【摘要】：近年來,技術(shù)標(biāo)準(zhǔn)越來越多的涉及到技術(shù)專利,技術(shù)專利已逐步成為技術(shù)標(biāo)準(zhǔn)的重要主體。在信息技術(shù)等高技術(shù)領(lǐng)域,在技術(shù)專利基礎(chǔ)上創(chuàng)立技術(shù)標(biāo)準(zhǔn),引導(dǎo)產(chǎn)業(yè)發(fā)展,謀求技術(shù)標(biāo)準(zhǔn)帶來的壟斷利潤,已成為發(fā)達國家和跨國企業(yè)重要的競爭手段。為簡化標(biāo)準(zhǔn)中專利的許可,加速標(biāo)準(zhǔn)的產(chǎn)業(yè)化,標(biāo)準(zhǔn)聯(lián)盟主要以專利池運營擁有的技術(shù)專利,專利池在標(biāo)準(zhǔn)創(chuàng)立及產(chǎn)業(yè)化中扮演著日益重要的角色。 本文以技術(shù)標(biāo)準(zhǔn)理論、專利池理論以及專利定量分析方法相關(guān)理論為基礎(chǔ),采用統(tǒng)計分析以及數(shù)學(xué)模型,對技術(shù)標(biāo)準(zhǔn)背景下的專利池演進及其專利申請行為進行了分析。首先,按照專利池發(fā)展的歷程,將其分成了三個典型階段,通過統(tǒng)計分析及社會網(wǎng)絡(luò)分析,分別總結(jié)了早期專利池以及技術(shù)標(biāo)準(zhǔn)背景下專利池的典型特點、專利池運行機制及專利池中的知識產(chǎn)權(quán)策略。其次,為辨識專利池中是否存在策略性的專利申請行為,以典型專利池中的必要專利數(shù)據(jù)為研究樣本,以專利質(zhì)量為測度指標(biāo),對專利池中的專利申請行為進行了分析。 研究表明,技術(shù)標(biāo)準(zhǔn)背景下的專利池主要集中于通信技術(shù)等高技術(shù)領(lǐng)域,圍繞專利池的合作越來越多,專利池已成為發(fā)達國家的利益聯(lián)合體；專業(yè)的專利池管理公司模式已成為專利池的主流運行模式。對專利池中的專利申請行為研究表明,專利池創(chuàng)立前后是專利申請的高峰期,這些專利絕大部分為專利池的發(fā)起人所控制；專利池中的專利質(zhì)量隨時間推移逐步降低,越在后期加入專利池的公司其質(zhì)量越低；專利池創(chuàng)立后申請的專利中,由發(fā)起人申請的專利質(zhì)量低于新成員。這表明專利池中存在策略型的專利申請行為；相對新成員,專利池發(fā)起人更有可能采取策略性的專利申請行為,將低價值專利加入專利池中。
[Abstract]:In recent years, technical standards are more and more related to technology patents, and technology patents have gradually become the main body of technical standards. In high-tech fields such as information technology, it has become an important means of competition for developed countries and multinational enterprises to establish technical standards on the basis of technology patents, to guide industry development and to seek monopoly profits brought by technical standards. In order to simplify the licensing of patent and accelerate the industrialization of the standard, the standard alliance mainly uses the technical patent which is owned by the patent pool, which plays an increasingly important role in the establishment and industrialization of the standard. Based on the theory of technical standard, patent pool theory and patent quantitative analysis method, this paper analyzes the evolution of patent pool and patent application behavior under the background of technical standard by using statistical analysis and mathematical model. Firstly, according to the development course of patent pool, it is divided into three typical stages. Through statistical analysis and social network analysis, the typical characteristics of patent pool in the early stage and in the background of technical standards are summarized respectively. Operation mechanism of patent pool and intellectual property strategy in patent pool. Secondly, in order to identify the strategic patent application behavior in the patent pool, taking the necessary patent data in the typical patent pool as the research sample and the patent quality as the measure index, this paper analyzes the patent application behavior in the patent pool. The research shows that the patent pool under the background of technical standard is mainly concentrated in the high-tech fields such as communication technology, and the cooperation around the patent pool is more and more, and the patent pool has become a consortium of interests of developed countries. Professional patent pool management company model has become the mainstream operation mode of patent pool. The research on patent application behavior in patent pool shows that before and after the establishment of patent pool, the peak period of patent application is before and after the establishment of patent pool, and most of these patents are controlled by the originator of patent pool, and the quality of patent in patent pool decreases gradually over time. The later the company joined the pool, the lower the quality of the patent pool; the quality of the patent filed by the sponsor is lower than that of the new member after the establishment of the patent pool. This indicates that there is a strategic patent application behavior in the patent pool, and the initiator of the patent pool is more likely to take strategic patent application behavior than the new member, and to add the low-value patent to the patent pool.
