【摘要】:登記是不動產(chǎn)物權(quán)的公示方式,直接關(guān)系著不動產(chǎn)物權(quán)的取得和行使。我國對城市地下空間登記并沒有比較系統(tǒng)的研究,主要的研究成果大多散見于地下空間管理政策以及不動產(chǎn)統(tǒng)一登記制度中。本文通過闡述地下空間登記的基本理論,分析我國城市地下空間登記的立法現(xiàn)狀及存在的問題,明確了進行地下空間登記的必要性;結(jié)合典型國家和地區(qū)地下空間權(quán)利設(shè)立及登記制度的相關(guān)經(jīng)驗,構(gòu)建符合我國國情的城市地下空間登記制度,以更合理的利用地下空間,保護權(quán)利人的合法權(quán)益,維護市場交易秩序,提高管理效率。本文共分為四部分,內(nèi)容概括如下:第一部分為城市地下空間登記制度概述。首先通過分析地下空間的屬性明確了城市地下空間的概念。根據(jù)學(xué)界的研究成果及我國法律的規(guī)定明晰城市地下空間權(quán)的概念、分類及性質(zhì),并對城市地下空間登記的含義、內(nèi)容、性質(zhì)、及模式進行介紹,之后提出進行地下空間登記的必要性。第二部分是我國城市地下空間登記立法現(xiàn)狀及問題。我國目前尚無關(guān)于城市地下空間登記的專門立法;全國性的不動產(chǎn)登記法律、法規(guī)也只是籠統(tǒng)的規(guī)定對不動產(chǎn)進行登記,對城市地下空間登記沒有專門的規(guī)定;一些發(fā)達地區(qū)雖進行了相關(guān)立法,但仍不能滿足地下空間的登記需求。這一現(xiàn)狀也反映了我國城市地下空間登記所存在的諸多問題。第三部分為典型國家和地區(qū)相關(guān)立法經(jīng)驗及對我國的啟示。從世界范圍看,地下空間開發(fā)利用較早的國家和地區(qū),有關(guān)地下空間的立法也較為先進。美國、日本、德國等國家及我國的臺灣地區(qū),地下空間開發(fā)利用較早,在地下空間權(quán)利設(shè)置、地下空間登記等方面的立法經(jīng)驗,為我國城市地下空間登記制度的建立提供了有益的參考。第四部分為我國城市地下空間登記制度的構(gòu)建。構(gòu)建城市地下空間登記制度,應(yīng)立足我國國情,借鑒國外相關(guān)立法經(jīng)驗,設(shè)立統(tǒng)一的不動產(chǎn)登記機構(gòu),將地下空間登記納入其中,并統(tǒng)一地下空間登記形式:進行相關(guān)立法,明確城市地下空間登記的范圍,理清城市地下空間權(quán)屬關(guān)系,規(guī)范地下空間登記的程序。
[Abstract]:The registration of immovable property in the public way, directly related to real property acquisition and registration in our country. The exercise of city underground space and no systematic research, the main research results are scattered in the underground space management policy, unified registration of immovable property system. This article explains basic theory of underground space registration the legislative analysis of current situation of our city underground space registration and the existing problems, the necessity of underground space registration; with the right of underground space in typical countries and regions set up and relevant experience of the registration system, registration system construction according to the situation of our country city underground space, underground space to more rational use, protection the legitimate rights and interests, maintaining market order, improve the management efficiency. This paper is divided into four parts, as follows: the first part is the city underground space The registration system overview. Firstly, through analyzing the properties of underground space defines the concept of city underground space. According to the regulations of academic research and the law of our country clear city underground space rights concept, classification and properties, and registration of the city underground space of the meaning, content, nature and mode are introduced, then put forward the necessary for underground space registration. The second part is the current situation and problems of legislation of our country city underground space registration. At present there is no specific legislation on city underground space registration; national real estate registration law, law is only a general rule of real estate registration, registration of city underground space not specifically the provisions of some developed areas; although the relevant legislation, but still can not meet the demand of underground space registration. This situation reflects the existence of our country city underground space registration Many of the problems. The third part is the typical countries and regions of the relevant legislative experience and the enlightenment to our country. From the view of the world, the development and utilization of underground space in earlier countries and regions, the relevant legislation of underground space is relatively advanced. The United States, Japan, Germany and other countries and Taiwan region in our country, the development and utilization of underground space earlier set in the underground space, underground space registration rights, legislative experience and other aspects, to provide a useful reference for the establishment of our city underground space registration system. The fourth part of our city underground space registration system construction. The registration system of construction of city underground space, should be based on our national conditions, learn from foreign legislative experience, the establishment of a unified real estate registration agencies, registration of underground space will be included, and the unity of the underground space registration form: related legislation, clarify the scope of city underground space registration, We should clarify the relationship between the power and ownership of the urban underground space and standardize the procedures for the registration of underground space.
