【摘要】：自2003年“非典”以后，我國(guó)的突發(fā)環(huán)境事件發(fā)生數(shù)量逐步增多，突發(fā)環(huán)境事件的應(yīng)對(duì)成為公共管理領(lǐng)域格外關(guān)注的重大問(wèn)題。突發(fā)環(huán)境事件發(fā)生后，對(duì)正常的社會(huì)秩序造成巨大的沖擊，產(chǎn)生的破壞力不可估量，如果政府不能夠及時(shí)的公開(kāi)相關(guān)的信息，整個(gè)社會(huì)可能會(huì)陷入癱瘓狀態(tài)中。 當(dāng)前我國(guó)雖然已經(jīng)初步建立了突發(fā)環(huán)境事件應(yīng)對(duì)體系，政府信息公開(kāi)也越來(lái)越規(guī)范，但是仍然存在許多的問(wèn)題。首先，突發(fā)環(huán)境事件中政府信息公開(kāi)的相關(guān)立法還不完善，立法效力層次低和立法模式單一；其次，突發(fā)環(huán)境事件中政府信息公開(kāi)的程序還不規(guī)范，信息公開(kāi)費(fèi)用承擔(dān)不合理，具體公開(kāi)途徑不全面，公開(kāi)的期限還不恰當(dāng)；第三，政府信息公開(kāi)的權(quán)利救濟(jì)制度還不健全，救濟(jì)范圍日趨縮�。坏谒�，政府信息公開(kāi)的行政問(wèn)責(zé)機(jī)制存在較大缺失，問(wèn)責(zé)結(jié)果不徹底。 在分析我國(guó)突發(fā)環(huán)境事件中政府信息公開(kāi)存在問(wèn)題的基礎(chǔ)上，通過(guò)借鑒美國(guó)、歐盟和日本等國(guó)家的先進(jìn)經(jīng)驗(yàn)，分析我國(guó)突發(fā)環(huán)境事件信息公開(kāi)立法體系，奠定政府信息公開(kāi)的基本原則；規(guī)范政府在突發(fā)環(huán)境事件中的運(yùn)行程序，重點(diǎn)強(qiáng)化區(qū)分公開(kāi)和不公開(kāi)的范圍，，增強(qiáng)政府信息公開(kāi)的公正性；健全政府信息公開(kāi)權(quán)利救濟(jì)的制度，擴(kuò)張權(quán)利救濟(jì)的范圍、推進(jìn)信息公開(kāi)公益訴訟發(fā)展進(jìn)程；在行政體制內(nèi)部建立一個(gè)長(zhǎng)期有效的行政問(wèn)責(zé)機(jī)制。
[Abstract]:Since the 2003 "SARS" in the future, China's environmental emergencies happen gradually increasing the number of environmental emergencies, should pay special attention to become a major problem in the field of public management. Environmental emergencies occurred, resulting in a huge impact on the normal social order, the breaking force is immeasurable, if the government can not open the relevant information in time, the whole society may be paralyzed.
Although our country has initially established the environmental emergency response system, government information publicity is increasingly standardized, but there are still many problems. First, the legislation of government environmental emergencies information disclosure is not perfect, the low level of legislation and legislative effect single mode; secondly, the government information disclosure program in environmental emergencies is not standardized, information disclosure cost is not reasonable, in particular ways is not comprehensive, open time is not appropriate; third, the government information public rights relief system is not perfect, the relief scope gradually reduced; fourth, the government information disclosure administrative accountability mechanism there is a big lack of accountability, results are not completely.
In the analysis of the government information disclosure in China in environmental emergencies on the basis of the issues, by drawing on the advanced experience of the United States, the European Union and Japan and other countries, the analysis of environmental emergencies information disclosure of China's legislative system, establishes the basic principles of government information disclosure; standardize the government in environmental emergencies in running the program, focus on strengthening the public distinguish and the scope of the public, enhance the fairness of government information publicity; improve the publicity of government information rights remedy system, expand the scope of right relief, and promote information disclosure litigation development process; to establish a long-term effective mechanism of administrative accountability in the administrative system.
