【摘要】：改革開放以來，隨著中國社會主義現(xiàn)代化建設(shè)的快速發(fā)展，城市的功能和結(jié)構(gòu)越來越復(fù)雜，各類功能高度集中，各種利益需求矛盾日益突出，給城市管理帶來諸多問題。城市管理行政執(zhí)法在中國通過實踐和超過十年的發(fā)展，既影響經(jīng)濟社會的穩(wěn)定與發(fā)展，也關(guān)乎每個公民的權(quán)利與利益。但在實踐中，城市管理行政執(zhí)法面臨巨大困境，引起了公眾和媒體的廣泛關(guān)注。因此，有效改善城市管理行政執(zhí)法就成為當(dāng)前推進國家治理體系和治理能力現(xiàn)代化的一個重要方面。 本文在對國內(nèi)關(guān)于城市管理、行政執(zhí)法的相關(guān)研究進行總結(jié)的基礎(chǔ)上，運用科學(xué)發(fā)展觀、新公共管理理論和治理理論，以浙江省嘉興市城市管理行政執(zhí)的實踐為例，對我國城市管理行政執(zhí)法的現(xiàn)狀進行了分析。嘉興市城管執(zhí)法取得了較大的成績，城市管理行政執(zhí)法體制不斷完善，為行政管理模式改革積累了經(jīng)驗，有效地解決了部分重點難點問題。但是，城市管理行政執(zhí)法依然存在一些不足，如城市管理行政執(zhí)法保障有待加強，城市管理行政執(zhí)法程序有待規(guī)范，城市管理行政執(zhí)法隊伍有待優(yōu)化等。存在這些不足的主要原因有，城市管理行政執(zhí)法工作缺乏法律和組織保障，城市管理行政執(zhí)法工作缺乏社會認(rèn)同，城市管理行政執(zhí)法工作缺乏正面宣傳。 結(jié)合理論分析，針對實踐中發(fā)現(xiàn)的不足及其主要原因，，本文認(rèn)為應(yīng)從以下四個方面優(yōu)化城市管理行政執(zhí)法工作。第一，明確城市管理行政執(zhí)法的目標(biāo)。城市管理行政執(zhí)法工作要以依法行政為準(zhǔn)繩，以群眾滿意為標(biāo)準(zhǔn)，以服務(wù)發(fā)展為要求；第二，完善城市管理行政執(zhí)法的法規(guī)。明確城市管理行政執(zhí)法工作的法律授權(quán)問題，厘清城市管理行政執(zhí)法工作的執(zhí)法保障問題，著力加快城市管理行政執(zhí)法的相關(guān)立法進程；第三，健全城市管理行政執(zhí)法的體制。正視城市管理行政執(zhí)法工作的體制機制的問題，從體制機制上規(guī)范統(tǒng)一城市管理行政執(zhí)法機構(gòu)，借鑒先進經(jīng)驗完善城市管理行政執(zhí)法體制機制；第四，優(yōu)化城市管理行政執(zhí)法的隊伍。重視城管執(zhí)法工作中的人員保障的問題，提升城市管理行政執(zhí)法人員的個人素質(zhì)，加強城市管理行政執(zhí)法隊伍的整體建設(shè)。
[Abstract]:Since the reform and opening up, with the rapid development of Chinese socialist modernization construction, the function and structure of the city more and more complex, all kinds of highly concentrated, various interests have become increasingly prominent, brought many problems to the city management. The administrative law enforcement of city management through more than ten years of practice and development in China, not only affects the stability and development of economy and society also, relating to the rights and interests of every citizen. But in practice, the administrative law enforcement of city management is facing a huge dilemma, caused widespread concern of the public and the media. Therefore, effectively improve the city management of administrative law enforcement has become an important aspect of the promotion of national governance systems and governance capacity modernization.
Based on the domestic related researches on city management and administrative law enforcement are summarized, with Scientific Outlook on Development, the new public management theory and governance theory, in Zhejiang Province, Jiaxing city management administrative enforcement practice as an example, the administrative law enforcement of city management in China is analyzed. The Jiaxing municipal law enforcement made great achievements, and constantly improve the city management of administrative law enforcement system, accumulated the experience for the administrative reform of management mode, effectively solve some difficult problem. However, the administrative law enforcement of city management still exist some problems, such as the city administrative law enforcement protection should be strengthened and the city management administrative law enforcement procedure should be standardized, city management administrative law enforcement team needs to be optimized. These problems are mainly due to the lack of law enforcement in city administration, legal and organizational security, city management of administrative law enforcement The work lacks social identity, and the administrative law enforcement of urban management lacks positive publicity.
Based on theoretical analysis, aiming at the shortage in practice and its main reasons, this paper argues the following four aspects of the optimization of city management of administrative law enforcement work. First, clear administrative law enforcement of city management. The city management of administrative law enforcement work in administration according to law as the criterion, to the satisfaction of the masses as the standard, to serve the development requirements; second. To improve the administrative law enforcement of city management regulations clearly. City management administrative law enforcement work authorized by law, law enforcement security issues to clarify the city administrative law enforcement work, administrative law enforcement of city management efforts to accelerate the process of legislation; third, perfect the administrative law enforcement of city management system. The system face the city management of administrative law enforcement problems, from unified city management system and mechanism of administrative law enforcement agencies, learn from the advanced experience of perfecting administrative law enforcement of city management system machine System; fourth, optimize the administrative enforcement team of urban management, attach importance to the issue of personnel protection in urban management and law enforcement work, improve the personal quality of administrative law enforcement personnel in urban management, and strengthen the overall construction of urban management administrative law enforcement team.
