【摘要】：我國(guó)行政委托現(xiàn)有規(guī)范框架在實(shí)踐中幾近被全面突破,這盡管是政府尋求自新的表征,但也是威脅行政民主的新風(fēng)險(xiǎn)。通過(guò)立法規(guī)范行政委托,本質(zhì)上是行政組織權(quán)的法律保留,其關(guān)鍵在于,相關(guān)規(guī)定需在保證行政民主的前提下不阻礙組織效率。基于"委托—代理"原理、行政體制改革的價(jià)值原理、行政與立法分權(quán)制衡原理等三方面考慮,行政委托的法律保留事項(xiàng)不應(yīng)包括"法律依據(jù)"這一內(nèi)容,而應(yīng)聚焦于"受托主體的資質(zhì)條件"、"禁止性委托事項(xiàng)"和"行政委托的程序規(guī)則"等內(nèi)容。
[Abstract]:China's existing administrative entrustment framework in practice is almost full breakthrough, although this is the government for the new representation, but also the threat of new risk administrative democracy. Through legislative norms of administrative entrustment, is essentially a legal right to retain administrative organization, the key is, the relevant provisions in the administrative democracy under the premise don't hinder the organization efficiency. Based on the "principal-agent" principle, value principle of the reform of administrative system, administrative and legislative principle of decentralization and balance three considerations, the administrative entrustment of legal reservation matters should not include "legal basis" of the content, but should focus on the qualifications of the subjects "," Prohibition of the principal matters "and" administrative entrustment procedure rules and so on.
