yè)模式的均衡分析,從而分析出農(nóng)民工和勞務(wù)分包企業(yè)均選擇“包工頭”的經(jīng)濟學原因。最后提出規(guī)范和發(fā)展建筑勞務(wù)市場同時需要從勞務(wù)分包企業(yè)和農(nóng)民工這兩個勞務(wù)市場主體角度來規(guī)范,分別是加強對勞務(wù)分包企業(yè)發(fā)展扶持和監(jiān)管、促進農(nóng)民工進行正規(guī)就業(yè)。
[Abstract]:In order to standardize the order of the construction market, improve the professional quality of the labor force and the overall quality of the construction enterprises, ensure the quality and safety management of the project, and establish a long-term mechanism to prevent migrant workers from defaulting on wages in the construction field. On August 5th 2005, the Ministry of Housing and Urban-Rural Construction promulgated the opinions on the Establishment and improvement of Labor subcontracting system and the Development of Construction Labor Enterprises, which was clearly put forward from July 1st 2005. It took three years to establish a basic standard subcontracting system in the construction labor market throughout the country, and migrant workers were basically absorbed directly by labor enterprises and other employment enterprises. "contractor" contracting subcontracting business is basically prohibited. In recent years, the relevant departments in charge of national construction actively promote the establishment and improvement of labor subcontracting system and labor subcontracting enterprises. At present, the construction market of our country has basically formed the labor service subcontracting system according to the requirement to the labor subcontracting enterprises with corresponding qualifications. A number of large-scale and formalized labor subcontracting enterprises have been established in the construction market. However, the disorder of the construction industry labor market in China has not been fundamentally changed. The proportion of self-owned workers in labor subcontracting enterprises of construction industry is very small, and the phenomenon of "empty shell" of labor subcontracting enterprises is serious. There is still a "contractor" image in the labor market of the construction industry in China, but the former dominant state is transformed into an invisible state. The construction labor market of our country still has the root of maintaining the real trade mode of "contractor" by means of "linking" and so on. This paper first analyzes the historical background of the "contractor" phenomenon in the construction labor market of our country, mainly the construction management system of our country. The reform of the employment system and the fact that the peasant workers become the main part of the construction production cause the "contractor" phenomenon. This paper analyzes the present situation of the "contractor" phenomenon in the construction labor market, and analyzes the position and function of the "contractor" in the construction labor market of our country. And through the empirical study, the author analyzes the "contractor" in the construction labor market in China. Then using institutional economics to analyze the decision-making and selection mechanism of migrant workers' employment model and labor subcontracting enterprise employment model decision-making selection mechanism analysis. The equilibrium analysis of employment mode of construction labor market in China is obtained. Therefore, it is analyzed that both migrant workers and labor subcontracting enterprises choose the "contractor". Finally, it is proposed to standardize and develop the construction labor market from the perspective of labor subcontracting enterprises and migrant workers. They are to strengthen the development of labor subcontracting enterprises support and supervision, to promote the formal employment of migrant workers.
