【摘要】：產(chǎn)品質(zhì)量是關(guān)系人民群眾健康安全的重大國計(jì)民生問題，是一個(gè)國家和地區(qū)經(jīng)濟(jì)實(shí)力的綜合反映，也是政府管理水平和效率的反映。廣東作為制造業(yè)大省，世界制造業(yè)中心之一，尤其是在全國率先提出了質(zhì)量強(qiáng)省進(jìn)而上升為質(zhì)量強(qiáng)省戰(zhàn)略之后，以電梯質(zhì)量監(jiān)管為試點(diǎn)，積極探索新形勢(shì)下質(zhì)量監(jiān)管體系建設(shè)，并取得了顯著成效。本研究著眼于經(jīng)濟(jì)社會(huì)發(fā)展的新要求，以制造業(yè)產(chǎn)品為對(duì)象，緊緊圍繞政府監(jiān)管這一關(guān)鍵環(huán)節(jié)，根據(jù)公共管理政府管制理論，運(yùn)用文獻(xiàn)研究、比較分析研究等方法，力爭系統(tǒng)剖析監(jiān)管模式之弊端，，進(jìn)而借鑒國內(nèi)外先進(jìn)經(jīng)驗(yàn)，提出構(gòu)建現(xiàn)代質(zhì)量政府監(jiān)管體系的對(duì)策建議。 本研究結(jié)果認(rèn)為，近年來尤其是黨的十八大以來，廣東省在全國率先開展電梯監(jiān)管體制、產(chǎn)品質(zhì)量監(jiān)督抽查、行政審批制度等方面改革，成效顯著。然而，深化產(chǎn)品質(zhì)量政府監(jiān)管體系建設(shè)，仍面臨著繁重任務(wù)和挑戰(zhàn)，脫胎于計(jì)劃經(jīng)濟(jì)年代的現(xiàn)行質(zhì)量政府監(jiān)管體制，從理念到模式都不能適應(yīng)和有效服務(wù)快速的經(jīng)濟(jì)社會(huì)發(fā)展，其突出的問題是：消費(fèi)者權(quán)益包括賠償?shù)葲]有得到真正保障；違規(guī)企業(yè)沒有受到應(yīng)有的懲罰，致使偽劣產(chǎn)品不能有效杜絕；政府的“替代角色”即行政為主的監(jiān)管模式的高成本、高風(fēng)險(xiǎn)和不可持續(xù)性凸顯。這些問題的根源在于現(xiàn)行監(jiān)督模式嚴(yán)重扭曲了權(quán)責(zé)關(guān)系和監(jiān)管重點(diǎn)，弱化了企業(yè)的主體責(zé)任，制約和限制了社會(huì)監(jiān)管力量和司法力量有效發(fā)揮。 本研究的對(duì)策建議是：完善政府監(jiān)管，要緊緊圍繞構(gòu)建現(xiàn)代產(chǎn)品質(zhì)量政府監(jiān)管體系這一主題，搶抓機(jī)遇，大膽實(shí)踐，著力推進(jìn)質(zhì)量監(jiān)管體制改革，創(chuàng)新機(jī)制�？傮w思路是：打造以強(qiáng)化行政手段為主要方式的傳統(tǒng)政府監(jiān)管模式，理清政府與市場(chǎng)的邊界，培育市場(chǎng)經(jīng)濟(jì)要素，發(fā)揮社會(huì)監(jiān)管力量，共同構(gòu)建現(xiàn)代化社會(huì)治理體系。主要措施是：加強(qiáng)社會(huì)監(jiān)督和綜合治理，形成以企業(yè)主體責(zé)任落實(shí)為核心、權(quán)益保護(hù)為基礎(chǔ)、保險(xiǎn)救濟(jì)和社會(huì)救助為保障、質(zhì)量檢測(cè)和安全風(fēng)險(xiǎn)監(jiān)測(cè)與評(píng)估為技術(shù)支撐、政府監(jiān)管為一般強(qiáng)制的現(xiàn)代監(jiān)管體系。
[Abstract]:Product quality is a major national economy and livelihood issue related to the health and safety of the people, a comprehensive reflection of the economic strength of a country and a region, as well as a reflection of the level and efficiency of government management. One of the manufacturing centers in the world, especially after the national strategy of strengthening the quality of the province and then rising to a strong province of quality, took the elevator quality supervision as a pilot, and actively explored the construction of the quality supervision system under the new situation. This study focuses on the new requirements of economic and social development, takes the manufacturing products as the object, closely revolves around the key link of government supervision, according to the theory of public management government regulation, and applies the literature research. Through comparative analysis and research, the author tries to analyze the malpractice of supervision mode systematically, and then draw lessons from the advanced experience at home and abroad, and put forward the countermeasures and suggestions for constructing the modern quality government supervision system. The results of this study indicate that in recent years, especially since the 18 National Congress of the CPC, Guangdong Province has taken the lead in carrying out the reform of elevator supervision system, product quality supervision and spot check, administrative examination and approval system in the whole country, and has achieved remarkable results. Deepening the construction of the government supervision system of product quality still faces heavy tasks and challenges. The current quality government supervision system, which was born in the planned economy era, can not adapt to and effectively serve the rapid economic and social development from the concept to the mode. The outstanding problems are: consumers' rights and interests, including compensation, etc., have not been really guaranteed, the illegal enterprises have not been punished properly, resulting in the fake and inferior products can not be effectively eliminated; The "substitute role" of the government is the high cost, high risk and unsustainability of the administrative supervision mode. The root of these problems lies in the fact that the current supervision mode seriously distorts the relationship between power and responsibility, and weakens the main responsibility of the enterprise. It restricts and restricts the social supervision and judicial power. The countermeasures and suggestions of this study are as follows: to perfect the government supervision, we should focus on the theme of constructing the modern product quality government supervision system, seize the opportunity, practice boldly, and make great efforts to promote the quality supervision system reform. The overall idea is to create a traditional mode of government supervision, which takes the strengthening of administrative means as the main way, to clear the border between the government and the market, to cultivate the elements of the market economy, and to bring into play the power of social supervision. The main measures are: to strengthen social supervision and comprehensive management, to form a system based on the implementation of the responsibility of the main body of the enterprise, to protect the rights and interests, and to safeguard the insurance relief and social assistance, Quality inspection and safety risk monitoring and assessment are supported by technology, and government supervision is a general compulsory modern regulatory system.
