【摘要】:最近幾年,民間金融、民間融資頻繁出現(xiàn)在學(xué)者的論文、政府的報(bào)告及媒體的報(bào)道中,被大家提及最多的便是民間金融風(fēng)險(xiǎn)持續(xù)暴露,必須盡快把其規(guī)范化發(fā)展提上日程。實(shí)際上,民間金融自古就有,只不過(guò)隨著經(jīng)濟(jì)的快速發(fā)展、民間財(cái)富的迅速積累及互聯(lián)網(wǎng)金融的興起而不斷豐富和活躍起來(lái)。它作為正規(guī)金融的有效補(bǔ)充,為民營(yíng)經(jīng)濟(jì)尤其是中小微企業(yè)的發(fā)展提供了強(qiáng)有力的資金支持,豐富了我國(guó)的金融業(yè)態(tài)和形式,提高了民間資本的使用效率。與此同時(shí),它的隱蔽性、逐利性和盲目性也容易使其“脫實(shí)相虛”,滋生金融風(fēng)險(xiǎn),危害金融穩(wěn)定和社會(huì)秩序。尤其是近幾年來(lái),全國(guó)各地頻繁發(fā)生的投資擔(dān)保公司跑路事件、非法集資事件等將民間金融推向風(fēng)口浪尖上,我們必須對(duì)這一問(wèn)題引起重視。本文正是以此為背景,探討了規(guī)范發(fā)展我國(guó)民間金融的路徑研究。文章一共分為五章。第一章是導(dǎo)論,主要是介紹了本文的研究背景、意義、內(nèi)容、方法及國(guó)內(nèi)外研究現(xiàn)狀等。第二章介紹了我國(guó)民間金融產(chǎn)生的理論基礎(chǔ),借此論證民間金融存在的合理性。并分析了我國(guó)民間金融的規(guī)模、形式及特點(diǎn)等,從整體上對(duì)當(dāng)前我國(guó)的民間金融發(fā)展現(xiàn)狀有個(gè)宏觀把握。第三章介紹了民間金融對(duì)我國(guó)經(jīng)濟(jì)社會(huì)產(chǎn)生的積極作用及負(fù)面效應(yīng),為充分發(fā)揮其積極作用,降低或消除其負(fù)面效應(yīng),必須對(duì)其進(jìn)行規(guī)范發(fā)展,將一定規(guī)模以上的民間金融活動(dòng)納入監(jiān)管范圍。通過(guò)山東省的小額貸款公司、典當(dāng)行、融資性擔(dān)保機(jī)構(gòu)及民間融資機(jī)構(gòu)的運(yùn)行情況介紹論證了引導(dǎo)民間金融規(guī)范化發(fā)展的可行性,同時(shí)指出了當(dāng)前的監(jiān)管體系仍存在一些漏洞,亟需完善。第四章詳細(xì)分析了美國(guó)、日本、臺(tái)灣和香港對(duì)民間金融的監(jiān)管歷程及成功經(jīng)驗(yàn),以期得到對(duì)我國(guó)有借鑒意義的經(jīng)驗(yàn)啟示。第五章在前面問(wèn)題和經(jīng)驗(yàn)分析的基礎(chǔ)上,提出了我國(guó)規(guī)范化發(fā)展民間金融的路徑選擇,即在堅(jiān)持透明化、制度化、有效監(jiān)管和靈活性的原則基礎(chǔ)上,建立以地方政府為主導(dǎo)民間金融監(jiān)管體系,重點(diǎn)從完善民間金融的相關(guān)法律法規(guī)、對(duì)不同類(lèi)型的民間金融實(shí)行差別化監(jiān)管、建立民間借貸的登記備案制度、加強(qiáng)民間征信體系建設(shè)及加強(qiáng)金融風(fēng)險(xiǎn)防控體系建設(shè)等五個(gè)方面進(jìn)行規(guī)范發(fā)展。
[Abstract]:In recent years, folk finance and private finance appear frequently in scholars' papers, government reports and media reports, the most mentioned is the continuous exposure of private financial risks, which must be put on the agenda as soon as possible. In fact, folk finance has existed since ancient times, but with the rapid development of economy, the rapid accumulation of folk wealth and the rise of Internet finance, it has become rich and active. As an effective supplement of formal finance, it provides strong financial support for the development of private economy, especially small and medium-sized enterprises, enriches the financial forms and forms of our country, and improves the efficiency of private capital. At the same time, its concealment, profit-seeking and blindness also make it easy to "get rid of reality", breed financial risk, endanger financial stability and social order. Especially in recent years, the frequent incidents of investment guarantee companies running the road and illegal raising of funds have pushed private finance to the top of the wave. We must pay attention to this problem. Based on this background, this paper probes into the research of the way to standardize the development of private finance in China. The article is divided into five chapters. The first chapter is an introduction, mainly introduces the research background, significance, content, methods and domestic and foreign research status. The second chapter introduces the theoretical basis of the emergence of private finance in China to demonstrate the rationality of the existence of private finance. The paper also analyzes the scale, form and characteristics of the folk finance in our country, and has a macroscopic grasp of the present situation of the development of the folk finance in our country as a whole. The third chapter introduces the positive and negative effects of folk finance on China's economy and society. In order to give full play to its positive role and reduce or eliminate its negative effects, it is necessary to standardize its development. Bring private financial activities above a certain scale into the scope of supervision. Through the introduction of the operation of small loan companies, pawnshops, financing guarantee institutions and private financing institutions in Shandong Province, this paper demonstrates the feasibility of guiding the standardized development of private finance, and points out that there are still some loopholes in the current regulatory system. Perfection is in urgent need. The fourth chapter analyzes the process and successful experience of American, Japanese, Taiwan and Hong Kong's supervision of private finance in detail, in order to get the enlightenment to our country's experience. The fifth chapter, on the basis of the previous problems and experience analysis, puts forward the path choice for the standardized development of folk finance in China, that is, on the basis of adhering to the principles of transparency, institutionalization, effective supervision and flexibility. To establish the local government as the leading private financial supervision system, focusing on perfecting the relevant laws and regulations of private finance, implementing differential supervision over different types of private finance, and establishing a registration and filing system for private loans and loans, Strengthen the construction of private credit system and strengthen the construction of financial risk prevention and control system.
