杭州市行政服務(wù)中心運(yùn)行機(jī)制研究

【摘要】:隨著我國行政體制改革、行政審批制度優(yōu)化的深入以及服務(wù)型政府理念的興起,行政審批流程優(yōu)化再造的課題被提上日程。行政服務(wù)中心的出現(xiàn)適應(yīng)了當(dāng)前變化,這種將各部門授權(quán)集中起來的方式在總體上實(shí)現(xiàn)了權(quán)力下放強(qiáng)度度和廣度的增加。 國內(nèi)關(guān)于行政服務(wù)中心的研究主要從公共管理、制度經(jīng)濟(jì)學(xué)、法學(xué)這三個(gè)視角切入并重點(diǎn)關(guān)注了行政服務(wù)中心產(chǎn)生的背景、功能、面臨的問題、發(fā)展對策這幾個(gè)方面的問題。國外對于行政服務(wù)中心的基本內(nèi)容與國內(nèi)大同小異,主要涉及行政服務(wù)中心的基本宗旨、面臨的挑戰(zhàn)、新型行政服務(wù)機(jī)構(gòu)建設(shè)的必要性。 杭州市行政服務(wù)中心在取得良好成績的同時(shí)也存在一定的運(yùn)行障礙,主要包括:審批事項(xiàng)的機(jī)械整合、組織內(nèi)部目標(biāo)—行動的局部性沖突、組織內(nèi)部共謀的事實(shí)不能、組織內(nèi)關(guān)系的困境、績效管理的缺陷、組織內(nèi)部的資源利用不足,而引發(fā)行政服務(wù)中心這些運(yùn)行障礙的誘因主要有以下幾個(gè)方面:合法性不足、科層制結(jié)構(gòu)的影響、部門的權(quán)力—利益枷鎖。 在分析障礙以及相應(yīng)原因的基礎(chǔ)上,行政服務(wù)中心若要克服障礙,需要從完善相關(guān)的制度、運(yùn)行框架;組織結(jié)構(gòu)上的改革;加強(qiáng)對行政審批的再簡化與監(jiān)督。 透過以上的分析可以發(fā)現(xiàn),其實(shí)行政服務(wù)中心的出現(xiàn)與運(yùn)行背后隱含的是對權(quán)力的整合、重構(gòu)與分配,這種公共服務(wù)形式是對既有權(quán)力結(jié)構(gòu)和組織運(yùn)行架構(gòu)的創(chuàng)新嘗試。 當(dāng)然,窗口及其所屬部門肯定會重視自身的服務(wù)職能,盡力為民眾和企業(yè)做好工作,因?yàn),無論怎樣,部門將窗口派出之后必將直接與民眾、企業(yè)存在各種互動,成為被監(jiān)督點(diǎn)的延伸,窗口工作倘若存在問題為民眾所不滿投訴,那么也將影響整個(gè)部門的形象和效績。但是,對于窗口的授權(quán)不足,必然會影響提供服務(wù)的質(zhì)量和服務(wù),影響外部對窗口的評價(jià)和質(zhì)疑,所以,部門總是在不停的選擇合適的點(diǎn),而且目前并沒有一個(gè)高效的法律依據(jù)對授權(quán)的情況進(jìn)行規(guī)定和說明,使得服務(wù)工作的隨意性更加大。 其實(shí),只要有政治世界的存在,權(quán)利的博弈就不可能消除,而與權(quán)力連帶的各種現(xiàn)象同樣會層出不窮,無論政府部門對于結(jié)構(gòu)、制度進(jìn)行何種設(shè)計(jì)、修改和安排,最終很難改變這樣的局面。但這并不意味著我們只能束手就擒,還是能夠依靠力量進(jìn)行調(diào)整,不斷地實(shí)踐能夠推動政府工作、各種理論持續(xù)地向前發(fā)展,這種權(quán)力悖論反而是前進(jìn)與發(fā)展的動力。
[Abstract]:With the reform of the administrative system, the deepening of the optimization of the administrative examination and approval system and the rise of the concept of service-oriented government, the issue of the optimization and reengineering of the administrative examination and approval process has been put on the agenda. The emergence of administrative service centres has adapted to the current changes, and this way of centralizing the delegation of authority across departments has generally resulted in an increase in the intensity and breadth of decentralization. The domestic research on the administrative service center mainly focuses on the background, function, problems and development countermeasures of the administrative service center from the perspectives of public management, institutional economics and law. The basic contents of administrative service center in foreign countries are much the same as those in China. They mainly involve the basic purpose of administrative service center, the challenge faced and the necessity of building new administrative service institution. At the same time, the Hangzhou Administrative Service Center also has certain operational obstacles, including: mechanical integration of examination and approval items, local conflicts between goals and actions within the organization, and the fact that there is no collusion within the organization. The predicament of the relationship within the organization, the defect of the performance management, the insufficient utilization of the resources within the organization, and the causes of these obstacles in the administrative service center mainly include the following aspects: lack of legitimacy, influence of the hierarchy structure, The power-benefit shackles of the department. On the basis of analyzing the obstacles and the corresponding reasons, if the administrative service center wants to overcome the obstacles, it needs to perfect the relevant system, run the frame, reform the organizational structure and strengthen the resimplification and supervision of the administrative examination and approval. Through the above analysis, we can find that the emergence and operation of the administrative service center implies the integration, reconstruction and distribution of power. This form of public service is an attempt to innovate the existing power structure and the organizational operation structure. Of course, the window and its departments will certainly attach importance to their own service functions and do their best for the public and enterprises, because, in any case, after the department sends the window out, it will definitely directly interact with the public and the enterprises. As an extension of the supervised point, problems in the window work will affect the image and performance of the whole department if they are complained about by the public. However, inadequate delegation of authority to the window will inevitably affect the quality and service of service delivery and the external evaluation and questioning of the window, so departments are constantly choosing the right points. Moreover, there is no efficient legal basis to regulate and explain the situation of authorization, which makes the work of service more arbitrary. In fact, as long as there is a political world, the game of rights cannot be eliminated, and various phenomena associated with power will emerge in endlessly, no matter what kind of design, modification and arrangement government departments make about the structure, system, etc. It will be hard to change that in the end. But this does not mean that we can only get caught without a hand, or can rely on the strength to adjust, constantly practice can promote the work of the government, various theories continue to develop, this power paradox is the driving force of progress and development.
