【摘要】：中國(guó)公立高校教師取消事業(yè)編制的改革已經(jīng)提上議事日程,但由于教師事業(yè)編制與高校法律地位直接相關(guān),所以解決教師編制問(wèn)題的前提是明確高校的法律地位。目前,一般認(rèn)為高校在法律上屬于事業(yè)單位或者法律法規(guī)授權(quán)的組織,然而隨著法治社會(huì)的發(fā)展,這兩種認(rèn)識(shí)都顯示出諸多不足,在一定程度上也會(huì)阻礙公立高校的發(fā)展。在新形勢(shì)下,有必要借鑒境外成熟做法,引入公務(wù)法人制度,通過(guò)修法等方式確立高校的公務(wù)法人地位,這對(duì)推動(dòng)包括取消教師事業(yè)編制等在內(nèi)的高等教育綜合改革有積極作用。
[Abstract]:The reform of canceling the establishment of public university teachers in China has been put on the agenda, but it is directly related to the legal status of colleges and universities. Therefore, the premise of solving the problem of teacher establishment is to clarify the legal status of universities. At present, it is generally considered that universities belong to institutions or organizations authorized by laws and regulations. However, with the development of the rule of law society. In the new situation, it is necessary to draw lessons from overseas mature practices and introduce the system of public legal person. The establishment of the status of public servant as a legal person in colleges and universities through the revision of the Law has a positive effect on promoting the comprehensive reform of higher education, including the abolition of the establishment of teachers' undertakings.
