【摘要】：通過文獻(xiàn)資料、比較分析等研究方法,從軟法視角分析體育產(chǎn)業(yè)政策的法律性質(zhì)、軟法表現(xiàn)形式、效力結(jié)構(gòu)等。認(rèn)為,體育產(chǎn)業(yè)政策是體育產(chǎn)業(yè)發(fā)展的行為準(zhǔn)則,它規(guī)定和指導(dǎo)著體育產(chǎn)業(yè)的發(fā)展方向。從法律維度看,作為保障體育產(chǎn)業(yè)發(fā)展的有效方式與制度形式,體育產(chǎn)業(yè)政策本質(zhì)上是一種具有"組織規(guī)則"特質(zhì)的軟法規(guī)范、體育領(lǐng)域軟法的載體形態(tài),由"權(quán)利—職責(zé)(權(quán)利—義務(wù))"規(guī)則、目的性思維、自創(chuàng)性內(nèi)核等結(jié)構(gòu)性要素組成的體育產(chǎn)業(yè)政策對促進(jìn)體育產(chǎn)業(yè)發(fā)展起著獨(dú)特的功能。提出今后我國體育產(chǎn)業(yè)政策調(diào)整完善需以"良法善治"為準(zhǔn)據(jù)、提高政策執(zhí)行能力、健全監(jiān)督機(jī)制、加強(qiáng)績效考量、確立體育產(chǎn)業(yè)政策執(zhí)行評估機(jī)制,以期實(shí)現(xiàn)體育產(chǎn)業(yè)發(fā)展的軟法之治。
[Abstract]:By means of literature, comparative analysis and other research methods, this paper analyzes the legal nature of sports industry policy, the manifestation of soft law and the structure of effectiveness from the perspective of soft law.It is believed that sports industry policy is the code of conduct for the development of sports industry, which prescribes and guides the development direction of sports industry.From the perspective of law, as an effective way and system form to ensure the development of sports industry, sports industry policy is essentially a kind of soft law norm with the characteristics of "organization rules", and the carrier form of soft law in sports field.The sports industry policy, which consists of the rules of "right-duty (right-duty)", the purposeful thinking and the self-creating core, plays a unique role in promoting the development of sports industry.It is pointed out that the future adjustment and perfection of sports industry policy should be based on the basis of "good law and good governance", improve the ability of policy implementation, improve the supervision mechanism, strengthen the consideration of performance, and establish the evaluation mechanism of sports industry policy implementation.In order to achieve the development of sports industry soft law governance.
