【摘要】:住房反向抵押貸款發(fā)展至今,在國外已成為解決一部分老年人現(xiàn)金貧困,改善老年人福利的一款重要的房產(chǎn)金融產(chǎn)品。目前,我國住房反向抵押貸款還處于理論的論證階段。從上世紀末至今,我國學(xué)者根據(jù)我國的實際情況從住房反向抵押貸款的運營、風(fēng)險控制、實施條件及可行性等方面做了相關(guān)研究。住房反向抵押貸款在我國還是一個新生事物,在實踐方面發(fā)展得相對緩慢。究其實踐進程遲緩的原因在于發(fā)展住房反向抵押貸款的不確定因素很多,各關(guān)聯(lián)方的參與積極性不高,尤其本應(yīng)是作為住房抵押貸款的發(fā)起者和規(guī)則的制定者的政府部門和金融機構(gòu)參與積極性不高。在我國,金融機構(gòu)進行股份制改革后,政府在金融機構(gòu)的角色是以國有控股或參股的形式存在,也就是說政府部門在金融機構(gòu)中起到了主導(dǎo)地位。政府部門作為住房反向抵押貸款的重要參與者,但是目前廣泛存在參與的廣度和深度都有待進一步提高。作為社會的管理者、公共服務(wù)的提供者、公共政策的制定者和執(zhí)行者,探索和發(fā)展適合我國實際需要的住房反向抵押貸款是政府落實其自身責(zé)任的重要體現(xiàn)。 本文在我國人口老齡化的大背景下,結(jié)合住房反向抵押貸款的基本理論,從其產(chǎn)品特性、風(fēng)險防范、業(yè)務(wù)規(guī)范等方面,對我國發(fā)展住房反向抵押貸款中的政府責(zé)任進行分析。同時結(jié)合國外的實踐經(jīng)驗,對外國開展住房反向抵押貸款的政府責(zé)任進行梳理,提出我國發(fā)展住房反向抵押貸款政府責(zé)任的對策建議。
[Abstract]:The development of reverse mortgage has become an important real estate financial product to solve some old people's cash poverty and improve the welfare of the elderly. At present, our country housing reverse mortgage loan is still in the theoretical argumentation stage. From the end of last century to now, Chinese scholars have done some research on the operation, risk control, implementation conditions and feasibility of the reverse mortgage loan according to the actual situation of our country. Housing reverse mortgage in China is still a new thing, in practice, the development is relatively slow. The reason why the practice process is slow is that there are many uncertain factors in the development of reverse mortgage loans, and the participation enthusiasm of all related parties is not high. In particular, government departments and financial institutions, which were supposed to be the initiators and rule-setters of mortgage loans, had little incentive to participate. After the shareholding system reform of financial institutions in China, the role of government in financial institutions exists in the form of state-owned holding or equity participation, that is to say, government departments play a leading role in financial institutions. Government is an important participant in reverse mortgage, but the breadth and depth of participation need to be further improved. As the social manager, the public service provider, the public policy maker and the executor, the exploration and development of the housing reverse mortgage which suits the actual needs of our country is the important embodiment of the government to carry out its own responsibility. Under the background of aging population in our country, combining with the basic theory of housing reverse mortgage loan, this paper analyzes the government responsibility in the development of reverse housing mortgage loan in China from the aspects of product characteristics, risk prevention, business standard and so on. At the same time, combined with the practical experience of foreign countries, this paper combs the government responsibility of developing the reverse mortgage loan in foreign countries, and puts forward the countermeasures and suggestions for the development of the government responsibility of the reverse mortgage loan in our country.
