施工總承包企業(yè)與勞務(wù)分包企業(yè)運作機制建設(shè)研究

【摘要】:在建設(shè)工程中,除了材料分包商的數(shù)量占比重最大外。建筑勞務(wù)分包數(shù)量占的比重居于次席。而建筑勞務(wù)分包更加涉及到一個相對很敏感的“農(nóng)民工”的問題。因此,如何解決建筑工程勞務(wù)分包機制的建設(shè)問題,一直是我國建筑業(yè)關(guān)心的重點環(huán)節(jié)。 本文通過分析當(dāng)前勞務(wù)分包問題的成因,結(jié)合我國建筑勞務(wù)分包的發(fā)展歷程,以及各國關(guān)于建筑勞務(wù)分包問題相應(yīng)的解決方法,提出現(xiàn)階段國內(nèi)建筑勞務(wù)分包履約過程沒有得到有效的監(jiān)督和約束,勞務(wù)分包模式缺乏完善的合同管理,勞務(wù)工人流動性過大,施工總承包企業(yè)缺乏勞動用工管理意識,建筑施工勞務(wù)分包招投標(biāo)制度欠缺,勞務(wù)分包企業(yè)資金鏈脫節(jié)等目前我國建筑行業(yè)存在的一系列問題。 論文從建筑勞務(wù)分包機制建設(shè)問題出發(fā)討論,以建筑施工總承包企業(yè)及及建筑勞務(wù)分包企業(yè)的利益雙方的博弈均衡為出發(fā)點。經(jīng)過建立雙方在不同合作模式下的成本—收益模型,探尋總承包公司與勞務(wù)分包企業(yè)的成本收益平衡點,且通過各種不同的制衡方法解決勞務(wù)雙方的違法尋租問題。本文創(chuàng)新性的引入政府監(jiān)督的建筑勞務(wù)分包的招投標(biāo)機制,并建立相應(yīng)的期望效用模型,提出政府介入的違規(guī)處罰P以及違法概率θ,,決定勞務(wù)合作雙方合作模式和管理模式的選擇。本文進一步提出建立建筑勞務(wù)用工市場運行機制,營造有序的勞務(wù)交易市場的措施;政府引導(dǎo)招投標(biāo)機制介入建筑施工勞務(wù)分包模式,形成有效政府監(jiān)督;鼓勵就地用工減少農(nóng)民工的流動消耗;建立專業(yè)的職業(yè)資格培訓(xùn)認(rèn)證與鑒定服務(wù)體系,并轉(zhuǎn)變職業(yè)技術(shù)學(xué)校的培訓(xùn)觀念,規(guī)范和完善我國的施工總承包企業(yè)與勞務(wù)分包企業(yè)的運作機制。
[Abstract]:In construction projects, in addition to the number of material subcontractors account for the largest proportion. The construction labor subcontract quantity occupies the second place in the proportion. And construction labor subcontracting involves a relatively sensitive issue of migrant workers. Therefore, how to solve the construction of construction engineering labor subcontracting mechanism has been the focus of our construction industry. This paper analyzes the causes of the current labor subcontracting problem, combined with the development of construction labor subcontracting in China, as well as the corresponding solutions to the construction labor subcontracting problems in various countries. It is pointed out that the process of domestic construction labor subcontracting has not been effectively supervised and restrained at present, the mode of labor subcontracting lacks perfect contract management, the labor workers mobility is too large, and the construction general contracting enterprises lack the consciousness of labor employment management. There are a series of problems existing in the construction industry of our country at present, such as the lack of the bidding system of construction labor subcontracting and the disconnection of capital chain of labor subcontracting enterprises. Starting from the construction of construction labor subcontracting mechanism, this paper starts with the game equilibrium between the construction construction general contracting enterprises and the construction labor subcontracting enterprises. Through establishing the cost-benefit model of the two sides under different cooperation modes, the paper explores the cost-benefit balance point between general contracting company and labor subcontract enterprise, and solves the problem of illegal rent-seeking by various checks and balances. This paper innovatively introduces the bidding mechanism of construction labor subcontracting supervised by the government, and establishes the corresponding expected utility model. This paper puts forward the penalty P and the probability 胃 of violating the law, which determines the choice of cooperation mode and management mode between labor cooperation and labor cooperation. This paper further puts forward the measures of establishing the operation mechanism of the construction labor market and creating an orderly labor trade market, the government guiding the bidding mechanism to intervene in the construction construction labor subcontracting mode, and forming effective government supervision; Encourage local employment to reduce the flow consumption of migrant workers, establish professional vocational qualification training certification and appraisal service system, and change the training concept of vocational and technical schools, Standardize and perfect the operation mechanism of construction general contracting enterprises and labor subcontracting enterprises in China.
