【摘要】：中國(guó)的社會(huì)轉(zhuǎn)型是全方位的,涉及到社會(huì)、政治、文化等各個(gè)領(lǐng)域,是一種由傳統(tǒng)社會(huì)向現(xiàn)代社會(huì)的過渡。在這種過渡的社會(huì)形式下,隨著經(jīng)濟(jì)體制的不斷完善,公安派出所功能經(jīng)歷了由單一到多功能的演變,在這種多功能的演變過程中,受轉(zhuǎn)型社會(huì)經(jīng)濟(jì)體制、社會(huì)結(jié)構(gòu)、利益格局以及思想觀念不斷調(diào)整與變化的影響,公安派出所的功能定位出現(xiàn)了誤區(qū)。結(jié)合公安派出所執(zhí)法執(zhí)勤的現(xiàn)實(shí)狀況,筆者對(duì)公安派出所功能定位存在的問題進(jìn)行提煉與總結(jié),得出影響我國(guó)公安派出所功能定位的原因,即執(zhí)法依據(jù)滯后、不協(xié)調(diào)、不統(tǒng)一；執(zhí)法行為不合法、不規(guī)范,執(zhí)法理念落后；承擔(dān)過多非警務(wù)活動(dòng)以及聯(lián)合執(zhí)法不規(guī)范等。筆者認(rèn)為,公安派出所要實(shí)現(xiàn)功能的合理定位,必須結(jié)合轉(zhuǎn)型社會(huì)的背景,在明確的法律地位、職權(quán)及職責(zé)條件下,完善法律制度、強(qiáng)化執(zhí)法監(jiān)督、減少非警務(wù)活動(dòng)及規(guī)范聯(lián)合執(zhí)法的,使公安派出所從過多的社會(huì)功能重解脫,充分發(fā)揮其法律功能,以實(shí)現(xiàn)其功能的合理定位。 本文以轉(zhuǎn)型社會(huì)為背景,結(jié)合公共管理與行政管理相關(guān)理論,對(duì)本文進(jìn)行論述。全文共分為三個(gè)部分,第一章為轉(zhuǎn)型社會(huì)中的公安派出所,主要介紹轉(zhuǎn)型社會(huì)的內(nèi)涵及公安派出所的法律功能；第二章為轉(zhuǎn)型社會(huì)公安派出所功能定位存在的問題,主要思路是呈現(xiàn)公安派出所在功能定位中存在法律功能發(fā)揮不完善,非警務(wù)活動(dòng)承載過多以及參與大量聯(lián)合執(zhí)法活動(dòng)等問題,第三章為轉(zhuǎn)型社會(huì)下公安派出所功能定位的建議,主要從規(guī)范行政執(zhí)法,完善法律制度,強(qiáng)化執(zhí)法監(jiān)督等方面實(shí)現(xiàn)公安派出所法律功能合理定位；通過完善法律制度,減少公安派出所非警務(wù)活動(dòng)；確立行政協(xié)助法制化來規(guī)范公安派出所聯(lián)合執(zhí)法活動(dòng)。
[Abstract]:China's social transformation is all-round, involving social, political, cultural and other fields, is a transition from traditional society to modern society. In this transitional social form, with the continuous improvement of the economic system, the function of the police station has undergone a single to multi-functional evolution. In the process of this multi-functional evolution, it is subject to the transformation of the socio-economic system and the social structure. Under the influence of the adjustment and change of interest pattern and ideology, the function orientation of police station has been misunderstood. Combined with the actual situation of law enforcement in police stations, the author abstracts and summarizes the problems existing in the function orientation of police stations, and draws a conclusion that the reasons affecting the function orientation of police stations in China are lagging behind, uncoordinated and non-uniform. The law enforcement behavior is illegal, irregular, the law enforcement idea is backward, undertake too much non-police activities and joint law enforcement is not standard and so on. The author believes that in order to realize the reasonable orientation of the function of the police station, it is necessary to improve the legal system and strengthen the supervision of the law enforcement under the condition of clear legal status, authority and duty, in the light of the background of the transitional society. By reducing non-police activities and standardizing joint law enforcement, public security police stations can be relieved from excessive social functions and give full play to their legal functions in order to realize the rational positioning of their functions. This article takes the transition society as the background, unifies the public management and the administration management correlation theory, carries on the elaboration to this article. The full text is divided into three parts. The first chapter is the police station in the transitional society, which mainly introduces the connotation of the transitional society and the legal function of the police station. The second chapter is about the problems existing in the function orientation of the police station in the transitional society. The main idea is to show that the legal function of the police station is not perfect in the orientation of the function of the police station. Non-police activities carry too much and participate in a large number of joint law enforcement activities, and so on. The third chapter is the suggestion of the function orientation of the police station under the transitional society, mainly from standardizing the administrative law enforcement and perfecting the legal system. Strengthening the supervision of law enforcement and other aspects to realize the reasonable positioning of the legal function of police stations; By perfecting the legal system, the non-police activities of police stations are reduced, and the legalization of administrative assistance is established to standardize the joint law enforcement activities of police stations.
