【摘要】：[目的/意義]比較中關(guān)專利引文的異同,對兩者深入認識理解,明晰兩者在揭示專利關(guān)聯(lián)度、反映專利所有者間競爭關(guān)系、判斷專利商業(yè)價值和法律穩(wěn)定性等方面的異同,以利于專利引文價值的更好實現(xiàn)。[方法/過程]研究中美專利引文的區(qū)別,并深入分析其專利制度和社會觀念層面的原因。[結(jié)果/結(jié)論]中美專利引文在著錄內(nèi)容、引用位置、排序標準、標識要素、類型標注及對PCT申請的國際階段產(chǎn)生的專利引文態(tài)度等方面均存在差異,因而在建立專利引文數(shù)據(jù)庫、挖掘?qū)＠那閳髸r,只有區(qū)別處理,才能提高專利引文分析成果的準確性,更加有效地實現(xiàn)專利引文的價值。
[Abstract]:[objective / significance] to compare the similarities and differences of patent citations in China, to understand them deeply, to clarify the similarities and differences between them in revealing the degree of connection of patents, to reflect the competitive relationship between patent owners, to judge the commercial value and legal stability of patents, etc. In order to facilitate the better realization of the value of patent citation. [method / process] to study the differences between Chinese and American patent citations, and to analyze in depth the reasons for their patent system and social concept. [results / conclusion] Chinese and American patent citations are in the description content and citation position, There are differences in ranking criteria, identification elements, type tagging and patent citation attitude to the international stage of PCT application. Therefore, when establishing patent citation database and mining patent citation information, we should deal with it differently. Only then can the accuracy of patent citation analysis be improved and the value of patent citation be realized more effectively.
