【摘要】：國務院于2008年6月發(fā)布的《國家知識產(chǎn)權戰(zhàn)略綱要》,截止2010年,7個部門先后成立了貫徹落實《國家知識產(chǎn)權戰(zhàn)略綱要》的領導機構,15個部門制定了落實《國家知識產(chǎn)權戰(zhàn)略綱要》的配套政策和實施方案,遼寧、上海、河南、江蘇、山東、湖南、廣東、貴州、陜西、四川等地出臺了地方知識產(chǎn)權戰(zhàn)略綱要。在地方知識產(chǎn)權戰(zhàn)略實施的同時,各地集中出臺并實施了相關專利資助政策,那么政策的調整對中藥專利的申請、授權和運用是個什么樣的影響,特別是在當前國家大力推進知識產(chǎn)權戰(zhàn)略,各地積極并大量投入財力、物力和人力的情況下,這些扶持政策和資助政策對中藥專利產(chǎn)生什么樣的影響,如果有影響,那些政策因素對中藥專利的影響因素更大,這一系列問題都顯得值得研究。 本文的目的在于根據(jù)不同特點的政策分析其政策實施下的中藥專利變化的影響,為其他支持和發(fā)展中藥產(chǎn)業(yè)的地方出臺類似法規(guī)提供借鑒和參考,進而為探求我國中藥領域運用專利制度能力和水平提供理論支持和實踐依據(jù)。 本文首先采用了文獻分析法對我國專利資助政策和中藥專利的相關文獻進行了回顧,在文獻分析方法部分,本文對現(xiàn)有關于專利資助政策和中藥專利的相關文獻進行了系統(tǒng)梳理和研究。其次,利用政策系統(tǒng)對比分析方法對我國各地方專利資助政策進行細化、總結和對比,并根據(jù)各地區(qū)的專利資助政策利用對比分類法進行異同分析。最后,以政策特點為研究出發(fā)點,整理和挖掘相關數(shù)據(jù)庫或者自建數(shù)據(jù)庫,利用專利檢索、專利信息分析對中藥專利數(shù)據(jù)進行提取和分類,運用統(tǒng)計學方法對各數(shù)據(jù)進行了深層數(shù)據(jù)篩選、清洗和加工,同時,針對政策影響下的數(shù)據(jù)進行分類分析,重點研究各政策對各可量化指標的影響。 在內(nèi)容方面,本文首先從四個方面對專利資助政策進行分解、對比和分析,分析各其相同點和區(qū)別點。隨后從中藥專利申請、授權、實施和質押等數(shù)據(jù)出發(fā),提取可以從資助政策中量化的數(shù)據(jù)指標,結合專利政策的分析部分,從定性和定量的角度有理有據(jù)的分析專利資助政策對中藥專利的影響變化情況。最后對本研究進行了總結和分析,并針對相關問題提出建議。 研究結果表明,各地方應當加強對專利申請資助政策對中藥領域專利資助效果的評估,修訂并完善專利申請資助政策；建立全國聯(lián)網(wǎng)的專利資助管理平臺和各級專利資助協(xié)作機制；細化和完善專利資助政策,重視中藥專利授權后的應用。
[Abstract]:The State Council issued the National intellectual property Strategic outline in June 2008. By 2010, seven departments had successively set up leading agencies to implement the National intellectual property Strategic outline. Fifteen departments have formulated supporting policies and implementation plans for implementing the National intellectual property Strategic outline, and Liaoning, Shanghai, Henan, Jiangsu, Shandong, Hunan, Guangdong, Guizhou, Shaanxi, Sichuan and other places have issued local IPR strategic outlines. While the local intellectual property strategy is being implemented, various localities have centrally promulgated and implemented relevant patent subsidy policies. What kind of impact does the adjustment of the policy have on the application, authorization and application of traditional Chinese medicine patents? Especially in the current situation where the state is vigorously promoting the intellectual property strategy and all localities are actively and heavily investing in financial, material and human resources, what kind of impact and if any of these supporting and subsidizing policies will have on the patent of traditional Chinese medicine? These policy factors to the patent of traditional Chinese medicine are more influential factors, this series of issues are worthy of study. The purpose of this paper is to analyze the influence of the change of Chinese medicine patent under the policy implementation according to the different characteristics of the policy, to provide reference and reference for other places that support and develop the traditional Chinese medicine industry to enact similar laws and regulations. Then it provides theoretical support and practical basis for exploring the ability and level of patent system in the field of traditional Chinese medicine. In this paper, firstly, the literature analysis method is used to review the relevant documents of Chinese patent aid policy and traditional Chinese medicine patent, and in the part of literature analysis method, In this paper, the existing patent subsidy policy and traditional Chinese medicine patent related literature has been systematically combed and studied. Secondly, the comparative analysis method of policy system is used to refine, summarize and contrast the local patent subsidy policies in China, and analyze the similarities and differences according to the comparative classification of patent aid policies in different regions. Finally, taking the characteristics of the policy as the starting point, sorting out and mining related databases or self-built databases, using patent retrieval and patent information analysis to extract and classify patent data of traditional Chinese medicine. The deep data were screened, cleaned and processed by the statistical method. At the same time, the data under the influence of policy were classified and analyzed, and the influence of each policy on each quantifiable index was studied. In terms of content, this paper firstly decomposes, compares and analyzes the patent subsidy policy from four aspects, and analyzes their similarities and differences. Then, from the data of patent application, authorization, implementation and pledge of traditional Chinese medicine, we extract the data indicators that can be quantified from the subsidy policy, and combine the analysis part of the patent policy. Qualitative and quantitative analysis of the impact of patent subsidy policy on traditional Chinese medicine patent changes. Finally, the research is summarized and analyzed, and some suggestions are put forward. The research results show that all localities should strengthen the evaluation of patent subsidy policy in the field of traditional Chinese medicine and revise and perfect the patent application subsidy policy. Establish the national network patent aid management platform and the cooperation mechanism of patent aid at all levels, refine and perfect the patent subsidy policy, attach importance to the application after patent authorization of traditional Chinese medicine.
