【摘要】：摘要：隨著移動(dòng)通信業(yè)務(wù)的飛速發(fā)展,手機(jī)終端的深度普及,手機(jī)短信業(yè)務(wù)已經(jīng)成為日常生活必不可少的一部分。手機(jī)短信在給公眾帶來便利的同時(shí),伴隨而生的垃圾短信卻給公眾帶來了諸多煩惱,不僅影響了人們的日常生活擾亂了社會(huì)的通信和市場秩序,還會(huì)給社會(huì)風(fēng)氣帶來不良影響。因此,如何治理垃圾短信已經(jīng)成為一個(gè)重要的社會(huì)問題,在現(xiàn)有的治理方式下,如何結(jié)合公共管理學(xué)的相關(guān)理論推進(jìn)治理成效已經(jīng)成為一個(gè)重要的實(shí)踐課題。 本文綜合運(yùn)用了公共治理理論、公共管理倫理學(xué)理論、法學(xué)相關(guān)理論和觀點(diǎn),結(jié)合日常工作的實(shí)踐經(jīng)驗(yàn),采用實(shí)證分析和綜合研究方法,在綜述國內(nèi)外有關(guān)垃圾短信治理研究現(xiàn)狀的基礎(chǔ)上,通過闡述從定義、分類、特征等角度對(duì)垃圾短信進(jìn)行描述,先初步探討了垃圾短信的特征對(duì)其進(jìn)行了綜合的定義。然后通過對(duì)國外先進(jìn)經(jīng)驗(yàn)的總結(jié)以及垃圾短信治理工作的現(xiàn)狀分析,提出了垃圾短信泛濫的成因：國家立法不夠完善、個(gè)人信息的保護(hù)不重視、運(yùn)營商的職業(yè)倫理規(guī)范不夠、政府治理力度不夠。針對(duì)以上問題,提出了完善短信業(yè)務(wù)立法、優(yōu)化企業(yè)內(nèi)部管理、手機(jī)用戶自律以及加強(qiáng)宣傳構(gòu)建良好短信文化四項(xiàng)治理對(duì)策。
[Abstract]:Absrtact: with the rapid development of mobile communication service and the popularity of mobile terminal, SMS service has become an indispensable part of daily life. While SMS brings convenience to the public, it brings many troubles to the public. It not only affects people's daily life and disturbs the social communication and market order, but also brings bad influence to the social atmosphere. Therefore, how to deal with spam messages has become an important social problem, under the existing governance, How to combine the relevant theories of public management to promote the effectiveness of governance has become an important practical issue. This paper synthetically applies the theory of public governance, the theory of ethics of public management, the theory and viewpoint of law. Based on the practical experience of daily work, using empirical analysis and comprehensive research methods, on the basis of summarizing the current situation of research on the governance of spam short message at home and abroad, this paper describes the spam short message from the perspectives of definition, classification, characteristics, and so on. First, the characteristics of spam SMS are discussed. Then through the summary of foreign advanced experience and the analysis of the current situation of spam SMS management, the causes of spam SMS flooding are put forward: the national legislation is not perfect, the protection of personal information is not taken seriously, and the professional ethics norms of operators are not enough. Government governance is not strong enough. In view of the above problems, this paper puts forward four countermeasures: perfecting the legislation of short message service, optimizing the internal management of the enterprise, self-discipline of mobile phone users and strengthening propaganda and constructing a good short message culture.
