【摘要】：礦產(chǎn)資源是埋藏在地下的巨大寶藏,對我國的社會經(jīng)濟發(fā)展具有重要意義。近年來,吉林省地質(zhì)勘查工作取得了一系列重要成果,為國民經(jīng)濟發(fā)展提供了大量的基礎地質(zhì)資料。探礦權(quán)出讓、登記審批等礦產(chǎn)資源勘查管理工作日趨完善。然而在礦產(chǎn)資源勘查管理中,仍存在諸多問題如對探礦權(quán)的合理投放、探礦權(quán)退出制度的建立、企業(yè)信用黑白名單的建立、探礦權(quán)市場的監(jiān)管、地質(zhì)礦產(chǎn)勘查行業(yè)管理等方面需要進一步研究規(guī)范。本文以公共管理理論為指導,對我國和吉林省礦產(chǎn)資源勘查管理的發(fā)展歷程進行分析和總結(jié),學習發(fā)達國家管理經(jīng)驗,充分結(jié)合吉林省的礦產(chǎn)資源特點、存在問題和目前經(jīng)濟發(fā)展形勢,提出適應吉林省省情的礦產(chǎn)資源勘查管理改革的原則、目標及具體措施,包括完善法律法規(guī)、建立健全礦產(chǎn)資源勘查管理機制、加強地質(zhì)礦產(chǎn)勘查行業(yè)管理等對策,并創(chuàng)新性提出通過建立企業(yè)信用黑白名單方式逐步形成探礦權(quán)人退出制度。希望通過落實上述對策和措施,最終實現(xiàn)提高吉林省礦產(chǎn)資源勘查行政管理水平的目標。文章主要分為四個部分:第一部分,介紹了選題的目的和意義及文章所涉及的相關概念和基本理論;第二部分,通過對我國的礦產(chǎn)資源勘查管理的發(fā)展歷程和吉林省礦產(chǎn)資源勘查管理的發(fā)展歷程進行研究,分析總結(jié)各階段不同的特點;第三部分,分析吉林省礦產(chǎn)資源勘查管理存在的問題并找出存在問題的根本原因;第四部分,通過對發(fā)達國家礦產(chǎn)資源勘查管理經(jīng)驗的研究,結(jié)合吉林省的自然資源和區(qū)域特點,提出適合吉林省的礦產(chǎn)資源勘查管理改進對策。本文的創(chuàng)新點在于提出建立礦業(yè)企業(yè)黑白名單,將礦業(yè)企業(yè)統(tǒng)一納入征信系統(tǒng)統(tǒng)一管理,這種方式便于連同其他部門共同發(fā)現(xiàn)問題并予以系統(tǒng)性解決,從而對整治探礦權(quán)市場秩序起到良好作用。提出推行探礦權(quán)退出制度,對“圈而不探”等處于法律邊緣界限的行為予以規(guī)范。
[Abstract]:Mineral resources are a huge buried treasure, which is of great significance to the social and economic development of our country. In recent years, a series of important achievements have been made in the geological exploration of Jilin Province. It provides a large amount of basic geological data for the development of national economy. The management of mineral resources exploration and management, such as the transfer of exploration rights, registration and approval, is becoming more and more perfect. However, in the management of mineral resources exploration and management. There are still many problems, such as reasonable investment of prospecting right, establishment of withdrawal system of prospecting right, establishment of black-and-white list of enterprise credit, supervision of prospecting right market. Based on the theory of public management, this paper analyzes and summarizes the development course of mineral resources exploration and management in China and Jilin Province. This paper studies the management experience of developed countries, fully combines the characteristics of mineral resources in Jilin Province, the existing problems and the present economic development situation, and puts forward the principles of mineral resources exploration and management reform adapted to the situation of Jilin Province. The target and concrete measures include perfecting the laws and regulations, establishing and perfecting the management mechanism of mineral resources exploration, strengthening the management of geological and mineral exploration industry and so on. And innovatively put forward through the establishment of enterprise credit black-and-white list way to gradually form a prospecting right to withdraw system. Hope through the implementation of the above countermeasures and measures. Finally realize the goal of improving the administrative level of mineral resources exploration in Jilin Province. The article is divided into four parts: the first part introduces the purpose and significance of the topic and the related concepts and basic theories involved in the article; The second part, by studying the development course of mineral resources exploration and management in China and Jilin Province, analyzing and summarizing the different characteristics of each stage. The third part analyzes the problems existing in mineral resources exploration and management in Jilin Province and finds out the root causes of the problems. Part 4th, through the study of the experience of mineral resources exploration and management in developed countries, combined with the natural resources and regional characteristics of Jilin Province. The innovation of this paper lies in the establishment of black-and-white list of mining enterprises and the integration of mining enterprises into the unified management of credit information system. This method is convenient to find problems together with other departments and solve them systematically, which will play a good role in regulating the market order of prospecting rights, and put forward to carry out the withdrawal system of prospecting rights. To "circle but not explore" and other behavior at the edge of the law to regulate.
