【摘要】：2007年頒布實施的《中華人民共和國農(nóng)民專業(yè)合作社法》第二條規(guī)定:“農(nóng)民專業(yè)合作社是在農(nóng)村家庭承包經(jīng)營基礎(chǔ)上,同類農(nóng)產(chǎn)品的生產(chǎn)經(jīng)營者或者同類農(nóng)業(yè)生產(chǎn)經(jīng)營服務(wù)的提供者、利用者,自愿聯(lián)合、民主管理的互助性經(jīng)濟組織”。農(nóng)民專業(yè)合作社遵循自愿和開放的成員資格、民主成員控制、社員經(jīng)濟參與、獨立和自主、教育、培訓(xùn)和信息、合作社之間的合作和關(guān)心社區(qū)等原則。農(nóng)民專業(yè)合作社的治理是一種雙重治理結(jié)構(gòu),它既是一個社會團(tuán)體,也是一個商事企業(yè),在不同的文化傳統(tǒng)中,人們對合作社的旨趣追求有微妙的差異。我國農(nóng)民專業(yè)合作社追求的是農(nóng)民專業(yè)合作社的合法、合意和有效三大治理目標(biāo)。本論文運用定性研究和定量研究相結(jié)合、邏輯和歷史相統(tǒng)一、歸納和演繹相結(jié)合的方法,從空間維度對現(xiàn)在農(nóng)民專業(yè)合作社治理的理論指導(dǎo)、制度基礎(chǔ)和社會背景進(jìn)行總結(jié),對農(nóng)民專業(yè)合作社治理的現(xiàn)實約束進(jìn)行分析;從主體維度對農(nóng)民專業(yè)合作社的社員素質(zhì)進(jìn)行分析,社員是農(nóng)民專業(yè)合作社的主體,由于其在合作社中的角色、視角不同而產(chǎn)生不同的心理感受,加之社員的文化素質(zhì)、民主意識的缺乏,產(chǎn)生了合作社的搭便車問題、認(rèn)同問題、精英俘獲、信任等問題,針對此些問題提出了對策;從制度環(huán)境來講,農(nóng)民專業(yè)合作社面臨其內(nèi)部制度、法律規(guī)范、外部制度的約束,在農(nóng)業(yè)發(fā)展中,有一種樸素的說法:“一靠政策,二靠科技,三靠投入”,制度本身雖然不是農(nóng)業(yè)資源,但是它能夠使資源進(jìn)行不同的組合,為資源配置提供環(huán)境、從而產(chǎn)生不同的成本和績效。所以對制度特別是上升為政策的制度關(guān)注能夠為合作社治理的發(fā)展提供適宜的環(huán)境,針對內(nèi)外部制度運行及其法律的不規(guī)范,指出導(dǎo)致中國農(nóng)民專業(yè)合作社產(chǎn)生的問題,并提出完善的措施。中國農(nóng)民專業(yè)合作社的治理是以馬克思主義合作經(jīng)濟思想為理論指導(dǎo),文章對農(nóng)民合作經(jīng)濟的制度條件、組織原則、組織形式、實現(xiàn)過程、分配方式和組織目標(biāo)進(jìn)行論述,并闡述了這些理論對中國農(nóng)民專業(yè)合作社治理的組織形式、融資渠道、管理機制、決策機制、分配機制和監(jiān)督機制的理論指導(dǎo)作用。中國農(nóng)民專業(yè)合作社治理是以中國農(nóng)民合作社的治理實踐為基礎(chǔ)的。文章對中國農(nóng)民專業(yè)合作社治理實踐的歷史進(jìn)行了簡要回顧,并具體解剖了各個時期的治理結(jié)構(gòu)及其治理績效,為新型農(nóng)民專業(yè)合作社提供了歷史實踐經(jīng)驗。中國農(nóng)民專業(yè)合作社治理改進(jìn)也存在著現(xiàn)實約束,主要包括國家行政行為的制度嵌入、市場經(jīng)濟的經(jīng)濟嵌入、農(nóng)產(chǎn)品供應(yīng)鏈管理的管理嵌入以及鄉(xiāng)土文化的文化嵌入所造成的一系列農(nóng)民專業(yè)合作社治理困境。影響中國農(nóng)民專業(yè)合作社治理改進(jìn)的因素包括成員素質(zhì)、法律規(guī)制、內(nèi)部治理機制及其外部環(huán)境。文章通過對上述因素形成的治理困境進(jìn)行一一剖析,提出具有針對性的中國農(nóng)民合作社治理改進(jìn)對策。需要指出的是,由于我國的農(nóng)民專業(yè)合作社發(fā)展起步較晚,所以出現(xiàn)各種各樣的問題,但是隨著未來合作社社員素質(zhì)的提升、農(nóng)民專業(yè)合作社相關(guān)法律的完善、農(nóng)民專業(yè)合作社內(nèi)部治理機制及其外部治理環(huán)境的不斷規(guī)范,一定能夠?qū)崿F(xiàn)其組織的合意性和合目的性。當(dāng)然對于國外的先進(jìn)經(jīng)驗,我們應(yīng)該秉承“萬物并育而不相害,道并行而不相�！钡男拍�,吸收和借鑒國外先進(jìn)經(jīng)驗,使其成為中國農(nóng)村帶動經(jīng)濟發(fā)展,提高農(nóng)民生活水平和社會公共服務(wù)化體系的經(jīng)濟互助組織。
