隨著社會(huì)經(jīng)濟(jì)的不斷發(fā)展,人們?cè)絹碓街匾曋R(shí)產(chǎn)權(quán),尤其是商標(biāo)權(quán)。在此背景下,2015年歐盟發(fā)布了《歐洲議會(huì)和歐盟理事會(huì)關(guān)于協(xié)調(diào)成員國(guó)商標(biāo)立法的指令》。本次翻譯實(shí)踐以這份指令作為翻譯素材,將該指令的英文版本譯為中文版本。該指令作為一種協(xié)調(diào)法,重在協(xié)調(diào)歐盟成員國(guó)之間的商標(biāo)實(shí)體法和程序法規(guī)則。其內(nèi)容比《保護(hù)工業(yè)產(chǎn)權(quán)的巴黎公約》更豐富,操作性更強(qiáng),對(duì)我國(guó)協(xié)調(diào)兩岸四地的商標(biāo)法規(guī)則有重要的借鑒意義,對(duì)實(shí)踐中商標(biāo)爭(zhēng)議的解決也有較高的參考價(jià)值。本翻譯實(shí)踐以弗米爾的目的論為指導(dǎo),確定了翻譯的目的和使命。本文分析了原文的語體特征,以商標(biāo)法領(lǐng)域的專業(yè)術(shù)語和長(zhǎng)難句為重點(diǎn),列舉了一些翻譯實(shí)例,詳細(xì)闡述了難點(diǎn)及其解決過程。最后對(duì)本次翻譯實(shí)踐進(jìn)行了總結(jié)。
