【摘要】：在市場(chǎng)經(jīng)濟(jì)高速發(fā)展的今天,鐵路作為人們出行中的一種重要的交通手段,已經(jīng)深入到每個(gè)人的日常生活之中,但是在市場(chǎng)經(jīng)濟(jì)發(fā)展的今天,鐵路運(yùn)輸管理行政執(zhí)法過程中出現(xiàn)的糾紛也隨著增多。改革開放以來,我國的法治化建設(shè)有了長(zhǎng)足的進(jìn)步,在行政執(zhí)法依法辦事和公共監(jiān)督按章辦事等方面更是有很大的提高。但由于諸多方面的原因的影響,鐵路運(yùn)輸管理機(jī)關(guān)的行政執(zhí)法現(xiàn)狀還是存在相當(dāng)多的問題,隊(duì)伍建設(shè)不當(dāng)、依法執(zhí)行理念不深入、行政執(zhí)法保障不力、企業(yè)法律意識(shí)不強(qiáng)等問題還不同程度地存在,這些問題是當(dāng)前鐵路運(yùn)輸管理行政執(zhí)法中存在的最突出、最重要的問題,這就顯示了本論題進(jìn)行研究的重要性和現(xiàn)實(shí)意義。 本文力圖以沈陽鐵路局運(yùn)輸管理行政執(zhí)法中存在的問題為切入點(diǎn),對(duì)沈陽鐵路局運(yùn)輸管理行政執(zhí)法中存在的問題作了分析總結(jié)。它主要表現(xiàn)在企業(yè)法律風(fēng)險(xiǎn)意識(shí)不強(qiáng)、依法行政理念不深入、行政執(zhí)法隊(duì)伍能力不足、行政執(zhí)法保障不利等方面。進(jìn)而,筆者從理論上探討沈陽鐵路局運(yùn)輸管理行政執(zhí)法中存在問題的原因,分別是鐵路法律法規(guī)體系不完善、政企分開不到位、行政執(zhí)法隊(duì)伍培養(yǎng)存在問題、行政執(zhí)法保障不能滿足發(fā)展要求等原因。在以此為前提的條件下,筆者提出了相應(yīng)對(duì)策。一是依法推進(jìn)鐵路改革；二是依法促進(jìn)政企分開；三是注重行政執(zhí)法隊(duì)伍的培養(yǎng)；四是加強(qiáng)行政執(zhí)法后勤保障。 本文以公共管理理論為基礎(chǔ),在對(duì)沈陽鐵路局運(yùn)輸管理行政執(zhí)法工作做以充分調(diào)研的基礎(chǔ)上,研究問題發(fā)生的原因,提出解決問題的方法,希望對(duì)沈陽鐵路局運(yùn)輸管理行政執(zhí)法工作有一定的參考價(jià)值。
[Abstract]:With the rapid development of the market economy, railway, as an important means of transportation for people to travel, has penetrated into the daily life of everyone, but today with the development of the market economy, The disputes in the administrative law enforcement process of railway transportation management are also increasing. Since the reform and opening up, the construction of rule of law in our country has made great progress. However, due to the influence of many factors, there are still many problems in the present situation of the administrative law enforcement of railway transport management organs. The construction of the team is improper, the concept of implementing the law is not deep enough, and the administrative law enforcement guarantee is weak. The legal consciousness of enterprises is not strong and so on. These problems are the most prominent and most important problems in the administration and enforcement of railway transportation management, which shows the importance and practical significance of the research on this topic. This paper attempts to analyze and summarize the problems existing in the administrative law enforcement of the transport management of Shenyang Railway Administration by taking the existing problems in the administrative law enforcement of the transportation management of Shenyang Railway Administration as the starting point. It mainly shows that the legal risk consciousness of enterprises is not strong, the concept of administration according to law is not deep, the ability of administrative law enforcement team is insufficient, and the protection of administrative law enforcement is unfavorable. Furthermore, the author theoretically discusses the causes of the problems in the administrative law enforcement of the transport management of Shenyang Railway Administration, which are respectively due to the imperfect system of railway laws and regulations, the lack of separation between government and enterprises, and the problems existing in the training of administrative law enforcement teams. Administrative law enforcement protection can not meet the development requirements and other reasons. Under the condition of this premise, the author puts forward the corresponding countermeasures. The first is to promote railway reform according to law; the second is to promote the separation of government and enterprises according to law; the third is to pay attention to the training of administrative law enforcement teams; and the fourth is to strengthen logistical support for administrative law enforcement. Based on the theory of public management, this paper studies the causes of the problems and puts forward the methods to solve the problems on the basis of the full investigation of the administrative law enforcement work of the transport management of Shenyang Railway Administration. It is hoped that it will be of some reference value to Shenyang Railway Administration for administrative law enforcement of transportation management.
