沈陽市商業(yè)銀行反洗錢工作對策研究

【摘要】:洗錢犯罪對國家和金融行業(yè)危害極大,擾亂了正常的經(jīng)濟金融秩序,破壞了現(xiàn)代社會的信用系統(tǒng),最終可能觸發(fā)經(jīng)濟危機。商業(yè)銀行反洗錢工作是我國反洗錢管理工作體系的一個重要分支,基層商業(yè)銀行則是反洗錢最前沿窗口,其反洗錢工作質(zhì)量直接關(guān)系到商業(yè)銀行反洗錢工作水平。 本文運用公共政策分析理論,采用實證數(shù)據(jù)統(tǒng)計分析、數(shù)據(jù)對比等方法,收集并整理了沈陽市商業(yè)銀行反洗錢工作的運營數(shù)據(jù),分析研究了沈陽市商業(yè)銀行反洗錢工作現(xiàn)狀及存在的問題。運用政府失靈理論及公共部門戰(zhàn)略管理理論,借鑒國內(nèi)外先進經(jīng)驗,針對存在的問題制定了改進方案及配套對策。 作者認為,現(xiàn)階段沈陽市商業(yè)銀行反洗錢存在以下問題:甄別工作質(zhì)量參差不齊、人員崗位配置不足、技術(shù)手段老化及身份識別難等。經(jīng)過對問題產(chǎn)生的原因進行剖析,總結(jié)出產(chǎn)生上述問題的原因主要有商業(yè)銀行追求利益最大化、國際形勢變化多樣以及公眾配合度不高。通過運用公共管理理論,借鑒美國、香港等國家和地區(qū)的反洗錢先進經(jīng)驗,提出了“125”改進方案,建議基層反洗錢工作應樹立統(tǒng)一和科學的反洗錢工作理念、建立完善的“雙線”反洗錢組織結(jié)構(gòu)、優(yōu)化反洗錢五個日常操作模式。作者認為反洗錢的工作理念應以“風險為本”,反洗錢組織結(jié)構(gòu)應建立“業(yè)務與監(jiān)管分離運行”的組織架構(gòu),同時應從加強反洗錢日常培訓體制、采取集中處理的作業(yè)模式、更新科技平臺、加大對公眾的宣傳力度、建立獎懲機制五個方面優(yōu)化反洗錢日常操作模式,并對該方案進行了可行性分析。同時,為保證“125”方案的順利實施提出了完善法律法規(guī)、建立信息平臺、健全激勵機制等方面的對策建議。
[Abstract]:The crime of money laundering does great harm to the country and the financial industry, disrupts the normal economic and financial order, and undermines the credit system of modern society. Commercial banks are an important branch of China's anti-money laundering management system, while grass-roots commercial banks are the most advanced window for anti-money laundering. The quality of anti-money-laundering work is directly related to the level of anti-money-laundering work of commercial banks. Based on the theory of public policy analysis, this paper collects and collates the operation data of anti-money laundering work of Shenyang commercial bank by means of empirical data statistical analysis, data contrast and so on. This paper analyzes and studies the present situation and existing problems of anti-money laundering work of commercial banks in Shenyang, applies the theory of government failure and the theory of strategic management of public sector, draws lessons from the advanced experience at home and abroad, and formulates the improvement scheme and supporting countermeasures for the existing problems. The author believes that the following problems exist in Shenyang Commercial Bank's anti-money laundering at present: the quality of the screening work is uneven, the personnel allocation is insufficient, the technical means are aging and the identification is difficult, and so on. The reasons for the above problems are summarized as follows: commercial banks pursue the maximization of benefits, the international situation is diverse and the degree of public cooperation is not high. By using the theory of public management, we can learn from the United States. The advanced anti-money laundering experiences of Hong Kong and other countries and regions have put forward the "125" improvement plan, and it is suggested that the grass-roots anti-money laundering work should establish a unified and scientific anti-money laundering work concept and establish a perfect "two-line" anti-money laundering organization structure. The author thinks that the working concept of anti-money laundering should be risk-based, the organizational structure of anti-money laundering should set up the organizational structure of "separate operation of operation and supervision", and the daily training system of anti-money laundering should be strengthened at the same time. Adopt the centralized operation mode, update the science and technology platform, increase the publicity to the public, establish the reward and punishment mechanism to optimize the daily operation mode of anti-money laundering, and carry on the feasibility analysis to this scheme. In order to ensure the smooth implementation of "125" scheme, the author puts forward some countermeasures and suggestions on perfecting laws and regulations, establishing information platform and perfecting incentive mechanism.
