【摘要】：本文意在對(duì)比討論中外礦產(chǎn)資源產(chǎn)權(quán)歸屬現(xiàn)狀。重點(diǎn)研究了加拿大資源產(chǎn)權(quán)所有權(quán)的變遷和歷史進(jìn)程,并以加拿大安大略省為例,論述資源產(chǎn)權(quán)理論在當(dāng)今加拿大礦業(yè)中的實(shí)際應(yīng)用。為了更全面的對(duì)比研究,作者對(duì)美國(guó)、澳大利亞和南非各國(guó)法律法規(guī)中對(duì)資源產(chǎn)權(quán)所有權(quán)的定義和變遷也做了一定的研究和陳述,從而使本文網(wǎng)羅了當(dāng)今世界主要礦業(yè)大國(guó)(中國(guó)、加拿大、澳大利亞、美國(guó)、南非)對(duì)礦產(chǎn)資源產(chǎn)權(quán)所有權(quán)的定義和政策,希望為我國(guó)目前面臨的礦業(yè)權(quán)改革命題供一些參考。
[Abstract]:This paper intends to discuss the status quo of mineral resources ownership in China and foreign countries. It focuses on the changes and historical processes of resource property rights in Canada, and takes Ontario, Canada as an example. This paper discusses the practical application of the theory of resource property right in the mining industry of Canada today. Australia and South Africa in the laws and regulations of the definition and change of ownership of property rights of resources have also made a certain study and statement, thus making this article the main mining countries in the world (China, Canada). The definition and policy of the ownership of mineral resources property rights in Australia, the United States and South Africa hope to provide some references for the proposition of mining right reform that our country is facing at present.
