【摘要】：傳播時(shí)代的大眾傳媒具備強(qiáng)大的公共話語塑造能力,這一話語能力業(yè)已成為影響立法績效的深層次社會因素�；趥惱碇髁x生成的符號功能,媒體話語往往被表層地解讀為公意;而作為證成立法民主價(jià)值的信號顯示,立法者以"媒體熱議—立法跟進(jìn)"的決策模式回應(yīng)媒體塑造的輿論氣候壓力,自我認(rèn)可并選擇了媒體話語作為權(quán)利義務(wù)配置的外部敦促力量,立法活動(dòng)被化約為應(yīng)對媒體話語沖擊的策略選擇,導(dǎo)致壓力型立法。這一立法決策模式忽略了司法機(jī)制運(yùn)作可觀察性、可檢驗(yàn)性的剛性約束,忽略了法律控制與社會規(guī)范等非法律控制的分工邊界,以偏狹的法律中心主義造成不可欲的泛立法化,以至于諸多"熱點(diǎn)入法"屢屢遭遇司法失靈,導(dǎo)致立法民主、科學(xué)雙重失落。應(yīng)當(dāng)從優(yōu)化立法公眾參與程序、建構(gòu)立法技術(shù)保障機(jī)制、人大代表立法提案公示制度、法律實(shí)施信息定期交換機(jī)制等多重維度進(jìn)行系統(tǒng)性設(shè)計(jì),實(shí)現(xiàn)價(jià)值理性與技術(shù)理性的有機(jī)融合。
[Abstract]:The mass media in the age of communication have strong ability of shaping public discourse, which has become a deep social factor affecting the legislative performance. Based on the symbolic function generated by ethicism, media discourse is often interpreted as public intention on the surface, and as a signal of the democratic value of the established law, The legislator responded to the media climate pressure with the "media hot discussion-legislation follow up" decision-making model, and chose the media discourse as the external urging force of the allocation of rights and obligations. Legislative activities are reduced to strategic choices to deal with media discourse shocks, leading to pressure-type legislation. This mode of legislative decision-making neglects the observability and testability of the judicial mechanism, neglects the boundary of the division of labor between legal control and social norm, and so on. So that many "hot-spot law" repeatedly encountered judicial failure, resulting in legislative democracy, science dual loss. The systematic design should be carried out from the aspects of optimizing the procedure of public participation in legislation, constructing the mechanism of legislative technical guarantee, publicizing the legislative proposal of deputies to the people's Congress, and regularly exchanging information on the implementation of the law. Realizing the organic fusion of value rationality and technical rationality.
